26 MARCH 2014. - An Act to amend the Act of 6 July 2005 on Certain Judicial Provisions in Electronic Communications and the Act of 17 January 2003 concerning the appeals and processing of disputes on the occasion of the Act of 17 January 2003 relating to the status of the regulator of the Belgian Post and Telecommunications Sectors (I)

The Chambers adopted and We sanction the following:
CHAPTER 1er. - Object
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
CHAPTER 2. - Amendment of the Act of 6 July 2005 on
certain legal provisions on electronic communications
Art. 2. Article 2, § 1er, of the Act of 6 July 2005 on certain legal provisions concerning electronic communications, the words "and its president or replacement" are inserted between the words "The decisions of the Commission of Ethics for Telecommunications" and the words "may be addressed".
CHAPTER 3. - Amendment of the Act of 17 January 2003 concerning the appeals and processing of disputes on the occasion of the Act of 17 January 2003 relating to the status of the regulator of the sectors of Belgian posts and telecommunications
Art. 3. Article 4, paragraph 1er, the Act of 17 January 2003 concerning the appeals and processing of disputes on the occasion of the Act of 17 January 2003 relating to the status of the regulator of the Belgian postal and telecommunications sectors, as amended by the Acts of 31 May 2009, 13 December 2010 and 3 April 2013, is supplemented by the following sentence:
"The parties are expected to waive the procedure before the Belgian Competition Authority in the event of recourse to the dispute settlement procedure provided for in Article 14, § 1er, 4/1°, of the law of 17 January 2003 referred to above.".
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
