283. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management on the granting of additional school milk aid and on the fixing of the maximum prices for school milk products in the school year 2011/2012 (School Milk-Maximum price-Regulation 2011)

On the basis of Section 7 (1) (12) and (2) of the Law on the Law of the Market 2007 (MOG 2007), BGBl. I n ° 55, as last amended by the Federal Law BGBl. I No 23/2010, shall be ordered:

Scope

§ 1. This Regulation provides for the fixing of additional school milk aid in accordance with Article 102 (2) of Regulation (EC) No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), OJ No. 1 and the fixing of the maximum prices for milk and milk products in accordance with Article 14 (2) of Regulation (EC) No 657/2008 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards the granting of a Community aid for the supply of milk and certain milk products to pupils in schools, OJ L 327, 31.12.2002, p. No. OJ L 183, 11.07.2008 p. 17.

Additional school milk aid

§ 2. An additional school milk aid shall be granted for the milk and milk products delivered for the period from 1 August 2011 to 31 July 2012 to beneficiaries within the meaning of Article 2 of Regulation (EC) No 657/2008.

(2) The amount of the additional aid shall be fixed for products of the categories listed in Annex I to Regulation (EC) No 657/2008 as follows:

5,19 €/100 kg for products of category I and

2.

4.67 €/100 kg for Category II products.

The amounts mentioned shall be taken into account in the fixing of the maximum prices for milk and milk products delivered to pupils.

§ 3. (1) The maximum prices (including VAT) in accordance with § 6 (1) of the School Milk Aid Regulation 2008-SBV 2008, BGBl. II No 30/2008, as last amended by the BGBl Regulation. II No 284/2009, in the case of a charge to beneficiaries in the period 1 August 2011 to 31 July 2012:

(2) For organic products, the maximum price fixed in each case for products listed in Annex I, category I, shall be increased. a of Regulation (EC) No 657/2008 of EUR 0.12 per litre and of the other products referred to in Annex I, category I and category II, by EUR 0.20 per litre or Kilogram. For fermented milk products with fruit juice, also flavoured, in accordance with Annex I, category I, lit. (c) Regulation (EC) No 657/2008 increases the fixed maximum price by EUR 0.20 per litre, respectively. Kilogram. For fermented milk products with fruit, whether or not flavoured, in accordance with Annex I, category II of Regulation (EC) No 657/2008, the maximum fixed price fixed in each case shall be increased by EUR 0.90 per litre, or Kilogram. For the supply of milk products by way of a vending machine, the maximum price fixed in each case shall be increased by EUR 0.20 per litre or Kilogram. To the extent that supplementary aid is granted, such aid should be taken into account at the relevant maximum prices.

(3) For Extended Shelf Life (ESL) products, the maximum price fixed for each product in accordance with Annex I, category I, shall be reduced. (a) of Regulation (EC) No 657/2008 of EUR 0.08 per litre and for products listed in Annex I, category I lit. b at 0,20 Euro per litre. For ultra-high temperature (UHT) products, the maximum fixed price for products listed in Annex I, category I, shall be reduced. (b) Regulation (EC) No 657/2008 of EUR 0.28 per litre.

(4) Exceeding the maximum prices shall be permitted provided that the supplier or the supplier of the agricultural market Austria proves that, in spite of the excess, the Community aid and the additional aid are reflected in the prices paid by the beneficiaries.

Override

§ 4. This Regulation shall expire on the expiry of 31 July 2012. However, it remains applicable to situations relating to the supply of eligible products for the period 1 August 2011 to 31 July 2012.
