334. Regulation of the Federal Minister of Health on information to the public by food business operators in the retail sector
Due to § 38 (4) of the Food Safety and Consumer Protection Act-LMSVG, BGBl. I n ° 13/2006, as last amended by the Federal Law BGBl. I No 95/2010, shall be arranged:
§ 1. ( 1) Food business operators according to § 3 Z 11 LMSVG have in the retail trade pursuant to Art. 3 Z 7 of Regulation (EC) No 178/2002 laying down the general principles and requirements of food law, establishing the European Authority for Food safety and the establishment of food safety procedures, OJ C 327, 28.4. No. OJ L 31, 1.2.2002, as amended, if they have reason to believe that a food sold by them is harmful to health in accordance with Article 5 (5) (5) (1) of the LMSVG, thereby jeopardising a larger population. (common risk), according to § 38 (1) Z 5 lit. a LMSVG to provide information to the public without delay.
(2) The information provided to the public in accordance with paragraph 1 shall be made by means of a trade-off in the retail sector. The following information shall be included in the following information:

the name of the food; |

| 2. |
the producer, manufacturer, importer or distributor; |
|||||||||
| 3. |
which is why the food is harmful to health, |
|||||||||
| 4. |
the warning against the consumption of the food, |
|||||||||
| 5. |
the warning that the warning does not indicate that the health hazard of the food has been caused by the producer, manufacturer, importer or distributor, and |
|||||||||
| 6. |
the measures taken or intended to be taken. |
|||||||||
(3) The slope referred to in paragraph 2 shall be:

clearly visible (at least A 4 format, font size small letter 5 mm) and |

| 2. |
easy to read |
|||||||||
| be. |
||||||||||
(4) The appendix referred to in paragraph 2 has

in the case of packaged foodstuffs, up to the end of the period of consumption or of the date of minimum durability indicated on the packaging in accordance with the provisions of the Food labelling Regulation 1993-LMKV, BGBl. No 72, as amended, |

| 2. |
in the case of unpacked food, to the end of the shelf life to be expected, |
|||||||||
| However, no more than two weeks in the retail trade. The information must be available in all establishments in a company where the food concerned has been placed on the market. |

(5) If the food business operator has a website which also serves the distance marketing of the food, the information provided to the public in accordance with paragraph 1 shall also be made directly on the same for the consumer.
§ 2. In the case of food-borne outbreaks according to Article 43 (3) of the LMSVG, the distribution of food business operators in the retail sector shall contain the following information:

the risk associated with the food, |
|||||||||
| 4. |
the warning against the consumption of the food, |
|||||||||
| 5. |
an indication that the warning does not indicate that the risk has been caused by the producer, manufacturer, importer or distributor; and |

| 6. |
the measures taken or intended to be taken. |
|||||||||
| § 1 para. 2, first sentence and para. 3, 4 and 5 shall apply. |

§ 3. In the case of the personal names used in this Regulation, the chosen form shall apply to both sexes.
