7 JANVIER 2014. - An Act to amend Royal Decree No. 38 of 27 July 1967 organizing the social status of independent workers with respect to the status of the assisting spouse (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In Article 7bis, § 1er, of Royal Decree No. 38 of 27 July 1967 organizing the social status of independent workers, last amended by the law of 9 July 2004, the following amendments are made:
1° a paragraph written as follows is inserted between subparagraphs 1er and 2:
"An independent activity of the assisting spouse does not, however, prevent the retention of the status of a helping spouse as determined in the preceding paragraph, provided that income from that own independent activity does not exceed the amount of 3,000 euros per year."
2° in paragraph 2, which becomes paragraph 3, the words "Previous paragraph" are replaced by the words "Paragraph 1er";
3° in paragraph 4, which becomes paragraph 5, the words "paragraph 2" are replaced by the words "paragraph 3".
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
