Regulation of the Federal Minister for Health, Family and Youth, amending the Animal Transport Training Regulation

Due to § § 7 (3) and 15 (1) of the Animal Transport Law Road, BGBl. No 411/1994, as last amended by the Federal Law BGBl. I n ° 32/2002 and the Federal Law BGBl. I n ° 6/2007, and Article 17 (2) of Regulation (EC) No 1/2005 on the protection of animals during transport and related operations, as well as amending Directives 64 /432/EEC and 93 /119/EC and Regulation (EC) No 1255/97, 1. OJ L 3, 5.1.2005 p. 1, shall be arranged:

The Animal Transport Training Regulation, BGBl. No 427/1995, shall be amended as follows:

1. § 4 (1) reads:

The Authority shall, on the basis of the knowledge required in accordance with Article 1, issue, on request, an acknowledgement in accordance with Chapter III of Annex III to Regulation (EC) No 1/2005 on the existence of professional competence, unless the applicant is entitled to: is subject to a reservation of animal cruelty and the authority is not aware of any repeated serious infringements of the animal transport legislation, the animal welfare laws of the Länder or the Federal Law on the Protection of Animals. The confirmation shall be marked by the following number:

1.		"AT" for Austria,
2.		the identification number of the political district in accordance with the Annex,
3.		serial number starting with 0001 and
4.		the addition "BN". "

2. § 5 (1) Z 2 reads:

" 2.		is not subject to animal cruelty or infringements of the animal transport laws, the animal welfare laws of the Länder or the Federal Law on the Protection of Animals. "

3. § 8 reads:

" § 8. (1) Persons in accordance with Section 7 (5) of the Animal Transport Law, which have already carried out at least half a year at the time of entry into force of Regulation (EC) No 1/2005, are considered to be technically competent. At the request of the Authority, they shall be required to certify the professional competence referred to in § 4 from the Authority until 31 December 2007, unless the applicant is subject to a pre-strait of animal cruelty and the Authority shall not be subject to repeated and serious infringements of the Animal transport law road, the animal welfare laws of the countries, or the federal law on the protection of animals are known.

(2) Existing qualifications as a result of the Animal Transport Training Regulation in the version of BGBl. No 427/1995, are to be rewritten by the Authority until 31 December 2007 on the basis of the qualifications referred to in Annex III, Chapter III, of Regulation (EC) No 1/2005.

4. The previous installation shall be repealed and replaced by the following Appendix:
