276. Regulation of the Board of Management of E-Control, which changes the Gas Market Model Regulation 2012 (GMMO-VO Novelle 2015)

Due to § 41 Gaswirtschaftgesetz 2011-GWG 2011, BGBl. I n ° 107/2011 in the version of the Federal Law BGBl. I No 174/2013, iVm § 7 para. 1 Energy Control Act-E-ControlG, BGBl. I No 110/2010 in the version of the Federal Law BGBl. I No 174/2013, shall be arranged:

The regulation of the Board of Management of E-Control on gas-market model regulations (Gas-Market Model Regulation 2012), BGBl. II No. 171/2012 in the version of the GMMO-VO Novelle 2014, BGBl. II No 234/2014, shall be amended as follows:

1. In accordance with § 2 (1) Z 16a, the following Z 16b shall be inserted:

" 16b.		"Regulation (EU) No 984/2013", Regulation (EU) No 984/2013 of the Commission of 14 June 2013. October 2013 establishing a network code on mechanisms for capacity allocation in transmission networks and supplementing Regulation (EC) No 715/2009 of the European Parliament, OJ L 327, 22.12.2009, p. 2. § 4 reads:

" § 4. (1) Capacity products shall be bundled in accordance with the requirements of Regulation (EU) No 984/2013 at the boundary coupling points where transmission networks are connected to each other.

(2) Transmission system operators may also offer bundled or unbundled capacity with allocation requirements in order to maximise the supply of bundled capacity. "

3. In § 6 (1), after the word order "in a transparent and non-discriminatory procedure" replaced by the phrase "according to the requirements of Regulation (EU) No 984/2013" .

4. Section 6 (3) is deleted.

5. § 8 reads:

" § 8. At the limit coupling points, the shares of the annual technical capacity referred to in Article 8 (6) to (8) of Regulation (EU) No 984/2013 shall be withheld and shall not be available at the earliest in the annual auction for annual capacity and/or annual capacity, respectively. to offer quarterly capacity. Shares exceeding this minimum level may, in accordance with the results of a needs survey to be coordinated by the transmission system operators, and after consultation of adjacent transmission system operators, may be subject to a limit coupling point proposed. 7. § 9 (3) deleted.

9. § 10 (2) shall be deleted.

10. In Section 11 (3), the unit shall be "kWh" replaced by "kWh/h" and after the phrase "Day Ahead-" the phrase "and Within Day" inserted.

11. In Section 11 (5), the word "Exceeds" replaced by the phrase "Over-or Fallen Below" and the phrase "Part crossing the allowed area" replaced by the phrase "the permissible range above or below the threshold" .

12. § 11 (9) and (10) shall be the order of the word "pursuant to § 6 (3)" is deleted.

13. In § 13 (3), at the end of the sentence "Capacity extensions shall be dealt with in the order of their arrival in time." .

14. In § 14 (3), after the second sentence, the sentence shall be: "Network access contracts with operators of storage and production facilities shall be concluded in accordance with the requirements of the distribution area manager, in so far as these contracts have an impact on the management of the distribution system." inserted.

15. In § 15, the following paragraph 4 is inserted after paragraph 3:

"(4) The distribution area manager shall book the necessary capacity at the limit coupling points in the distribution network, through which parts of the market area are exclusively fed through an adjacent market area."

16. In § 16 (1), after the second sentence of the sentence " If storage undertakings do not comply with the request of the network operators to book capacity within the reasonable time limit set by the network operators, the last-booked capacity of the respective storage company for the following year shall be: on the basis of this. 23. In accordance with Section 47 (9), the following paragraph 10 is added:

" (10) § 2 para. 1 Z 16b, § 4, § 6, § 8, § 9 and § 26 paragraph 6 in the version of the GMMO-VO Novelle 2015, BGBl. II No. 276/2015, will enter into force on 1 November 2015, 6 a.m. All other provisions of this amendment will enter into force on 1 October 2015, 6 a.m. "

Annex 1, point III.1 (3) reads as follows:
