The Chambers have adopted and we endorse the following: Article 1. This Act regulates a matter referred to in article 78 of the Constitution.
S. 2. in article 47 of the Act of 21 March 1991 on the reform of some economic public companies, paragraph 4, inserted by the law of December 30, 2009, is repealed.
S. 3. in the same Act, as last amended by the Act of 29 January 2013, it is inserted an article 47/1 as follows: "article 47/1. § 1.
It is established an Advisory Committee for rail passengers, hereinafter referred to as 'the Committee', with the Federal mobility and transport public Service. This Committee is responsible for rail passenger transport services which are the subject of public service missions. The King regulates the composition and functioning of the Advisory Committee for rail passengers.
§ 2. The Committee shall deliver opinions at the request of public undertakings providing railway transport services of passengers subject to public service missions, at the request of the Minister responsible for these public enterprises, at the request of the Minister that the regulation of rail in charge or the own initiative of the Committee.
The Committee can issue own-initiative opinions on any question relating to rail transport services of passengers subject to public service rendered by a public railway undertaking missions. These opinions reflect the diversity of the positions of its members.
It is consulted on the draft multi-annual investment plans and transport plans concerning travellers. These documents are communicated to the Committee by the Manager of the rail infrastructure and public undertakings providing railway transport services of passengers subject to public service missions.
No later than six months before the expiry of the management contracts, the Committee shall transmit to the legislative chambers its recommendations on management contracts.
The Committee may organise consultations involving public companies providing rail transport services of passengers making the object of public service missions and Governments.
§ 3. Annually, the Committee shall report its activities public railway undertakings providing services of passenger transport covered by public service missions, the Minister responsible for public enterprises, the Minister who has the regulation of rail in charge, to the federal legislative chambers and the regional executives.
§ 4. The King may grant compensation to cover the costs incurred by the members of the executive bureau of the Committee and related to the exercise of their mandate since the year 2009. The maximum overall amount of this compensation is twelve thousand five hundred euros per year.
§ 5. The railway public enterprise provides on request of the president or vice-president information useful for the proper functioning of the mission of the Committee.
S. 4. the King sets the date of entry into force of this Act.
Promulgate this Act, order that it be under the seal of the State and published by le Moniteur.
