150. Regulation of the Federal Minister of Justice on the amendment of the regulation on the implementation of the Public Prosecutor's Act (DV-StAG)
On the basis of Section 43 (2) of the Public Prosecutor's Law, BGBl. No. 164/1986, as last amended by the Federal Law BGBl. I No 111/2010, shall be ordered:
The Ordinary of the Federal Minister of Justice of 16 June 1986 on the implementation of the Public Prosecutor's Law (DV-StAG), BGBl. No 338/1986, as last amended by the BGBl Regulation. II. No 330/2010, shall be amended as follows:
1. § 4 (2) reads:
" (2) The commercial business shall be based on the initial letter of the family name of the accused (first accused) or with regard to the place of crime according to locally defined areas or on the basis of a fixed basis. Distribute key, possibly using a random electronic distribution system, to be distributed to the units. In proceedings against unknown perpetrators, the assignment of the files in the registries BAZ and UT (§ 18 (1) Z 3 and 4) to a particular unit must be done in any case using a random electronic distribution system. "
(2) The following paragraph 1a is inserted in Article 18:
" (1a) In proceedings against unknown perpetrators the proceedings may be terminated immediately after seization in accordance with Section 197 (2) of the StPO, the Rules of Procedure shall be applied to the courts of first and second instance (Geo.) with the proviso that the File number is formed from an ongoing number. An entry into the BAZ or UT Register pursuant to Section 1 (1) (3) and (4) shall be made as soon as an order, an order or a request by the Public Prosecutor's Office is made. "
3. In § 53, the following paragraph 6 is added:
" (6) The provisions of § § 4 (5) and 18 (1a) in the version of the Federal Law BGBl. II No 150/2011 will enter into force on 1 May 2011. "
