104. Federal law that modifies the notarial procedure

The National Council has decided:

The notary's right, RGBl. No. 75/1871, last amended by Federal Law Gazette I no. 111/2010, is amended as follows:

1. paragraph 1 para 3:

"(3) without prejudice to article 51 of the Treaty on the functioning of the European Union law and notaries who carry out public activities on the basis of statutory provisions, public tasks get."

2. § 6 para 1 subpara 1 is: "1. the nationality of a Member State of the European Union or of another Contracting State of the agreement on the European economic area or the Swiss Confederation," 3 in section 6 paragraph 3 No. 2 is omitted the word "Austrian".

4. § 6 ABS. 3 Z 4 replaces the phrase "or the articles 14a and 14b AVRAG"by the phrase", the sections 14a and 14B AVRAG or similar legislation of a Member State of the European Union, of another Contracting State of the agreement on the European economic area or the Swiss Confederation".

5. in Article 6a, paragraph 4 first sentence the phrase "Austrian nationals" is replaced by the phrase "National of a Member State of the European Union or of another Contracting State of the agreement on the European economic area or the Swiss Confederation".

6 § 19 para 1 lit. c is: "c) due to the loss of nationality to a in article 6, paragraph 1 Z 1 these States;"

7. after article 19, paragraph 1, the following paragraph 1a is inserted:

"(1a) do not enter the legal consequences associated with the loss of nationality, if the notary public of citizen of Z remains 1 States mentioned in article 6, paragraph 1."

8. in section 117a subsection 2 first sentence the phrase "Austrian citizen" is replaced by the phrase "Nationals of a Member State of the European Union or of another Contracting State of the agreement on the European economic area or the Swiss Confederation".

9. in Article 118a, paragraph 1 lit. c is the phrase "Austrian citizenship" by the phrase "nationality to a in section 117a subsection 2 first sentence above States" replaced.

10. after Article 118a, paragraph 1, the following paragraph 1a is inserted:

 

 

"(1a) the legal consequences associated with the loss of nationality does not materialize if the nationals candidate a dwelleth in section 117a subsection 2 first sentence States mentioned."
