CHAPTER 1
er. - Introductory provision
Article 1
er. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER 2. - Amendments to the Act of 29 April 1999
on the organization of the electricity market
Art. 2. In Article 7, § 1
erParagraph 1
er, 1°, of the law of 29 April 1999 on the organization of the electricity market, last amended by the law of 8 January 2012, the sentence "The certificates granted to electricity production facilities from the winds in the marine areas on which Belgium can exercise its jurisdiction in accordance with international maritime law and subject to a concession of the state referred to in article 6 shall not be granted the obligation to repurchase electricity to » is repealed:
Art. 3. In section 21bis of the Act, last amended by the Act of 8 January 2012, the following amendments are made:
1° § 1
erbis is repealed;
2° in § 2, paragraph 1
er4°, the word "between" is replaced by the words "higher than" and the words "and 250,000 MWh/year" between the words "25,000 MWh/year" and the words ": 45 percent" are repealed;
3° in § 2, paragraph 2, the word "When" and the words ", a quantity greater than 250,000 MWh is provided to a final customer," are repealed.
CHAPTER 3. - Amendment of the Royal Decree of March 24, 2003 setting out the terms and conditions of the federal contribution for the financing of certain public service obligations and the costs related to the regulation and control of the electricity market
Art. 4. Article 5 of the Royal Decree of March 24, 2003 establishing the terms of the federal contribution to the financing of certain public service obligations and the costs related to the regulation and control of the electricity market, replaced by Royal Decree of March 27, 2009 amending the Royal Decree of March 24, 2003 establishing the terms of the federal contribution to the financing of certain public service obligations and the costs related to the regulation and control of the electricity market
CHAPTER 4. - Confirmation of two royal decrees under the Act of 29 April 1999 on the organization of the electricity market and the Act of 12 April 1965 on the transport of gaseous and other products by pipelines
Art. 5. The Royal Decree of November 20, 2012 determinating the amounts for 2012 of funds for the financing of the real cost resulting from the application of maximum prices for the supply of electricity and natural gas to residential protected customers is confirmed with effect to 1
er January 2012.
Art. 6. Article 1
er of the Royal Decree of 24 April 2012 amending the Royal Decree of 24 March 2003 setting out the terms of the federal contribution for the financing of certain public service obligations and the costs related to the regulation and control of the electricity market and the Royal Decree of 28 October 2004 establishing the terms and conditions for the management of the fund for the financing of the federal policy for the reduction of greenhouse gas emissions is confirmed with effect on 1
er April 2012.
CHAPTER 5. - Entry into force
Art. 7. Sections 3 and 4 come into force on 1
er January 2013.
