ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. After a notice of an agency approved for this purpose by the King by decree deliberated in Council of Ministers, the Minister having the Interior in his powers examines the conformity of the online collection systems implemented to collect statements of support for a proposal of citizen initiative, when the data collected are called to be retained in Belgium, to the technical specifications adopted in accordance with Article 6, § 4, of the European Regulation (EU) No.
The King sets out the conditions and procedure for the accreditation of the bodies responsible for giving notice on the conformity of online collection systems.
If compliance referred to in paragraph 1er is established, the Minister having the Interior in his powers shall issue to the organizers of the proposal for a citizen initiative the certificate referred to in Article 6, § 3, of the above-mentioned regulation.
Art. 3. The Minister with the Interior in his duties coordinates the process of verification of the support declarations collected in favour of a proposal for a citizen initiative, when their signatories reside in Belgium or are Belgian nationals residing outside the territory of Belgium. It designates officers who are responsible for examining, on the basis of appropriate controls, whether these support statements are valid under the provisions of the above-mentioned regulation.
The purpose of these controls is to ensure:
1° that the minimum number of signatures to be affixed to support declarations is reached;
2° that the signatories of these support statements have the age to vote in the elections of the European Parliament;
3° that they have the status of Belgian or national of another Member State of the European Union and are registered as a principal residence either in the registers of the population of a Belgian commune or in the registers of a Belgian diplomatic or consular post abroad.
The controls referred to in paragraph 2, 2° and 3° shall be carried out by sampling. The King determines the rules that must be followed for this purpose.
If it is the result of these controls that the support declarations validly collected in favour of the proposal for a citizen initiative are in sufficient number, the Minister having the Interior in his powers shall issue to the organizers of the proposal the certificate referred to in Article 8, § 2, of the above-mentioned regulation, including the number of valid support statements.
