171. Regulation of the Federal Minister for Health and Women on the fixing of the minimum retail selling price for tobacco products to ensure a minimum price level (minimum price regulation)

Due to § 2 para. 4 of the Tobacco Act, BGBl. No 431/1995, as last amended by the Federal Law BGBl. I N ° 47/2006, is being prescribed in agreement with the Federal Minister for Finance:

Definitions

§ 1. For the purposes of this Regulation, the minimum retail selling price shall be that price under which tobacco products may not be delivered to consumers.

Minimum retail price

§ 2. (1) The minimum retail selling price for cigarettes per unit shall be at least 92.75% of the weighted average price of all cigarettes sold during the previous calendar year.

(2) The minimum retail selling price shall be equal to or greater than 90% of the weighted average price of all fine-cut tobacco sold for self-turned cigarettes of the previous calendar year for fine-cut cigarettes per gram.

Calculation and Customer

§ 3. (1) The Federal Ministry of Finance shall send the Federal Ministry of Health and Women annually until the end of February for the previous calendar year a compilation of the compilation of the Sales of tobacco products and their retail selling prices. Each year, the Federal Minister for Health and Women has the weighted average prices of the past calendar year on the basis of this compilation-in the case of cigarettes from the total number of cigarettes sold and the number of cigarettes sold. -to calculate the minimum retail prices for the current year, in the case of fine-cut cigarettes from the total sales volume in grams and the current retail selling prices per gram- and these, rounded up to four decimal places, in the official journal of the Wiener Zeitung to make known. The new minimum retail prices shall apply as from the month of the year following the customer's purchase.

(2) Cigarettes and fine-cut for self-made cigarettes, whose retail selling prices last made known in accordance with Article 9 of the Tobacco Monopoly Act 1996 are lower than the minimum retail selling prices, are from the wholesalers in compliance with § 1 of these Regulation and Section 9 of the Tobacco monopoly Act 1996.

Final destination

§ 4. By way of derogation from § 3 (1), the minimum retail selling prices shall apply for the first time with effect from 15 May 2006.
