The House of representatives has adopted and we sanction the following: Chapter 1. -Available preliminary Article 1.
This Act regulates a matter referred to in article 74 of the Constitution.
CHAPTER 2. -Changes of Code consular art. 2. article 64 of the consular Code is repealed.
S. 3. in article 65 of the Code, paragraph 3 is replaced by the following: "the Minister may, prior to the issuance of a passport or of a Belgian travel, ask at any time to the competent authority for this purpose to provide any complementary information that may inform the decision to issue or refusal to issue. Pending additional information, the issue of the passport or travel document is suspended. » Art. 4. in the same Code, it is inserted an article 65/1 as follows: «art.» 65/1. Passports and Belgian travel documents are removed and disabled the conditions referred to in article 62.
In addition, passports and Belgian travel documents can also be removed and invalidated following the reasoned opinion of a competent authority for this purpose if the applicant clearly presents a substantial risk for the maintenance of public order or the protection of national or public security.
The Minister may, prior to the withdrawal or the invalidation of a passport or of a Belgian travel, ask at any time to the competent authority for this purpose to provide any complementary information that may inform the decision on withdrawal or invalidation. » Art. 5. in the same Code, it is inserted an article 65/2 as follows: «art.» 65/2. The initial decision of refusal to grant, withdrawal or invalidation of an identity card by the Minister who has the Interior in charge, under article 6, § 10, of the Act of 19 July 1991 on the registers of the population, identification cards, foreign cards and residence documents and amending the law of 8 August 1983 organising a national register of natural persons automatically leads to the decision of refusal to issue, withdrawal or invalidation of the passport or Belgian travel of the person concerned by the Minister that the Foreign Affairs.
The decision of refusal to issue passport or Belgian travel is thrown when is thrown the initial decision of refusal to grant, withdrawal or invalidation of the identification referred to in paragraph 1.
"CHAPTER 3. -Entry into force art. 6. this Act comes into force the day of its publication in the Moniteur belge, with the exception of article 5, which shall enter into force on the date fixed by royal decree deliberated in the Council of Ministers.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
