246. Ordinance of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the statistics on horticulture and field vegetable cultivation (Horticultural and Field Vegetable Vegetable Collection Ordinance 2015)

Pursuant to § § 4 (3), 5, 6 (1), 2 and 3, 8 (1), 9 and 32 (4) (4) (1) of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. Arrangement for the compilation of statistics

§ 1. In accordance with this Regulation, the Federal Statistical Office of Austria (Bundesanstalt) shall carry out surveys and, on the basis of the data collected until 30 September 2016, compile statistics on horticulture and field vegetable cultivation in each case. create.

Statistical units

§ 2. (1) Statistical units are natural and legal persons as well as registered partnerships, which

Horticulture and nursery farms with at least 10 artisanally farmed open-land areas or a growing or growing of a plant or garden. Greenhouse (high glass or plastic or foil) or

2.

agricultural holdings with at least 10 arable crops, including areas in two-tangled crops by agricultural crops or a predominantly commercial-sector-managed plant or plant, Greenhouse (high glass or plastic or foil)

farming.

(2) The survey excludes holdings with exclusive forest seed production or forest seed production and holdings which produce exclusively for their own use.

Reference period, reference period

§ 3. (1) Date of survey of the characteristics referred to in Annex I Section A, Z 1, 2, 6, 8 and 9, and in accordance with Annex II Section A Z 1 and 2 is 1 July 2015.

(2) The characteristics referred to in Annex I Section B shall be collected over the calendar year 2014 (reference period).

(3) The characteristics referred to in Annex I Section A, Z 3 to 5 and 7, and section C Z 1 to 4, and Annex II Section A, Z 3 to 5 and Section B shall be collected over the calendar year 2015.

Survey characteristics

§ 4. The following survey characteristics shall be collected:

1.

in the case of statistical units in accordance with Article 2 (1) (1), the Annex I and

2.

in the case of statistical units in accordance with Article 2 (1) (2), the Annex II

features listed below.

Survey Type

§ 5. The survey characteristics are to be collected in the form of a full survey by survey of the statistical units.

Implementation of the survey

§ 6. (1) The survey pursuant to § 5 shall be carried out by the Federal Institute.

(2) For the survey, the Bundesanstalt has to compile uniform survey documents (electronic questionnaires and explanations) and make these available to the parties responsible for providing information.

Obligation to provide information

§ 7. (1) According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information in the surveys.

(2) For the purpose of providing information, those natural and legal persons as well as registered partnerships are obliged to operate a statistical unit in its own name.

(3) In order to provide information in the form of a reasoned empty message, those natural and legal persons as well as registered partnerships are also required to operate either an establishment on which the conditions laid down in accordance with § 2 shall not apply or which have left the selected establishment.

Obligation to provide information to the parties responsible for providing information

§ 8. (1) The parties responsible for providing information pursuant to § 7 shall be obliged to complete the electronic questionnaire of the Federal Institute in full and to the best of its knowledge within four weeks after receipt of the access authorization for the electronic questionnaire and to be returned to the Federal Institute within this period.

(2) If the technical possibilities for an electronic message do not exist in the case of the party responsible for the information, the party responsible for providing information shall have this within two weeks after receipt of the access authorization for the electronic questionnaire of the to inform the Federal Institute in writing. In this case, the party responsible for providing information has to comply with his obligation to provide information within eight weeks after the written announcement (postmark of the communication) by telephone interview.

(3) In so far as the data of the characteristics in accordance with § 3 (3) of the year 2015 are not yet available to the respondent at the time of the survey, he has to make an estimation to the best of his knowledge.

Other co-action obligations

§ 9. Former managers (farmers) of statistical units in accordance with § 2 are obliged to participate in the determination of the new information subject pursuant to Section 7 (2) of the Federal Institute of the Federal Republic of Germany.

Information on disclosure requirements

§ 10. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Transmission of data to the LFBIS

§ 11. The Federal Institute has to send the collected individual data to the Federal Minister for Agriculture, Forestry, Environment and Water Management for inclusion in the agricultural and forestry operating information system (LFBIS).

Cost replacement

§ 12. (1) The Federal Minister for Agriculture, Forestry, Environment and Water Management provides the Federal Institute with a total cost of € 407 774.

(2) The payment of the cost replacement shall be made as a one-off payment by the end of 2015.

Override

§ 13. This Regulation shall expire on the expiry of 31 December 2016.
