Posted the: 2013-12-19 Numac: 2013206906 FEDERAL CHANCELLERY of the Prime Minister 4 December 2013 PUBLIC SERVICE. -Act to amend the law of June 17, 2013, motivation, information and remedies in public procurement and some markets works, supplies and services and on the confirmation of the provisions concerning the judicial protection of two royal decrees taken in application of article 80, paragraphs 3 to 5, of the Act of June 15, 2006 on public procurement and certain works contracts supplies and services (1) PHILIPPE, King of the Belgians, to all, present and to come, hi.
The Chambers have adopted and we endorse the following: Article 1. This Act regulates a matter referred to in article 77 of the Constitution.
S. 2. in article 18, 1 °, of the law of June 17, 2013 on motivation, information and remedies in public procurement and certain works contracts, supplies and services, the words "in accordance with the model laid down by the King" are replaced by the words "in accordance with the model set out in the implementing Regulation (EU) No 842/2011 of the Commission on August 19, 2011 establishing standard forms for the publication of notices in the context of the award of public contracts and repealing Regulation (EC) No 1564/2005 ".

3. in the same Act, it is inserted an article 29/1, as follows: «art.» 29/1. With the exception of the markets identified by an accepted invoice, article 10 applies to contracts which the expenditure to approve excluding value added tax does not exceed the thresholds referred to in article 29, § 1. ».
S. 4. in article 35 of the same Act, paragraph (3) is repealed.
S. 5 are confirmed with effect from the date of their entry into respective force and until June 30, 2013: 1 ° the provisions of Chapter 5 "rules regarding motivation, information and remedies" of the royal decree of September 12, 2011, laying down, in relation to the competitive dialogue procedure, the entry into force of the Act of 15 June 2006 on public procurement and certain works contracts supplies and services, and its implementing rules, as well as the special detailed rules for the application of this procedure;
2 ° the provisions of Chapter 2 "rules regarding motivation, information and remedies" of the royal decree of January 24, 2012, fixing the entry into force of the Act of August 13, 2011 on procurement and some markets works, supplies and services in the fields of defence and security, as well as the rules relating to the motivation information and remedies regarding these markets.
S. 6. this Act is effective July 1, 2013, with the exception of article 4, which shall enter into force the day following the publication of this Act in the Moniteur belge.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
