The Chambers have adopted and we endorse the following: Article 1. This Act regulates a matter referred to in article 78 of the Constitution.
S. 2. this Act applies to the public interest organizations, autonomous public enterprises and legal persons on which the federal Government exercises directly or indirectly a dominant influence.
S. 3. for the purposes of this Act, is meant by: 1 ° public interest organizations: public interest organizations referred to in article 1 of the law of 16 March 1954 relating to the control of some public interest organizations falling under the jurisdiction of the Federal Government;
2 autonomous public undertakings °: autonomous public undertakings referred to in article 1, § 4 of the Act of 21 March 1991 on the reform of some economic public companies;
3 ° legal entity over which the federal Government exercises directly or indirectly a dominant influence: the legal entity in which the federal Government has influence:-be concluding with it a management contract or a contract for administration;
-either by designating, directly or indirectly, more than half of members of its governing body, of management or direction or by designating one or more persons responsible for exercising the administrative supervision of the Government in his breast;
-either holding, directly or indirectly, the majority of the subscribed capital;
- either by having, directly or indirectly, the majority of the votes attached to shares issued by the undertaking;
4 ° representative: any person who sits in the Board of directors or management of a legal person referred to in article 2 or who is named in order to exercise the administrative supervision of the Government.
5 ° compensation: any remuneration linked to the exercise of the function, for the purposes of articles 31 and 32 of the income tax Code.
S. 4. the remuneration of the members of staff and representatives of the legal entities referred to in article 2 is paid to them directly and exclusively as a person physical.
Any payment made in contravention of section 1 is zero.
S. 5. this Act comes into force the first day of the seventh month following that of its publication in the Moniteur belge.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
