283. Regulation of the Federal Minister for agriculture and forestry, environment and water management concerning the granting of additional aid for school milk and to the fixing of maximum prices for school milk product in the school year 2011/2012 (school milk price regulation 2011)

On the basis of § 7 para 1 Z 12 and par. 2 of the market organisation Act 2007 (MOG 2007), Federal Law Gazette I no. 55, as last amended by Federal Law Gazette I no. 23/2010, is prescribed:

Scope of application

§ 1. This regulation serves the fixing of additional school milk aid referred to in article 102 paragraph 2 of Regulation (EC) No 1234 / 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation), OJ No. L 299 of November 16, 2007 p. 1 and the establishment of the prices for milk and milk products in accordance with article 14 paragraph 2 of Regulation (EC) No 657/2008 laying detailed rules for the application of Regulation (EC) No 1234/2007 of as regards the granting of Community aid for the supply of milk and certain milk products to pupils in schools, OJ No. L 183 of July 11, 2008 p. 17.

Additional school milk aid

2. (1) for during the period from August 1, 2011 until 31 July 2012 to beneficiaries within the meaning of article 2 of Regulation (EC) No. 657 / 2008 given subsidized milk and milk products is an additional school milk aid granted.

(2) the amount of the additional aid shall be the following no. 657 / 2008 categories for products in annex I of to Regulation (EC):



1. €5.19 / 100 kg for products of category I and 2 4.67 €/ 100 kg for category II products.

The amounts above be taken into account in determining the maximum prices for milk supplied to pupils and milk products.

3. (1) the maximum prices (including VAT) in accordance with section 6, paragraph 1, of the school milk aid regulation 2008 - SBV 2008, Federal Law Gazette II No. 30/2008, last modified by regulation BGBl. II No. 284/2009, be in charge to beneficiaries during the period August 1, 2011 until 31 July 2012:

(2) for products from organic production increases of each fixed maximum prices for products referred to in annex I category I lit. of Regulation (EC) No. 657/2008 to 0.12 euro per litre and for the other products listed in annex I category I and category II to 0.20 euro per litre or kilograms. For fermented milk products with fruit juice, also flavored, listed in annex I, category I lit. c of Regulation (EC) No. 657/2008 increases each fixed maximum price to EUR 0.20 per litre or kilograms. For fermented milk products with fruit, also flavoured, in accordance with Annex I category II of Regulation (EC) No. 657/2008 increases each fixed maximum price to 0.90 euro per litre or kilograms. Each fixed maximum price to EUR 0.20 per liter or kilogram increases for the delivery of milk products in an automated way. As far as supplementary aid, such aid at the respective maximum selling prices are appropriately taken into account.

(3) for extended shelf life (ESL) products of each fixed maximum prices for products referred to in annex I is reduced category I lit. of Regulation (EC) No. 657/2008 to 0.08 euro per litre and for products listed in annex I category I lit. (b) EUR 0,20 per litre. For ultra high temperature (UHT) products decreases of each fixed maximum prices for products referred to in annex I category I lit. (b) of Regulation (EC) No. 657/2008 to 0.28 euros per litre.

(4) exceeded the maximum is allowed, unless the supplier or the supplier of Agrarmarkt Austria proves that exceeds the Community aid and the additional aid on the price paid by the beneficiary reflected.

Expiry of

§ 4. This Regulation shall enter upon the expiry of the 31 July 2012 override. It remains still applicable on the facts relating to the distribution of eligible products in the period August 1, 2011 until 31 July 2012.
