19. Regulation of the Federal Minister of Transport, Innovation and Technology, which changes the Civil Aviation Staff Regulation 2006
On the basis of § § 29, 33, 36 and 44 of the Aviation Act, BGBl. No. 253/1957, in the version of the Federal Law BGBl. I n ° 83/2008, shall be:
Civil Aviation-Personnel Regulation 2006 (ZLPV 2006), BGBl. II No 205/2006, as amended by the BGBl Regulation. II No 71/2009 is amended as follows:
1. In § 23, the following paragraph 4 is added:
" (4) The competent authority may adopt provisions of JAR-FCL 1, which contain derogations or additions to the provisions of this Regulation, as published by the Joint Aviation Authorities with 1 December 2006 (Amendment 7) apply. These provisions shall be published by the competent authority in an aeronautical manner. In doing so, the competent authority must comply with the requirements of aviation security and shall ensure that there is no adverse effect on any allowances existing under the provisions of this Regulation. When applying the provisions of JAR-FCL 1 (Amendment 7), the competent authority must ensure that equivalent safety standards are ensured in the European comparison. "
2. In § 141, the following paragraph 8 is added:
" (8) § 23 (4) in the version of the BGBl Regulation. II No. 19/2011 enters into force with the day following the presentation in the Federal Law Gazans. "
