Section 1

Establishment and duties of election commissions

Election Commissions

§ 1. (1) Permanent election commissions are set up at the Austrian High School and the University of the University of Austria and the university students ' high school and university students.

(2) The Electoral Commission of the Austrian High School of Student Affairs, with the participation of the electoral commissions in the high school and high school students at the universities, is responsible for the conduct of the elections in the Federal representation of the students.

Federal Representation

§ 4. (1) The Federal Representation shall belong to the elected representatives elected by the university representatives, the academy representatives, the electoral community and the list associations.

(2) The newly elected university representatives have to elect student representatives in accordance with the principle of proportional representation in the federal representation of the students. Convening of election commissions

§ 11. (1) The Chairperson shall, after knowledge of any facts which require a decision of the Electoral Commission, convene the Electoral Commission without delay, but at the latest within one week of being informed of a meeting. Such meetings shall be invited immediately, but at the latest within three working days of the request. Subcommissions

§ 13. (1) The electoral commissions of the high school and high school students at the universities may appoint sub-commissions if it is more appropriate to organise the conduct of the elections. Each sub-commission shall be allocated an exactly circumscribed circle of persons entitled to vote.

(2) Decision-making on the establishment of sub-commissions and their areas of action shall be taken at the latest three weeks before the last election day. The sub-commissions shall be constituted before the start of the election of the first election day.

(3) Each sub-commission of the Electoral Commission of the University of Bremen has at least three representatives of the elective groups represented in the university representation of the students. shall be included. § 14. (1) The election commissions shall, in particular, be:

13.

the modest determination of the erasure of mandates pursuant to § 43 HSG 1998 and the subsequent assignment of mandates to persons (§ 57 (3) to (6)),

14.

the implementation of the provisions of § 50 of the HSG in 1998, if they take place jointly with high-school and high-school elections,

15.

the holding of the constituent meeting of the university representation with the election of the chairman and of his/her deputiors or alternates,

16.

Establishment of an appointment, up to which the university representation is to be announced, which are to be selected in the form of summarized study representatives.

(2) At the latest on the eighth day before the first election day, the election commissions shall have the admissible valid nominations in the order in accordance with section 43 (2). (3) The election results shall be available within one week from the last election day. § 15. The Electoral Commission shall in particular:

Election days

§ 16. (1) Within two weeks after the entry into force of the regulation, the Electoral Commission of the Austrian High School of Student Affairs has the Federal Minister or the Federal Minister for the purpose of determining the voting days and the resulting the dates and time limits for the electoral procedure.

(2) These directories shall contain the persons entitled to vote separately for the university representation and for each student representation in order of their matriculation number or in alphabetical order. The election commissions may also decide that, instead of a separate directory for the university representation and each student body, an overall list of those entitled to vote in the field of action of the relevant electoral commission shall be held by the name of the institutions for which each or every person entitled to vote is actively entitled to vote. § 20. § 21. Denomination of the elective groups

§ 22. (1) where several nominations for an institution have the same or difficult names, the competent electoral commission shall have the appointing representatives and representatives of the eligible groups concerned to request, within three days, but at the latest two weeks before the last election day, the agreement on the distinguishing names. If an agreement is not reached, the relevant electoral commission shall establish different denominations of the nominations.

(2) In any case, electoral groups which have been represented in the institution concerned shall be entitled to maintain their previous name.

(3) The use of names of organs after the HSG 1973 and after the HSG in 1998 as the designation of an elective group is not permitted.

Candidate and Candidate List

§ 23. (1) The list of candidates shall not exceed twice as many people as those for which the institution concerned is to be given the mandate.

(2) For each nominee and candidate, please state:

(5) If a candidate list contains more candidates than is allowed, the outnumbered candidates shall be deleted.

Declarations of consent

§ 24. (1) A person may be included in the election proposal only if he or she has declared his or her consent in writing. The declaration shall be attached to the nomination.

(2) Candidates and candidates who have not issued a declaration of consent shall be deleted.

Delegation Plenipotentiary Representatives

§ 25. (1) Each election proposal and each list association in accordance with § 51 shall contain the first and first names and the address of a representative representative or representative of the appointing representative.

(2) If an election proposal does not give a representative representative or a representative representative, the person referred to in the first place of the nomination shall be deemed to be a representative representative of the election or as a representative of the person responsible for the election, or Representatives of the elective group shall be the representative of the appointing authority.

(3) The elective group or the list association may at any time replace the appointing representative or the appointing representative with another representative or another representative. (2) In the case of any supporting declaration attached to the nomination, the name, the matriculation number, the address and the degree of study of the supporting person shall be given. (3) The report of the continuation of the study is to be confirmed by the Rector or the Rector.

(4) Electoral persons may not make a declaration of support for an institution unless they or he are entitled to vote in respect of the institution concerned.

(5) (4) Contradicting statements of support shall be deleted by the Electoral Commission as invalid if:

the person is not actively entitled to vote in respect of the institution to which the nomination relates; the validity of the declaration of support of the same person to nomination proposals for institutions for which it is entitled to vote shall not be affected by this.

(6) Any withdrawal of individual statements of support after the election proposal has been received shall not be taken into account by the Electoral Commission, unless the supporter or the supporter of the Electoral Commission makes it credible that she or has been determined by a material error or by fraudulent deception or threat to support the election proposal and the withdrawal of the support declaration has been made no later than two weeks before the last election day.

§ 27. § 48. (1) In the event of circumstances preventing the vote, any electoral commission (Subcommission) may interrupt the ballot or postpone it beyond the specified voting time within the given voting days.

§ 54. § 55. (1) The assignment of the mandates for the university representatives and the student representatives shall be made immediately after the determination of the results of the election. In this case, the provisions of § § 40 to 42 of the HSG shall be used in 1998.

Election of the election result

§ 56. (1) The chairpersons of the election commissions of the university and university students at the university have the results of the election for the university representatives and the student representatives without delay, but at the latest one week after the last Election day in the form prescribed in section 31 (3).

§ 57. (1) The elected representatives of the Federal Representation shall be certified by the President of the Electoral Commission of their choice within one day after the end of the election of the election result with a letter of resignation. § 58. (1) The Federal Minister or the Federal Minister has to decide on objections concerning the violation of the provisions relating to the electoral procedure for the election of the federal representation of the students.

(2) Each elective group for a university representation as well as the academy representatives are entitled to claim objections within two weeks from the date of the election of the election results to the President of the Electoral Commission at the Austrian Federal Republic of Germany. § 60. (1) If, on the basis of an objection due to infringement of the provisions relating to the electoral procedure, the repetition of an election is necessary, this election shall be carried out within 60 days from the legal force of the decision. (2) Electoral repetition for elections of university representatives and student representatives shall be carried out in one week from Tuesday to Thursday. The holding of the re-election during the course free time and within the authorisation periods is inadmissible. (3) The re-election shall be based on the nominations for election approved for the annulled election, unless they are withdrawn at the latest on the eighth day before the election. The introduction and approval of new election proposals as well as new electoral groups shall be permitted. The election proposal submitted by the relevant electoral group in the annulled elections shall be deemed to be withdrawn if the new election proposal is approved by the electoral commission.

(4) If the decision on the annulment of the election becomes final in the last quarter of the operating period, the reelection period and the institutions shall continue to function until the end of the period of operation.

(5) These provisions shall apply also to the nominations for election of the student representatives.

(6) If the election to the federal representation at a university is declared invalid, this election shall be repeated immediately.

Transitional provision

§ 63. (1) Up to the constitution of the Electoral Commission of the Austrian High School of Student Affairs on the basis of Section 38 (2) of the HSG in 1998, as amended by the Federal Law BGBl.
