368. Regulation of the Federal Minister for labour, Social Affairs and consumer protection for the temporary employment of foreigners in the winter tourism

Due to section 5, paragraph 2 No. 1 of the aliens Employment Act - aliens, BGBl. No. 218/1975, as last amended by Federal Law Gazette I no. 25/2011, is prescribed:

§ 1 (1) for the winter tourism industry will set a quota of 1 935 for the temporary employment of foreign workers and on the provinces, divided as follows:

              Burgenland:...               20

              Kärnten: ………………….........................................               55, 5 for show control operations

              Lower Austria:...               40, including 15 for entertainment companies

              Upper Austria:...              105, including 15 for entertainment companies

              Salzburg:...              700

              Styria:...              310, 10 for entertainment companies

              Vorarlberg:...              300

              Wien: …………………………………....…………..               10

(2) within the framework of this and with regulation BGBl. II No. 337 / 2011 previously allocated quotas may be granted during the whole temporal scope of this regulation of employment permits, duration of validity may not exceed 24 weeks and do not end after May 15, 2012.

§ 2 (1) for Tyrol is set an additional quota youth Winter Olympic Games of 50 for short-term employment of foreign workers in the accommodation industry, catering and recreational facilities during the 1st in Innsbruck.

(2) within this quota, employment permits may be granted with a maximum duration of four weeks. The term of the grants may not begin before January 1, 2012 and do not end after January 31, 2012.

3. nationals who are subject to the transitional provisions for the EU – free movement of workers (Article 32a aliens), and asylum seekers are preferable in the granting of employment permits.

§ 4. This Regulation shall enter with force on April 30, 2012.
