19 AVRIL 2014. - An Act to amend the Act of 21 March 1991 on reform of certain economic public enterprises with regard to the establishment of the RER steering committee



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
CHAPTER Ier. - General provision
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER II. -- Amendment of the Act of 21 March 1991 on reform of certain economic public enterprises
Art. 2. Article 154quater of the Act of 21 March 1991 on the reform of certain economic public enterprises, inserted by the Royal Decree of 11 December 2013, is supplemented by a 3° written as follows:
"3° RER (Reseau Express Régional): the network referred to in Article 2, 2°, of the convention of 4 April 2003 aimed at implementing the programme of the regional express network of, to, in and around Brussels, concluded between the State, the Flemish Region, the Walloon Region and the Brussels Capital Region. ".
Art. 3. In Title V of the Act, a chapter IIIter is inserted, which reads as follows:
"CHAPITRE IIIter. - RER Steering Committee."
Art. 4. In Chapter IIIter, inserted by Article 3, an article 161sexies is inserted, as follows:
"Art. 161sexies. § 1er. The Board of Directors is a RER Steering Committee.
§ 2. The RER steering committee is composed of six directors, including the managing director. The Board of Directors appoints the members of the RER Steering Committee.
§ 3. The RER Steering Committee has as many French-speaking and Dutch-speaking members.
§ 4. The RER steering committee is chaired by the managing director.
§ 5. The RER Steering Committee invites the person who has the direction of the RR service within the SNCB to the RER Steering Committee meetings. This person sits there with an advisory voice.".
Art. 5. In the same chapter, an article 161septics is inserted, as follows:
Art. 161septics. § 1er. The RER Steering Committee sets out a five-year plan proposal for the operation of the RRSP. This proposal includes, in any case, the following:
1° an assessment of the current RRSP operating situation;
2° the strategic and operational objectives related to the operation of the RRSP with an action plan including the planning of actions to be undertaken, their budgetary impact, the personnel required and the timing for their implementation for the next five years;
3° the detailed planning, for the next five years, of the actions to be taken in the operation of the RRSP;
4° a detailed explanation of the financial means, personnel needs and projected deadlines, required for each of the actions referred to in the 3°.
§ 2. The RER Steering Committee shall submit the five-year plan proposal, no later than three months before the expiry of the previous five-year plan, to the approval of the Board of Directors.
The RER Steering Committee may adapt the five-year plan proposal, if any, to the comments that the Board of Directors makes on this proposal.
The Board of Directors shall decide on the proposal for a five-year plan in any case within three months of receipt of the proposal referred to in paragraph 1er.
§ 3. The RER Steering Committee shall report annually to the Board of Directors on the implementation of the five-year plan referred to in § 1erand make recommendations on implementation.
Where applicable, the Board of Directors shall inform the RER Steering Committee in writing of the follow-up to the recommendations referred to in paragraph 1er.
Art. 6. In the same chapter, an article 161octies is inserted, as follows:
"Art. 161octies. § 1er. On its own initiative or at the request of the Board of Directors, the RER Steering Committee shall render to the Board of Directors a prior notice of any decision or decision on the operation of the RRSP. To this end, the decision proposals are communicated to the RER steering committee on time.
§ 2. If the board of directors departs from the notice referred to in § 1er, he motivates his decision. ".
Art. 7. In article 162octies, § 2, as amended by the Royal Decree of 11 December 2013, the words "and RER orientation" are inserted between the words "remuneration" and "dressent".
CHAPTER III. - Transitional provision
Art. 8. By derogation from Article 161septics, § 2, of the Act of 21 March 1991 mentioned above, inserted by Article 5, the RER Orientation Committee shall submit no later than 1er October 2014 the first five-year plan proposal to the Board of Directors and this first plan is approved by the Board of Directors by December 31, 2014.
CHAPTER IV. - Entry into force
Art. 9. This Act comes into force on the day following that of its publication to the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
