1 section

General terms and conditions

Scope

§ 1. This regulation have bearings and explosives, insofar as it is not camp, under the mineral commodity law - MinroG, Federal Law Gazette I No 38/1999, the munitions Act 2003 - MunLG 2003, Federal Law Gazette I no. 9, or under section 2 para 16 of the Gewerbeordnung 1994 - GewO 1994, BGBl. No. 194, fall.

Definitions

§ 2. Within the meaning of this regulation means:



1. storage of shooting and explosives: the storage of shooting and explosives to their consumption, excluding the short-term availability prior to use; section 8 of the regulation of blasting - SprengV, Federal Law Gazette applies this provision II No. 358/2004;

2. underground storage: storage embedded in rock or soil formations or niche;

3. transportable storage: a camp that is not associated with the underground and is built with the intention to put it locally.

Basic protection measures

Shooting and explosives are § 3 (1) to store that they are sufficiently protected against



1. influences that can cause an unintended implementation, and 2. influences that can affect their usability.

(2) all external components of a warehouse, as well as the access door including the Castle have sufficient protection against unauthorized acquisition or unauthorized use to provide targeted access. Whether sufficient protection is guaranteed, is to assess in particular by the following criteria:



1. protection from unauthorized access through violence against property, in particular one of the quantities and corresponding to the warehouse a - and burst-resistant access doors including the Castle;

2. protection against random access of lawfully present persons.

(3) in and from camps, and in the fire protection zone is prohibited:



1 smoking as well as any dealing with burning or glowing objects with fire, with an open light or spark-pulling tools, using open flames of any kind, 2 which can cause portability and use of electrical power sources, an unintended ignition, 3. the storage of flammable oxidizing, pyrophoric, or explosive materials other than shooting and explosives and 4. access by unauthorized persons.

(4) in the storage, suitable fire fighting AIDS in sufficient quantities are ready to keep.

Operating rules

§ 4 (1) on the outside of the access to the warehouse is to indicate a prohibition for unauthorized persons. On the inside of the access to the warehouse is that in section 3 para 3 prohibitions referred to in no. 1 to 3 to indicate.

(2) on every access door to a storeroom or a storage chamber, following instructions to install are:



1 upper-surface level and 2. storage classes in accordance with Appendix 1.

(3) the Chambers of warehouse or storage rooms have to serve only the storage of shooting or explosives. In these areas, no other activities may be performed.

(4) a vestibule or a manipulation Chamber may only for the opening of packaging and fiddling with shooting and explosives, as well as for the storage of the used for the storage, handling and use of required tools and equipment to the necessary extent. The storage of other items is prohibited.

Separate storage

5. (1) explosives and igniters should not be stored together in a storage room, a storage chamber or a niche.

(2) Nitrocet may not be stored in a storage room, a storage chamber or a niche with explosives.

Electrical equipment and lightning protection

6. (1) electrical equipment and electrical installations have the State of the art meet and must be particularly protected from dust.

Interior

Section 7 (1) in each room and each storage chamber must be present for an orderly warehouse management:

Ventilation and heating

Covering layer

Access

Establishment of multiple stock

Eligibility exceptions

§ 12 (1) at the request can grant, if necessary, the authority exceptions to the provisions of this regulation, under the terms, limitations and conditions, if safe storage in accordance with the principles of this regulation is ensured by other, equivalent arrangements, such as structural measures.

Above-ground storage

Safety distances and fire protection zone

The safety distances indicated in Appendix 2 are section 13 (1) in above-ground warehouses to comply.

Large bearings

Standard bearings

Section 15 (1) in a standard warehouse up to 1000 kg of shooting and explosives may be stored.

(2) standard bearings have a vestibule or from the storage access an area protected from the weather (forecourt) and a ventilation system. The establishment of a ventilation system may be waived if an effective ventilation by opening the door of the warehouse. The covering layer must be at least one metre.

(3) walls, ceilings and floors are made of reinforced concrete with a minimum thickness of 150 mm to build.

Small storage

Section 16 (1) in a small warehouse up to 150 kg of shooting and explosives may be stored.

(2) walls, ceilings and floors are made of reinforced concrete with a minimum thickness of 100 mm to build.

(4) by way of derogation by article 3, par. 4 suitable extinguishing AIDS in sufficient quantities in the immediate vicinity of a small warehouse are ready, if not because of the location and of the purpose of the small camp can be waived.

Storage for small amounts

Shooting or explosives may § 17 (1) Notwithstanding the provisions of the first section up to a volume of 26 kg in its original packaging or in solid, dense containers (boxes, shooting, safety cabinets) in a room the following prerequisites are met, the:



1. the room has to be on the ground and locked.

2. the walls and ceiling of this room must be fire retardant.

3. the floor must have a surface to be cleaned easily and may exhibit no joints, cracks, or comparable wells.

4. the door to this room has to consist of non-combustible materials.

5. window or other openings must be protected against unauthorized access through appropriate grid.

6 next to or immediately above or below the room no living quarters and other rooms to the stay of persons may be located.

7 only equipment must be used for heating, which the goods can ignite nor decompose.

Underground storage

Basic requirements for underground storage

Section 18 (1) underground storage sites must be sufficiently

1. an access tunnel, 2. a storage chamber and 3 a manipulation Chamber consisting.

(4) the minimum distance by which each storage chamber of the areas to be protected above and below ground is according to the formula: D = to measure 2 L 1/3. Access tunnel

Section 19 (1) of the access tunnel is to run, that in the case of a detonativen implementation as little impact of the blast shock wave takes place on the surface.

(2) the total length of the access tunnel has to be at least 1.6 times the distance D (§ 18 par. 4).

(3) in the access tunnel, at least two rectangular kinks must be provided. Storage and manipulation Chamber

Underground storage in niche

Shooting or explosives may § 22 (1) Notwithstanding the provisions of the first section and the sections 19 to 21 to be stored to a volume of 150 kg under the following conditions in niches:



1. the distance of the respective niche to the areas to be protected above and below ground has to be at least 10 m.

2. in the presence of multiple niches, these have so arranged to be that they are secured by intervening pillar or barriers against a detonation transmission. The pillar or barriers must have a thickness of at least two meters.

3. niche may be built only in page lines or blind places and the like, where they are unaffected by business operations.

4.

Niches are in compliance with fire protection technical and weather-technical issues to build and operate.

5 niches have to be locked. Section 3 subsection 2 applies to the access door or the door of the niche.

6. in the area of niche suitable extinguishing AIDS are ready to keep.

(2) in the area of niche may not smoked, still open flame or fire are used and no work involving risk of sparks may be carried. Devices in explosion-proof execution, which can trigger an unintended implementation may not be carried to the niches. In terms of niche manipulation work may not be made on the explosives.

Permit free storage

Storage of small quantities

Section 23 (1) up to a maximum limit of 10 kilograms shooting or explosives (small quantities) outside of approved warehouses in a suitable area and versperrtem container must be stored.

(2) a suitable room exists if



1. This is not the permanent stay of people around a storage room or basement, 2. it is not generally accessible part of a house or no attic, 3. it is no fire hazard rooms, boiler rooms or fuel storage areas and 4 he is dry and Frost as well as the room temperature does not exceed 50 degrees Celsius.

(3) Furthermore is on the suitability in accordance with paragraph 2 required that appropriate deletion AIDS available are as well as the necessary precautions are taken to prevent unauthorized access. Packaging units broken on are measures to ensure that the use of is not impaired.

(5) igniters may be stored only in the manufacturer's original packaging.

(6) on the occasion of shooting competitions or similar events do not visibly store Nitrocet in an amount of up to ten kilograms in a closed vehicle, in a closed container from the outside. This type of storage is permitted only for the time strictly required.

5. section

Final and transitional provisions

Entry into force

§ 24. This Regulation shall enter into force January 1, 2011.

Transitional provisions

Existing section 25 (1) explosives warehouse, that any approval after the shooting and explosives law, BGBl. No. 196/1935, in connection with the shooting and explosives monopoly regulation, Federal Law Gazette No. 204/1935, needed, are to adapt to the provisions of article 23 of this regulation until 1 July 2011.

(2) on the day before the entry into force of this regulation, pending for approval of a bearing are after the shooting and explosives monopoly regulation, Federal Law Gazette to lead No. 204/1935, to end.

Linguistic equal treatment

Appendix 1 to § 4 paragraph 2

Storage class 1.1

Shooting and explosives, which have a mass explosion hazard. (A mass explosion is an explosion which affects virtually instantaneously all quantities in stock.)

Stock class 1.2

Shooting and explosives, which have the risk of formation of splinters, explosives and pieces of litter, but are not a mass explosion hazard.

Stock class 1.3

Shooting and explosives, which have a fire hazard and either by pressure or a low risk of splinters, explosives and pieces of litter or both have a low risk, but are not a mass explosion hazard

(a) whose combustion produces considerable radiant heat or

(b) one at a time to burn, that result in a low air pressure effect or splitter - and blast - litter piece effect or both effects.

Stock class 1.4

Shooting and explosives which pose only a low risk of explosion in the event of ignition or ignition. The effects are essentially limited to the packaging. Acting outside fire may result in almost all of the contents of the packaging not virtually instantaneous explosion.

Stock class 1.5

Very insensitive explosive mass shooting and explosives, which are so insensitive that the probability of initiation or of transition of fire to a detonation under normal conditions is very low.

The safety distance of fire protection zones is for shooting and explosives of the stock class 1.4 in accordance with Appendix 1.
