1. Section

General provisions

Scope

§ 1. This Regulation lays down warehouses for shooting and explosives, as far as they are not warehouses under the Mineralroh Feed Law – MinroG, BGBl. I No 38/1999, the ammunition storage law 2003 – MunLG 2003 BGBl. I No. 9, or under § 2(2). 16 of 1994 - GewO 1994, BGBl. No 194.

Definition provisions

§ 2. In accordance with this Regulation:

1.

storage of guns and explosives: retention of shooting and explosives up to their consumption, excluding short-term preparedness before use; § 8 of the Exploring Regulation – ExploV, BGBl. II No 358/2004;

2.

Under-irdical camp: camp or niche embedded in rock or soil formations;

3.

Local storage: a camp that is not firmly connected to the underground and is designed to enable it locally.

Basic safeguards

§ 3. (1) Brakes and explosives must be kept so that they are sufficiently protected against

1.

influence that can cause unintended implementation, and

2.

Consequences that can affect their ability to use.

(2) All parts of a warehouse and access doors, including the Castle, have sufficient protection against unauthorised access to, or unauthorised use. To ensure adequate protection, it is necessary to assess in particular the following criteria:

1.

protection against foreign access through violence against objects, in particular one of the quantity of warehouses and the storage site, corresponding access door including the Castle;

2.

Protection against random access of legal persons present.

(3) In and before camps and in the fire protection zone is prohibited:

1.

smoking as well as any handling of burning or aggravating objects, with fire, with open light or sound tools, the use of open fires of any kind,

2.

the use and use of electric voltage sources that can cause unintended ignition;

3.

storage of fire-enhancing, self-inflammatory, flammable or other explosive substances as a shooting and explosive agent and

4.

the entry by unqualified persons.

(4) In the camp, appropriate extinguishing aids must be kept in sufficient quantity.

Operating rules

§ 4. (1) On the outside of the access to the camp, it should be pointed out to a ban on detention. On the inside of access to the camp is on the § 3. 3 Z 1 to 3 above.

(2) Any access door to a storage room or a warehouse chamber must provide the following information:

1.

Maximum quantity and

2.

Storage classes according to Annex 1.

(3) The storage chambers or warehouses have to serve exclusively the storage of gun or explosives. In these rooms, no other activities may be directed.

(4) A pre-space or a tampering chamber can only be used for opening packaging and charging with guns and explosives, as well as for storing, transhipment, as well as for using the necessary tools and devices to an essential extent. Storage of other objects is prohibited.

Separate storage

§ 5. (1) explosives and ignition equipment must not be stored in a storage room, a storage chamber or a niche together.

(2) Doing devices must not be stored in a warehouse, a storage chamber or a niche together with explosives.

Electrical devices and flash protection

§ 6. (1) Electrical equipment and electrical installations have to comply with the state of technology and must in particular be protected from dust.

(2) Electrical equipment and electrical installations must be examined by an electric power on their regulatory state:

1.

before the first opening of the camp,

2.

after any substantial change in a warehouse; and

3.

at least every three years.

The proof of this is to be kept in operation for at least three years.

(3) If the camp is not sufficiently protected by its natural situation or by a sufficient amount of Earth oversight against the dangers of atmospheric discharges, a flash protection plant corresponding to the state of technology must be set up and maintained.

§ 7. (1) In each storage area and each storage chamber, there must be an orderly storage:

1.

appropriate facilities such as shelves, shelf compartments, warehouses or pallets and

2.

a suitable thermometer.

(2) If the ignition equipment is not stored in its original packaging, separate shelf ranges are to be installed for each of the stages of the ignition. The floor of the shelf compartments is to prevent mechanical use of the means of ignition with appropriate materials, such as felt or wood.

(3) It is to be seen as a potential balance that connects all the touchable parts in the camp.

(4) In a pre-space or in a tampering chamber, at least one table for tampering work and appropriate extinguishing aids must be in sufficient number.

(5) If the camp is secret, the ground must not have any inconsistencies, squirrel or deepening. An ally ground surface must not be incinerated and must have a slightly clean surface. It must be securely attached, sufficiently viable and, in particular, electrostatic in the storage of electric ignition devices.

§ 8. (1) The ventilation must ensure that all gas or vapours that are dangerous for human health cannot be collected and that condens water is avoided as far as possible.

(2) ventilation openings must be carried out in such a way that no matter or liquids can be raised or penetrated from the outside.

(3) For heating, only heating facilities that cannot be destined or crushed are allowed.

Distribution

§ 9. (1) A distribution must be made all-way, except access. One erosion is to be countered by appropriate measures, such as greening.

(2) As a bulk, a damp material is to be used, such as medium-sized soluble soil (less floor or floor) with a grain size of a maximum of 16 mm.

Access

§ 10. (1) The area of access, as well as the access to the warehouse, must be designed in an appropriate manner and be safe to use.

(2) Prior to access to the camp, a protective wall is to be built which is suitable to shift the pressure into a direction where no persons or objects to be protected are located. The bititel level of the protective wall must exceed access by at least one meters. The establishment of a protective wall is not necessary for small warehouses or, if there is equivalent protection due to the form of the site or growth of the site.

(3) The doors of a camp must be turned outside. doors inside a warehouse must be fire-retardant.

Establishment of several warehouses

§ 11. (1) If several warehouses are built, compliance with a minimum distance ensures that there is no transfer of implementation to the other warehouse in case of implementation of the stock.

(2) The minimum storage distance to each other according to the formula Z = 0.8 L1/3 to be counted. Z is the distance in meters and L the maximum storage quantity in kilograms. The fire protection zone of ten metres between the camps must at least be observed.

(3) Stockpiling with opposite access points (extra bubbles) is inadmissible.

(4) Between camps that are behind each other and have the same level of bladder, the safety margins will apply according to the table in Annex 2 column A.

Admissibility of exceptions

§ 12. (1) On request, the Authority may grant derogations from the provisions of this Regulation, subject to conditions, time limits and conditions, when other equivalent safeguards such as construction measures guaranteeing safe storage in accordance with the principles of this Regulation.

(2) A request for derogation under paragraph 1 are all descriptions and temporarys that are relevant to the assessment of the requested exception (such as the description of the explosive storage in an exceptional and predictable manner, an overview plan on an appropriate scale, in which all buildings are located within the security distance).

Oberirdish Lager

Security distance and fire protection zone

§ 13. (1) In the case of obsolete camps, the safety margins listed in Annex 2.

(2) Without prejudice to the security distance provided for in paragraph 1 is to set up the obsolete warehouse at least 10 meters wide fire protection zone, which is free of storage, disposition of vehicles, excluding loading, and dürrem. There may be no other building in the fire zone.

Large warehouses

§ 14. (1) More than 1000 kg of shooting and explosives can be stored in a large warehouse; However, it must not reach a quantity of 10 000 kg of gun and explosives.

(2) Large warehouses must have a space and ventilation and must be carried out in an unfilled manner.

(3) The warehouse building must not have any further opening except the entrance door and ventilation openings. The distribution must be at least one meter.

(4) The walls, ceilings and floors are to be built from steel concrete with a minimum of 200 mm.

Standard warehouses

§ 15. (1) In a standard warehouse, up to 1000 kg of shooting and explosives can be stored.

(2) Standard warehouses must have a pre-space or before storage access to a protected area (pre-place) and ventilation protected from climatic events. The installation of an ventilation can be excluded if the opening of the storage door is an effective ventilation. The distribution must be at least one meter.

(3) walls, ceilings and soils are to be built from steel concrete with a minimum of 150 mm.

(4) Standard warehouses can also be built as a local storage. In case of this, the area envisaged is to be designated in the application.

Small warehouses

§ 16. (1) In a small warehouse, up to 150 kg of shooting and explosives can be stored.

(2) walls, ceilings and soils are to be built from steel concrete with a minimum thickness of 100 mm.

(3) The distribution must be at least half metres.

(4) Derogation from § 3 4 are ready to maintain suitable fire-fighting aid in sufficient quantities in the immediate vicinity of a small warehouse, unless it can be waived due to the location and use of the small warehouse.

(5) § 15 paragraphs. 4 applies accordingly.

Storage for small quantities

§ 17. (1) Notwithstanding the provisions of the first section, shooting or explosives may also be stored in an area that meets the following conditions:

1.

The space has to be flat and blocked.

2.

The walls and ceiling of this room must be fire-retardant.

3.

The floor must have a slightly clean surface and must not have any slash, cracks or similar deepening.

4.

The door to this area has to consist of non- brennbare material.

5.

windows or other openings must be protected against unauthorised access, for example through appropriate grids.

6.

In addition to or directly above or under the space, no living rooms and other spaces may be located for the stay of persons.

7.

For heating, only installations that cannot be destined or crushed.

8.

In or before the area, an appropriate disposal aid is available.

(2) In this area, neither smoked nor open light or fire can be used and no work involving the risk of radio flight can be carried out. voltages that can cause unintended ignition, such as mobile phones or radio devices, cannot be implemented. Anti-abuse work on explosives must not be done in this area.

3. Section

Subsidiary warehouse

Basic requirements for underground storage

§ 18. (1) Subsidiary storage must be sufficient

1.

hortrous influences (such as collapse or dangerous mountain movements),

2.

water and

3.

Mining gas

be protected.

(2) Subsidiary warehouses must at least

1.

access cases,

2.

a warehouse chamber and

3.

a tamper chamber

exist.

(3) access cases, storage chambers and tampering chambers have sufficiently dimensioned and safe to operate, taking into account transport and storage conditions.

(4) The minimum distance between the respective storage chambers to the areas of obsolete and under days is according to the formula D = 2L1/3 to measure. L is the maximum storage quantity in kilograms and D of the minimum distance in meters. If an explosion closure is set, the distance D is to be measured by a 10% discount.

(5) If the establishment of walls or ceilings is necessary, these are to be performed in steel concrete with a minimum of 200 mm.

(6) Each storage chamber and any tampering chamber is to be closed by a blocked door.

(7) The storage must be carried out in such a way as to ensure a minimum distance of at least 30 cm from ceilings and walls of the warehouse chamber.

Access cases

§ 19. (1) Access deaths must be carried out in such a way that, in case of detonative implementation, the maximum impact of the pressure wave on the surface is achieved.

(2) The total length of access deaths has at least 1.6 times the distance D (section 18). 4) to be.

(3) In access cases, at least two rather angled knicks are available. Knickings are only those smeltings that are removed from the first storage chamber from at least 0.8 times the distance D (§ 18). 4) are ordered. Storage and manipulation chamber

§ 20. (1) The minimum distance between the warehouse chambers between each other and the tampering chamber has the 0.8-fold distance D (section 18). 4) to be.

(2) The warehouse chambers may not have any further links, except access cases.

§ 21. (1) If there is a link with protected areas under days or if the establishment of a protective wall is not sufficient, an explosion closure is foreseen to minimise the explosion pressure.

(2) The length (AE in meters) of access deaths from the storage chamber to the explosion closure will depend on the number of rebates from the Formula AE = 16.8/3nx L0.5 calculated. In this formula, L means the maximum quantity of storage per storage chamber in kilograms and the number of fairly angled squeezing of the open link between the storage chamber and explosion closure. The length of AE can be reduced by others the pressure wave of lower facilities (such as expansion chambers).

(3) The dimensioning of explosion decisions is to be carried out in such a way that they resist the explosion pressure calculated according to the formula p = 65L/v. In this formula, L means the maximum quantity of storage per storage chamber in kilograms, v the content of the space blocked by the explosion closure in litre and p the explosion pressure in kilonewton per square centimeter.

(4) The doors (catch, flaps) of explosion closures must be fitted with devices to prevent a reversal of the following setback.

Underground camps in niches

§ 22. (1) Notwithstanding the provisions of the first section and Articles 19 to 21, shooting or explosives may be stored in niches up to a quantity of 150 kg under the following conditions:

1.

The distance of the respective niche to the areas of obsolete and under days must be at least 10 metres.

2.

In the presence of several niches, these must be arranged in such a way that they are secured by the intermediate pillars or barriers against a detonation transfer. The arrows or barriers must have a thickness of at least two metres.

3.

niches can only be built on side routes or blinds and the same, where they are unimpededed by operating transactions.

4.

niches must be built and operated in compliance with fire-safe and weather-related concerns.

5.

niches have to be blocked. The access door or the niche door applies § 3. 2.

6.

In the field of niches, appropriate extinguishing aids are available.

(2) In the field of niches, neither smoked nor open light or fire can be used and no work involving the risk of radio flight can be carried out. Devices that can trigger unintended implementation cannot be brought into the niches. In the field of niches, manipulation work on explosives must not be carried out.

4. Section

Free retention

Storage of small quantities

§ 23. (1) Up to a maximum quantity of 10 kilograms, shooting or explosives (small quantities) may be stored outside licensed warehouses in an appropriate space and blocked containers.

(2) A suitable space is available if:

1.

it does not serve the permanent stay of persons, such as a storage room or a room,

2.

it is not a publicly accessible part of a house or a roof floor;

3.

These are not areas of fire danger, such as heating rooms or fuel warehouses, and

4.

it is dry and chilled and does not exceed room temperature 50 degrees Celsius.

(3) Further is appropriate in accordance with paragraph 3. 2 Requires adequate fire-fighting aids to be available as well as the necessary measures to prevent unauthorised access. Measures must be taken in case of broken packaging units to ensure that the ability to use is not affected.

(4) In the storage room, smoking and any handling of burning or arable objects, with fire, with open light or fun-catching tools and using open fire of any kind. A corresponding noteboard is well visible at the entrance of the room.

(5) ignition equipment can only be stored in the original packaging of the manufacturer.

(6) On the occasion of shooting competitions or similar events, shooting devices may not be kept visible in a quantity of up to ten kilograms in a closed vehicle, in a closed container and from outside. This type of storage can only be done for the strictly necessary duration.

5. Section

Final and transitional provisions

Entry into force

§ 24. This Regulation will enter into force on 1 January 2011.

Transitional provisions

§ 25. (1) Existing explosives warehouses that do not have to be approved under the Fire and Equipment Act, BGBl. No 196/1935, in conjunction with the Anti-Money Laundering Regulation, BGBl. No 204/1935, shall be adapted to the provisions of Section 23 of this Regulation by 1 July 2011.

(2) On the day before the entry into force of this Regulation, pending procedures for granting a warehouse are to be brought to an end, according to the gun and explosive monopoly regulation, BGBl. No 204/1935.

Language equality

§ 26. In so far as natural persons-related names are only mentioned in male form, they relate to women and men in the same way. When applying the name to certain natural persons, the gender-specific form must be used.

Class 1.1

Class 1.3

shooting and explosives that have a fire risk, which are either a low risk of air pressure or a low risk of splitting, explosive and litter, or both, but are not mass explosive,

(a) in the case of its incinerator,

Class 1.4

Brake and explosives that pose a low risk of explosion in the event of inflammation or ignition. The effects remain essentially limited to the packaging. An outdoor fire must not lead to a virtually simultaneous explosion of almost all contents of the packaging.

Storage class 1.5

Very unsensitive mass explosions and explosives, which are so insensitive that the likelihood of an ignition or the transition of a fire to a detonation is very low under normal conditions.

Class 1.6

Extremely unsensitive shooting and explosives that are not mass explosions and contain only unsensitive detonating substances and have a negligible likelihood of accidental ignition or reproduction.

The safety margins of warehouses, which are to be kept for the plain and free terrain, in which explosives of the storage classes 1.1, 1.2, 1.3, 1.5 and 1.6 are calculated from the formulas mentioned in the table.

The safety margin of the fire protection zone is equivalent to 1.4 for fire-fighting and explosives.
