460. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in agriculture and forestry

Due to § 5 (1) Z 1 of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I n ° 135/2009, shall be:

§ 1. For the agricultural and forestry sector, a quota of 7 260 for the fixed-term employment of foreign workers is established and is divided among the Länder as follows:

Burgenland: ........................................................ 500

Salzburg: .................................................... 90

Steiermark: .............................................................. 1 560

§ 2. (1) In the context of these quotas, the granting of employment permits for a period of up to six months may be granted throughout the period of validity of this Regulation. For foreigners who have already been employed under a quota in accordance with Article 5 (1) (1) (1) of the AuslBG in the Agriculture and Forestry industry during the previous three years and the transitional provisions on the free movement of workers (§ 32a AuslBG), employment permits may be granted with a period of validity of up to nine months. The period of validity of the employment permits shall not end after 31 December 2011.

(2) Foreigners who are subject to the transitional provisions on EU free movement of workers and asylum seekers are to be preferred in the granting of the employment permits.

§ 3. This Regulation shall enter into force with 4. Jänner 2011 in force and with 30 April 2011.
