206. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection, with which the Federal Regulation on the Highest Numerical Control Regulation (Bundeshighest numerical Education) is amended

Pursuant to Section 14 (3) of the Foreigners Employment Act (AuslBG), BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I No 25/2011, shall be assigned:

The Bundeshighest numerical overdraft regulation-BHZÜV, BGBl. No 278/1995, as last amended by the BGBl Regulation. II No 55/2006, shall be amended as follows:

1. In § 1, the quote shall be "pursuant to Section 12a (1)" by quoting "pursuant to § 14 (1)" replaced.

2. § 1 Z 3 reads:

" 3.		Foreigners who have a residence permit "permanent residence-EC" of another Member State, or who are already legally established in the Federal Republic of Germany, and who fulfil the conditions for employment as a specialist or key force, , as well as their spouses, registered partners and minor minor children (including child and adoptive children); "

3. § 1 Z 5 reads:

" 5.		Foreign nationals who are to be employed on a temporary basis (§ 5 AuslBG); "

4. § 1 Z 8 is deleted.

5. In § 1 Z 10 lit. b becomes the reference "pursuant to Section 382b of the Executive Order" by reference "in accordance with § § 382b or 382e of the Executive Order" replaced.

6. § 1 Z 11 reads:

" 11.		Foreign nationals who enjoy special protection pursuant to § 69a NAG; "

7. In § 2, the expression "9 vH" by the expression "8 vH" replaced.

8. The previous text of § 3 receives the sales designation "(1)" ; the following (2) and (3) are added:

" (2) § 1 Z 3, 5, 10 and 11 as well as § 2 in the version of the BGBl Regulation. II No 206/2011 will enter into force on 1 July 2011.

(3) § 1 Z 8 in the version of the BGBl Regulation. II No 55/2006 will not enter into force on 30 June 2011. '
