368. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in winter tourism

Due to § 5 paragraph 2 Z 1 of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I No 25/2011, shall be assigned:

§ 1. (1) For the winter tourism sector, a quota of 1 935 for the temporary employment of foreign workers is established and allocated among the Länder as follows:

Vienna: ......................................................... 10

(2) Within the framework of this Regulation and the BGBl Regulation. No 337/2011 already allocated quotas may be granted during the entire period of validity of this Regulation, which shall not be longer than 24 weeks and shall not end after 15 May 2012 may.

§ 2. (1) For Tyrol, an additional quota of 50 for the short-term employment of foreign workers in the accommodation sector, in the catering sector and in leisure facilities will be provided during the 1. Olympic Youth Winter Games set in Innsbruck.

(2) In the framework of this quota, the granting of employment permits may be granted with a maximum period of validity of four weeks. The duration of the permits shall not be allowed before 1. January 2012 start and not after the 31. Jänner 2012 end.

§ 3. Nationals who are subject to the transitional provisions on the free movement of workers of the EU (§ 32a AuslBG), and asylum seekers are to be preferred in the granting of the employment permits.

§ 4. This Regulation shall not enter into force on 30 April 2012.
