108. Statement by the Federal Chancellor on the repeal of the word "unchecked" in § 54 (1a) third sentence of the Code of Civil Procedure, RGBl. 113/1895 idF BGBl. I n ° 111/2010 by the Constitutional Court

According to Art. 140 (5), (6) and (7) B-VG, and in accordance with Section 64 (2) of the Constitutional Court Act 1953, BGBl. No. 85, is made known:

The Constitutional Court has come to the conclusion of the 5. October 2011, G 84 /11-6, G 87 /11-9, G 101 /11-3, G 102 /11-3, delivered to the Federal Chancellor on 11 November 2011, rightly recognized:

" I.

In § 54 (1a), third sentence, Civil Procedure Code, RGBl. 113/1895 idF BGBl. I n ° 111/2010, the word 'unchecked' shall be repealed as unconstitutional.

II.

The repealed word shall no longer be applied.

III.

Previous legal provisions do not enter into force again. "
