515. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, amending the Regulation on the Implementation of Quality Control

On the basis of § § 2 (1), 11 (5), 20 (2) and 25a (4) of the Quality Class Act, BGBl. No. 161/1967, as last amended by the Federal Law BGBl. I n ° 78/2003, is in agreement with the Federal Minister for Finance, the Federal Minister for Health and Women, and the Federal Minister for Economic Affairs and Labour:

The regulation of the Federal Minister of Agriculture and Forestry on the implementation of quality control, BGBl. No 576/1995, as last amended by the BGBl Regulation. II No 440/2002, shall be amended as follows:

1. According to § 6, the following § 6a is inserted:

" § 6a. (1) In the implementation of the control of imports and exports of fresh fruit and vegetables, the control body shall ensure that the marketing standards are complied with (conformity control).

(2) Where certain consignments are imported under the conditions laid down in Article 6 (4) of Regulation (EC) No 1148/2001 on checks for compliance with the marketing standards for fresh fruit and vegetables, OJ L 327, 30.12.2001, p. No. 9., the Federal Office for Food Security (Bundesamt für nutritional security) has to issue a declaration (waived declaration). The declaration of renunciation shall contain the following information:

the importer/contractor,

2.

the country of destination,

3.

the country of origin,

4.

the country of consignment,

5.

the means of transport (type and number),

6.

the consignor/seller,

7.

the trade name of the goods;

8.

the number of packages, the weight of the lot, the type of packaging and its class,

9.

the KN code.

(3) The period of validity of the declaration shall be at least three days from the date of the exhibition. It shall also be valid only if it is the import body referred to in Article 3 (2).

in the original and with seal of service,

2.

fax, which clearly shows the sender's identification of the Federal Office for Food Security, or

3.

in another technically possible form, where the issuing authority is clearly identified

is presented.

(4) The declaration of renunciation is a document required for the customs clearance requested in accordance with Article 62 (2) of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code, OJ L 327, 31.12.1992, p. No. OJ L 302, 19.10.1992 p. 1.

(5) The minimum shares of the consignments to be checked by the competent inspection body for the type of import to be determined by the Federal Office for Food Security in accordance with the second subparagraph of Article 6 (4) of Regulation (EC) No 1148/2001 for the type of import concerned and quantities must not be less than 20%.

(6) The Federal Office for Food Security may, under the conditions laid down in Article 5 (1a) of Regulation (EC) No 1148/2001, authorise certain operators in the framework of export control for autonomous control (self-control).

(7) In accordance with the second subparagraph of Article 5 (2) of Regulation (EC) No 1148/2001, a control independently carried out by entrepreneurs is in box 13 (remarks) with the words "own control" of the Annex I to Regulation (EC) No 1148/2001 (a certificate of compliance with the marketing standards for fresh fruit and vegetables).

(8) The minimum share of the consignments and quantities to be determined by the Federal Office for Food Security in accordance with the second subparagraph of Article 5 (1a) of Regulation (EC) No 1148/2001 as regards the operators entitled to own control, and the quantities of Control by the inspection body shall not be less than 20%. "
