The House of representatives has adopted and we sanction the following: Article 1. This Act regulates a matter referred to in article 74 of the Constitution.
S. 2 article 1 of Act of 4 July 1962 on official statistics, inserted by the law of 22 March 2006, is completed by 17 ° and 18 °, worded as follows: "17 ° statistical authority: the national Institute of statistics, in short the INS, and other statistical authorities by a law, a decree or an order, the collection and the processing of data for the purpose of achieving public statistics." The conditions under which must answer the statistical authorities are mentioned in chapter V of the agreement of cooperation between the federal State, the Flemish Region, the Walloon Region, the Brussels-Capital Region, the Flemish community, the French community, the German-speaking community, the Brussels joint Community Commission and the French Community Commission concerning the methods of operation of the Institute interfederal statistics, the Board of Directors and the Scientific Institute of national accounts committees dated July 15, 2014 and published in the Moniteur belge on October 20, 2014;
"18 ° public statistics: statistics produced and disseminated by the statistical authorities or other public bodies which are accessible to the public and which are used to ensure the development, execution, follow-up and evaluation of public policies."
S. 3. Chapter V of the Act, and including articles 14 and 14A, is replaced by a chapter includes a section 14 as follows: "chapter V. - provisions relating to the Belgian statistical system s. 4 § 1. It is created a public establishment with legal personality, called 'Inter-Federal Institute of statistics', hereinafter referred to as 'IIS'.
The headquarters of ISI is established in the administrative arrondissement of Brussels-capital.
Composition, missions and the operation of the IIS, on the one hand, and the responsibilities and obligations of the parties, on the other hand, are defined in the cooperation agreement referred to in article 1, 17 °.
2. The IIS is managed by a Board of Directors whose composition and mode of operation are set out in the cooperation agreement referred to in article 1, 17 °.
§ 3. Are members of the Board of Directors of the IIS 1 ° the president of the federal public Service economy, SMEs, Middle Classes and energy;
2 ° the official leader of the national Institute of statistics;
3 ° a member of the Board of Directors of the National Bank of Belgium.
The Planning Bureau may designate a representative who will attend the Board of Directors of the IIS, as an observer.
§ 4. The secretariat of the IIS has its seat to the INS. The mode of operation and financing of the secretariat are set out in the cooperation agreement referred to in article 1, 17 °. "Art. 5. in chapter VI of the Act, it is inserted an article 15b, as follows: "article 15B. the transmission of confidential data may take place between statistical authorities, provided that it is necessary for the effectiveness of the development, production and dissemination of public statistics, or to improve the quality of these, and as laid down in chapter V of the agreement of cooperation referred to in article 1, 17 °. 6 this Act comes into force on January 1, 2016.
