18 JULY 2012. - An Act to amend the Act of 16 March 1968 concerning the Police of Road Traffic in respect of the restitution of the driver's licence in the event of a loss of the right to drive



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Article 40 of the Act of 16 March 1968 on the Police of Road Traffic is supplemented by two paragraphs written as follows:
"Without prejudice to section 49/1, in the event that the convicted person fails to issue a licence to conduct the licence to the office of the office of the court, the current due period shall be extended in full right of time between the fifth day following the warning referred to in paragraph 1er and the effective date of delivery of the driver's licence.
If a number of sentencing statements are handed down to the convicted person, the public prosecutor may take them to court after the warning. »
Art. 3. In the same Act, an article 49/1 is inserted, which reads as follows:
"Art. 49/1. It is punishable by a fine of 200 euros to 2,000 euros and a loss of the right to drive a motor vehicle for a period of at least one month or only one of these penalties, which, after a loss of the right to drive was pronounced against it, does not return its driver's license within the time limits set by the King.
In case of mitigating circumstances, the fine can be reduced without being less than a euro.
The penalties are doubled if there is a recidivism within three years of a previous judgment, which is pronounced in conviction and in force of evidence. »
Art. 4. This Act comes into force on the first day of the month following the expiration of a period of ten days beginning on the day after its publication in the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
