348. Ordinance of the Federal Minister for Health and Women, with which the occupational health insurance fund Semperit is dissolved

Pursuant to Section 23 (3) of the General Social Insurance Act, BGBl. No. 189/1955, as last amended by the Federal Law BGBl. I No 131/2006, shall be ordered:

§ 1. Due to the entry of significant changes in the insurance structure, the operating sickness insurance fund Semperit shall be deemed to have been dissolved by the end of September 30, 2006.

§ 2. (1) All rights and liabilities existing at the closing date of September 30, 2006 for the operating-health insurance fund Semperit shall be 1. October 2006, on the Lower Austrian Regional Health Insurance Fund.

(2) The assets and circulatory assets of the occupational health insurance fund Semperit, minus the amount referred to in paragraph 3, available at the closing date of 30 September 2006, shall be 1. October 2006 into the property of the Lower Austrian District Health Insurance Fund.

(3) Ten million euros from the general reserve of the occupational health insurance fund Semperit shall be 1. The "Private Foundation for the Promotion of the Health of Employees of Semperit AG Holding", which is to be founded by Semperit AG Holding, is to be introduced in October 2006. In the event of the dissolution of this foundation, the Lower Austrian District Health Insurance Fund shall receive the remaining assets after settlement.

§ 3. With regard to the transfer of rights and assets to the Lower Austrian Regional Sickness Fund in accordance with § 2 (1) and 2 (2), this insurance policy has

for the transfer of the assets of the occupational health insurance fund Semperit this (assets/liabilities) to be recorded separately in appropriate records and to be kept in evidence; deviating allocations of assets and liabilities in the financial statement are in more detail;

2.

The annual report (§ 1 of the instructions for the accounting and accounting of the social insurance institutions and the main association (accounting regulations-RV)) for the operating-health insurance fund Semperit for the first three quarters of 2006 (Success calculation for the period 1. January 2006 to September 30, 2006, final balance sheet as of September 30, 2006, Annual Report, statistical remittantions), in compliance with the accounting rules, and the Federal Ministry of Health and Women, as well as the other The accounting rules referred to above shall be submitted by 31 December 2006;

permanent underage remittantions as well as monthly accounts of contributions to social security contributions and other contributions (§ 29 RV) of the occupational health insurance fund Semperit to be drawn up and submitted on time;

4.

to calculate the partial rates of expenses incurred during the first three quarters of 2006, such as for the weekly allowance and for the examination of young persons, and the supervisory fee for the operating-health insurance fund Semperit;

5.

in its final balance sheet as at 31 December 2006, in the individual reference to the items general reserve, reserve and support fund, to indicate separately the assets acquired as a "transfer of assets";

6.

in their annual report for the year 2006, in any case, on the assets acquired (assets/liabilities) and on the assets to be transferred to the 1. Report of the European Parliament and of the Council of 27 October 2006 on the insurance sector

7.

keep in mind the retention periods in accordance with § 58 RV with regard to all acquired books, records and other documents.

§ 4. The insurance membership and competence as well as the service and the service
-jurisdiction with regard to persons insured with the occupational health insurance fund Semperit at the closing date of 30 September 2006 and of the persons entitled to the benefits of the occupational health insurance fund shall go to 1. October 2006, on the locally competent territorial health insurance fund. For the insured persons and their dependants, the following shall apply from 1. October 2006 the regulations (statutes, medical regulations, etc.) of the respective area health insurance fund.
