The Chambers have adopted and we endorse the following: Article 1. This Act regulates a matter referred to in article 77 of the Constitution.
S. 2. in the first subparagraph of article 569 of the Judicial Code, amended by the law of 11 April 1989, 21 ° is replaced by the following: ' 21 ° of the claims based on basis of the International Convention of 1992 on civil liability for damage due to oil pollution and taking account of the provisions of paragraph 1 of article IX of this convention; When subsequently a same event of pollution damage occurred partially on national territory, including the territorial sea, or the Belgian exclusive economic zone and partially in the territory, including the territorial sea, or area referred to in article II, a), ii) of the Convention of another State, the Court is competent to hear actions for damages by pollution that occurred in the latter State provided that the limitation fund opposite to the claims forming the subject of the action is constituted by Defender with this tribunal and that the applicant renounces to sue the same defendant for damages caused by such event before a Court of any other State or discontinues this action; ».
S. 3. article 2 of the law of 20 July 1976 relating to the approval and execution of the International Convention on civil liability for oil pollution damage, and annex, made in Brussels on 29 November 1969, is hereby repealed.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
