337. Regulation of the Financial Market Supervisory Authority (FMA) amending the Disclosure Regulation
On the basis of Section 26 (7) of the Banking Act-BWG, BGBl. No. 532/1993, as last amended by the Federal Law BGBl. I No 72/2010, shall be arranged:
The Disclosure Ordinance-OffV, BGBl. II No 375/2006, shall be amended as follows:
1. In § 4 Z 1, the line point shall be replaced by a point and the following sentence shall be added:
"In particular, instruments pursuant to Section 23 (1) (3) (3a) of the Federal Elections Act (BWG), instruments whose provisions contain a moderate repayment incentive for the credit institution, and instruments pursuant to Section 103n Z 3 of the Federal Elections Act (BWG) shall be used;"
2. In § 4 Z 2, the following phrase shall be inserted before the point of stroke:
" , as well as the total amount of instruments pursuant to Section 23 (1) (3a) of the BWG, the instruments whose provisions contain a moderate repayment incentive for the credit institution and the instruments according to § 103n Z 3 BWG "
3. § 9 together with headline reads:
"Special financing and equity positions"
" § 9. Credit institutions which calculate the weighted exposure amounts according to § 74 (3) SolvaV or § 77 SolvaV shall disclose the exposure values for each category of the table in accordance with Section 74 (3) SolvaV or for each weight pursuant to Section 77 (3) SolvaV. "
4. § 19 (1) and the sales designation "(2)" .
5. The previous text of § 20 receives the sales designation "(1)" . The following paragraph 2 is added:
" (2) § 4 (1) and (2) and (9) in the version of the BGBl Regulation. II No 337/2010 enter into force on 31 December 2010; section 19 (1) and the sales designation "(2)" shall expire on 30 December 2010. "
