ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. § 1er. If the lack of payment of money imposed by an order of payment made enforceable or by a judgment cast in force in respect of breaches of the law of 16 March 1968 relating to the police of road traffic, the law of 18 February 1969 relating to the enforcement of treaties and international acts in respect of carriage by sea, by road, by rail or by inland waterway,
§ 2. Failure to pay the sums of money referred to in § 1er, the vehicle can be immobilized. The capital property is lifted as soon as the day of the full payment of money and fees.
The vehicle is immobilized at the cost and risk of the owner of the vehicle.
Any person who makes use or permits a third party to use a vehicle that he or she knows that the immobilization is imposed shall be punished by imprisonment for eight days to six months and a fine of 100 to 1,000 euros, or only one of those penalties.
§ 3. If the debtor has not paid the sums of money due and the costs within 30 days of the date of the vehicle's immobilization, the competent receiver for the recovery of the criminal fines may, after ratification by the judge of the seizures of the jurisdiction in which the office where the removal is to be carried out, allow the forced sale of the vehicle, provided that the debtor is the owner of the vehicle. The procedure is initiated on a unilateral request. The decision of the examining magistrate is enforceable in advance.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
