68. Federal Act amending the Federal Law on Foreign Legal Relations of the Greek-Oriental Church in Austria

The National Council has decided:

The Federal Law on External Legal Relations of the Greek-Oriental Church in Austria BGBl. No 229/1967, as last amended by the Federal Ministries Act 2007, BGBl. I n ° 6/2007, is amended as follows:

1. According to § 1, the following § 1a. inserted:

§ 1a. (1) With effect for the state sector, the Metropolitan of Austria is chaired by an Orthodox Bishops ' Conference, at least one representative of the dioceses recognised under this Federal Law.

(2) In particular, the tasks of the Orthodox Bishops ' Conference include:

1.

Coordination of religious teaching in the sense of the Law of Religion, BGBl. No 190/1949, as amended,

2.

the ecclesiastic review right within the meaning of § 14 of the Federal Law, BGBl. No 182/1961, on the external legal relations of the Evangelical Church,

3.

Submission of an opinion to the Federal Minister of Education, Arts and Culture prior to the recognition of Orthodox institutions under this federal law.

2. In Section II, the following section IIa is inserted:

Section IIa-Establishment of new dioceses and appointment of organs

§ 3a. (1) The Federal Minister for Education, the Arts and Culture, at the request of the respective Patriarchate, has to make known the establishment of a diocese in the Federal Law Gazprom if:

1.

in Austria there are at least two church congregation for which a diocese has been established in accordance with the ecclesiastical law,

2.

the bishop's seat of this diocese, or the seat of his representative in the episcopal office in Austria, and

3.

there are statutes of the diocese approved by the ecclesiastical supreme authority.

(2) With the manifestation the diocese acquires the position of a corporation public law.

§ 3b. If there is a diocese, it shall have the future statutes or to submit their amendments and those of their congregations to the Federal Ministry of Education, Arts and Culture for approval.

§ 3c. If the conditions for the establishment of a diocese have been omitted, the dissolution of the diocese in the Federal Law Gazprom is to be made known.

§ 3d. (1) In a church congregation, parishes can be set up without any legal personality, with the consent of the respective diocese transferring their own wealth management by decision of the parish for their area can.

(2) In the case of the transfer of the power of action, it is to be determined which function carriers these are to be assigned.

(3) This decision shall be notified to the Kultusbehörde I. Instance of the respective federal state in which the parish is located.

3. In § 7. (1) after the words "Metropolis of Austria" the phrase "for dioceses under section IIa," inserted.
