206. Regulation of the Federal Minister for labour, Social Affairs and consumer protection, modifies the Federal maximum overdraft regulation

On the basis of § 14 para 3 of the aliens Employment Act (aliens), Federal Law Gazette No 218/1975, as last amended by Federal Law Gazette I no. 25/2011, is prescribed:

The Federal maximum overdraft regulation - allowed, Federal Law Gazette No. 278/1995, as last amended by regulation Federal Law Gazette II No. 55/2006, is amended as follows:

1. in article 1, the quote "according to section 12a paragraph 1" is replaced by the quote "according to § 14 para 1".

2. paragraph 1 Z 3: "3. foreigners /-who have a residence permit"Long-term resident – EC"of another Member State or are already legally established in the Federal territory and meet the requirements for employment as a specialist or key staff, as well as their spouses, registered partners will and unmarried minors (including stepchildren and adopted children);"

3. paragraph 1 Z 5: "5. foreigners /-who should be employed in a temporary (section 5 aliens);"

4. § eliminates 1 Z 8.

5. in section 1, no. 10 lit. b is the reference "pursuant to section 382b of the execution order"

the reference "in accordance with the sections 382 b or 382e of execution order"


6 paragraph 1 Z 11: "11 foreigners /-inside, that special protection in accordance with § 69a NAG enjoy;"

7. in section 2, the expression is replaced by the expression "9 vH" "8 vH".

8. the existing text of § 3 receives the sales designation (1); following paragraph 2 and 3 shall be added:

"(2) § 1 Z 3, 5, 10 and 11, article 2 as amended by the regulation BGBl. II No. 206/2011 enter into force July 1, 2011."

"(3) § 1 Z 8 in the version of regulation BGBl. II Nr 55/2006 comes with override on June 30, 2011."
