75th meeting of the Federal Minister of Arts and Culture, Constitution and the Media concerning amendments to Annexes 1, 6 and 9 to the Customs Convention on International Transport of Goods by TIR Carnets (TIR Agreement)

On the basis of § 5 paragraph 1 Z 6 of the Federal Law on the Federal Law Gazette 2004 (BGBlG), BGBl. I n ° 100/2003 idgF, shall be made known:

According to Annex 8 of the TIR Agreement (BGBl. No 112/1978, as last amended by BGBl. III No. 192/2014) on 6 February 2014 and on 12 June 2014, the Management Committee adopted the following amendments to Annexes 1, 6 and 9 to the TIR Agreement:

Annex 6, New Explanatory Note 0.38.2

Add a new Explanatory Note to Article 38, paragraph 2 to read

Explanatory note to paragraph 2

0.38.2 The legal requirement to notify the TIR Executive Board that a person has been temporarily or permanently excluded from the operation of the Convention is deemed to be fulfilled by means of the proper use of electronic applications developed to this end by the TIR secretariat under the supervision of the TIR Executive Board.

Annex 6, New Explanatory Notes 8.9.1

Add new Explanatory Note to Annex 8, Article 9, paragraph 1 to read

8.9.1 The members of the TIR Executive Board shall be competent and experienced in the application of Customs procedures, particularly the TIR transit procedure, both at national and international levels. Board members shall be nominated by their respective Governments or organizations being Contracting Parties to the Convention. They shall represent the interests of the Contracting Parties to the Convention and not the specific interests of any one individual Government or organization.

Annex 6, New Explanatory Note 8.9.2

Add new Explanatory Note to Annex 8, Article 9, paragraph 2 to read

8.9.2 In case a member of the TIR Executive Board resigns before the completion of his/her mandated term of office, the TIR Administrative Committee may elect a replacement member. In that case the elected member shall only hold office for the unexpired portion of the term of office of his/her predecessor. In the event that a member of the TIR Executive Board is unable, for reasons other than resignation, to complete his or her term of office, this information should be transmitted in writing to the TIR Executive Board and the TIR secretariat by the national administration of the member concerned. In this case, the Administrative Committee may elect a replacement member for the unexpired portion of the term of office.

Annex 6, New Explanatory Note 9.II.4

Annexe 6, nouvelle note explicative 8.9.1

8.9.1 Les membres de la Commission de contrôle TIR sont compétents et expérimentés en matière d' application des procédures douanières, en particulier de la procédure de transit TIR, tant au niveau national qu' international. Les membres de la Commission sont proposés par leurs gouvernements respectifs ou par des organisations, Parties contractantes à la Convention. Il représentent les intérêts des Parties contractantes à la Convention et non les intérêts particuliers d' un gouvernement ou d' une organisation.

Annexe 6, nouvelle note explicative 8.9.2

Ajouter une nouvelle note explicative au paragraphe 2 de l' article 9 de l' annexe 8, comme suit:

8.9.2 Au cas où l' un des membres de la Commission de contrôle TIR démissionnerait avant le terme de son mandat, le Comité de gestion de la Convention TIR peut élire un membre de remplacement. Dans ce cas, le membre qui sera élu ne restera en fonctions que pour la période de temps restante du mandat de son prédécesseur. Lorsqu' un membre de la Commission de contrôle TIR n' est pas en mesure, pour des raisons autres qu' une démission, d' honorer son mandat jusqu' à son terme, l' administration nationale du membre concerné devrait en aviser, par écrit, la Commission de contrôle TIR et le secrétariat TIR. Dans ce cas, le Comité de gestion peut élire un remplaçant pour la période de temps restante du mandat.

Annexe 6, nouvelle note explicative 9.II.4

0.38.2 The legal obligation to inform the TIR control commission that a person has been temporarily or permanently excluded from the facilitation of the Convention shall be deemed to be fulfilled if the TIR Secretariat is under the supervision of the TIR Secretariat. TIR Control Commission has been properly used for this purpose.

Annex 6, New explanation 8.9.1

The following new explanation of Annex 8 Article 9 (1) will be added: inserted:

8.9.1 The members of the TIR Control Commission have competence and experience in the application of customs procedures, in particular the TIR transit procedure, both at national and international level. The members of the TIR control mission shall be designated by their respective governments or organizations which are parties to the Convention. They represent the interests of the parties to the Convention and do not represent the special interests of a single government or organization.

Annex 6, New explanation 8.9.2

The following new explanation of Annex 8 Article 9 (2) will be added: inserted:

8.9.2 If a member of the TIR Control Commission withers before the expiry of his term of office, the TIR Management Committee may elect a substitute member. In such a case, the elected member shall remain in office only for the remainder of his or her predecessor's term of office. If a member of the TIR Control Commission is not able to terminate his term of office on the basis of other reasons independent of a resignation, the national administration of the Member concerned should do so by the TIR Control Commission and by the TIR Secretariat in writing. In such a case, the Management Committee may elect a substitute member for the remainder of the term of office.

Annex 6, New Explanatory Note 9.II.4

The following new explanation shall be given on Annex 9, Part II, paragraph 4 inserted:

The amendments are to be amended in accordance with Article 59 (3) of the Agreement. Jänner entered into force in 2015.
