Regulation of the Federal Minister for Economic Affairs and Labour amending the Electrotechnical Ordinance 2002 (Electrotechnical Ordinance 2002/A1-ETV 2002/A1)

Pursuant to § § 2, 3 (3), 4 (2), 5 (2) and 7 (2) and 7 (2), (5) and (6) of the Electrical Engineering Act 1992-ETG 1992, BGBl. No. 106/1993, in the version of the Federal Law BGBl. I n ° 136/2001, as well as Section 181 (2) of the MinroG MinroG Act, BGBl. I n ° 38/1999, as last amended by the Federal Law BGBl. I No 85/2005, shall be ordered:

The regulation of the Federal Minister for Economic Affairs and Labour on the safety, normalization and typing of electrical equipment and equipment as well as other installations in the hazard and disturbance range of electrical installations (electrical engineering regulation) 2002-ETV 2002), BGBl. II No 222/2002, shall be amended as follows:

1. § 2 para. 2 reads:

" (2) The BGBl 2002 Annex I of the ETV. II No 222/2002, binding and in the annexes to ETV 1993, BGBl. No 47/1994, on ETV 1996, BGBl. No 105/1996, as amended by BGBl. No 575/1996, and ETV 2002, BGBl. II No 222/2002, printed SNT rules remain binding, except in the case of the Annex II , the liability of which shall be repealed. "

2. § 9 reads:

" § 9. (1) The SNT regulation ÖVE-EN 1, Part 3 (§ 41): 1995-03 is to be applied with the following amendment:

Section 41.8.4.3 (1) of the ÖVE-EN 1, part 3 (§ 41): 1995-03, as amended:

" (1) for connecting cables or cables which connect generators, transformers, rectifiers or accumulators to their switchgear. The termination of the short-circuit protection must be taken into account only if the connecting line does not leave the range of use of the respective "closed electrical operating rooms". However, a short-circuit protection shall always be provided when leaving the area. "

(2) Equipment within the scope of the SNT regulation ÖVE/ÖNORM EN 60335-2-76:2000-12-01 may continue until 31 July 2006 in accordance with the previously valid SNT regulations ÖVE-G/EN 61011/1992, ÖVE EN 61011/A1 + A2:1994-06, ÖVE-G/EN 61011-1/1992, ÖVE EN 61011-1/A2:1994-06, ÖVE-G/EN 61011-2/1992 and ÖVE EN 61011-2/A2:1994-06 including the supplement ÖVE EN 61011/A11:1996-11 produced and placed on the market.

(3) The SNT regulations ÖVE EN 60335-1 and their amendments (Z 67 of Annex I) are binding only in the case of joint application with the SNT regulation ÖVE/ÖNORM EN 60335-2-76.

(4) In the establishment of lightning protection systems according to the SNT regulation ÖVE/ÖNORM E 8049-1:2001-07-01, these are to be carried out at least in accordance with protection class III.

(5) Electrical installations within the scope of the Annex III Z 2 up to and including Z 18, the SNT rules are to be planned from the entry into force of this Regulation in accordance with these SNT rules and at the latest from 1. Jänner 2007 under these SNT rules. "

§ 10 reads:

" § 10. (1) Insofar as § 9 is not determined otherwise,

1.

the application of the provisions of Annex II of this Regulation, with the exception of those listed in Z 23, 27, 28, 39, 40 and 41, and five years from the date of entry into force of this Regulation; and

2.

the application of the Annex II of the SNT provisions listed in this Regulation: Z 23, 27, 28, 39, 40 and 41, until 31 December 2006; and

3.

the application of the provisions of Annex II of the ETV 2002, BGBl. II No 222/2002, listed SNT rules, with the exception of Z 12, 13 and 14 specified therein, and until 13 June 2007

allowed.

(2) The application of the provisions of Annex II of the ETV 2002, BGBl. II No 222/2002, listed SNT provisions Z 12, 13 and 14 are not permitted. '

4. § 12 reads:

" § 12. (1) The BGBl Regulation. II No 222/2002, in compliance with the provisions of Directive 98 /34/EC, OJ L 327, 31.12.1998, p. No. OJ L 204, 21.07.1998 p. 37, as amended by Directive 98 /48/EC, OJ L 201, 31.7.1998, p. No. OJ L 217, 05.08.1998, p. 18, notifiable (notifying number 2000 /299/A).

(2) The BGBl Regulation. II No 33/2006 has been adopted in compliance with the provisions of Directive 98 /34/EC, OJ L 327, 30.12.1998 No. OJ L 204, 21.07.1998 p. 37, as amended by Directive 98 /48/EC, OJ L 201, 31.7.1998, p. No. OJ L 217, 05.08.1998 p. 18, notified (notifying number 2004 /0557/A). "
