399. Regulation of the Federal Minister for Economic Affairs, Family and Youth, amending the Regulation on the storage of pyrotechnic articles in commercial premises in 2004 (Pyrotechnic Storage Ordinance 2004-Pyr-LV 2004)

Pursuant to Section 69 (1) and Section 82 (1) of the Industrial Regulations 1994-GewO 1994, Federal Law Gazette (BGBl). N ° 194, as last amended by the Federal Law BGBl. I n ° 99/2011, is being assigned in agreement with the Federal Minister for Agriculture, Forestry, the Environment and Water Management:

The pyrotechnic storage regulation 2004-Pyr-LV 2004, BGBl. II No 252/2004, shall be amended as follows:

1. The title of the Regulation shall be followed by the following: "Federal Minister for Economic Affairs and Labour" through the phrase "Federal Minister for Economic Affairs, Family and Youth" replaced.

2. In Section 1 (1), the phrase " Pyrotechnikgesetz 1974, BGBl. No. 282/1974, idgF " through the phrase " Pyrotechnikgesetz 2010-PyroTG 2010, BGBl. I No 131/2009 " and the annual number "1974" by the year "2010" replaced.

3. § 1 (5) Z 1 reads:

" 1.

fire retardant, if it is the fire resistance class EI 30 or REI 30 according to the ÖNORM EN 13501-2:2010-02-15 " Classification of construction products and types to their fire performance-Part 2: Classification with the results the fire resistance tests, with the exception of ventilation systems " or the fire resistance class EI 2 30-C, ".

4. In Section 1, Section 5, Z 2 and 3, the word order shall be "ÖNORM B 3850" through the phrase "ÖNORM EN 13501-2" replaced.

5. § 1 (7) reads:

" (7) The net explosive mass within the meaning of this Regulation shall be the sum of the masses of all the sentences in a pyrotechnic article without ignition. "

6. The following paragraphs 8 and 9 are added to § 1:

" (8) Records are loose substances or mixtures of substances which, as a result of an exothermic chemical reaction, achieve an effect of heat, light, sound, gas, fog, smoke, movement, pressure or stimulus, or a combination of these effects.

(9) Pyrotechnic articles for vehicles are components of safety devices in vehicles containing pyrotechnic substances used to activate such equipment or other devices. "

7. In § 2 (1) the annual number shall be: "1974" by the year "2010" replaced.

8. § 2 (7) reads:

" (7) For the first extinguishing aid, a functioning portable fire extinguisher (water or foam extinguisher with a minimum filling quantity of 9 l) must be easily visible and easily accessible in or in front of any room in which pyrotechnic articles are stored. shall be kept ready. "

9. The following paragraphs 8 and 9 are added to § 2:

" (8) In each room where pyrotechnic articles are stored, a safety lighting system shall be fitted to ensure the safe exit of the room in the event of a failure of the general lighting system. This excludes sales containers and sales stands according to § 9 as well as storage containers and warehouse buildings according to § 10.

(9) If pyrotechnic articles are stored with electrical triggering, the triggering devices must be short-circuited. "

10. § § 6 Z 5, 7 Z 5, 8 Z 6, 11 Z 11, 12 Z 11, 13 Z 11 and 14 Z 8 are omitted. In § 8, paragraphs 7 and 8 are given the number designation "6" and "7", In § 11, paragraphs 12 to 14, the number designation "11" to "13" and in § 13, paragraphs 12 to 16, the number designation "11" to "15" . In § 14, paragraphs 6 to 12 shall be given the number designation "5" to "10" .

11. In the title of the 3. Section, in the interim headings of this section, in § § 4, 6 to 11 and in § 12 Z 1, the word sequence is in each case "Classes I and II" through the phrase "Categories F1 and F2" replaced.

12. In the title of § 5 and in the introduction sentence of § 5, the word order shall be "Class I" through the phrase "Category F1" replaced.

13. The previous § § 8 Z 8, 9 Z 4, 10 Z 4, 11 Z 12, 12 Z 12, 13 Z 12 and the nunmehrige § 14 Z 7 are:

"The electrical installation must comply with the electro-technical regulations for" fire-prone spaces ".

14. In the title of the 4. Section and in § 12 the word order shall be "Class III" through the phrase "Category F3" replaced.

15. In the title of the 5. Section, in the interim headings of this section and in § § 13 and 14, the word order shall be "Class IV" through the phrase "Category F4" replaced.

16. In § § 12 Z 2, 13 Z 1 and 14 Z 1 the word order shall be "Classes I to III" through the phrase "Categories F1 to F3" replaced.

17. In § § 13 (2) and (16) (2) (2) the word order shall be "Classes I to IV" through the phrase "Categories F1 to F4" replaced.

18. In § 14 Z 4, the word "Nettomasse" by the word "net explosives" replaced; the parenthesis "(sum of the firing, driving and effect rates)" No.

Storage of pyrotechnic articles of categories S1 and S2

§ 15. (1) Pyrotechnic phrases of category S1 in the form of bengal powder, shellac powder and smoke powder shall be stored in accordance with the provisions applicable to pyrotechnic articles of category F2 with the proviso that their storage shall only be stored in storage rooms, Storage buildings or storage containers are allowed.

(2) The storage of pyrotechnic articles of category S2 shall be carried out in accordance with § 14. "

20. The title of the 7. Section is:

"Storage of other pyrotechnic articles of categories P1 and P2".

21. In § § 16 to 19 and their headings, the word shall be "Nettomasse" by the word "net explosives" and the phrase "pyrotechnic articles for technical purposes" in all grammatical forms by "other pyrotechnic articles of categories P1 and P2" in the respective grammatical form.

22. In § 16 (1) the parenthesis is deleted "(sum of the firing, driving and effect rates)" .

23. § 16 (4) reads:

"(4) § 19a shall apply to the storage of pyrotechnic articles for vehicles."

24. In § 19 Z 1 the expression "§ 14" by the expression "§ 13" replaced.

25. In § 19 Z 2, the expression "§ 15" by the expression "§ 14" replaced.

26. The following § 19a and title shall be added to § 19:

" Storage of pyrotechnic articles for vehicles

" § 19a. (1) Pyrotechnic articles for vehicles may be stored in the working and storage rooms of workshops up to a maximum of 10 kg net explosive mass.

(2) Pyrotechnic articles intended for vehicles with a total mass of more than 10 kg net explosive mass may only be stored under the following conditions:

Pyrotechnic articles for vehicles with a total mass of more than 10 kg net explosive mass must be stored in a separate storage space, with the assembly of vehicle parts or materials which do not cause explosive danger, and which are not explosive, highly flammable, highly flammable and/or highly flammable or corrosive are allowed.

2.

The storage space must be designed as a fire section.

3.

The storage room must be equipped with a ventilation possibility into the open air.

4.

Windows of the storage space must be designed in such a way that, in the case of a fire, no storage items can reach the outside.

5.

The access doors must be clearly visible on the storage material (pyrotechnic articles for vehicles) and the maximum allowable amount of storage by stops in accordance with the labelling regulation.

The floor must have a resistance less than 10 8 Ohm.

Where pyrotechnic articles are stored for vehicles with electric triggering, the floor of the storage room shall be grounded and radio transmitters (e.g. radios or mobile telephones) shall not be introduced.

8.

By way of derogation from Article 2 (9), pyrotechnic articles for vehicles with electrical triggering for the purpose of storage shall not be short-circuited if they are manufactured and delivered by the manufacturer, without a short-circuiting bridge. "

27. The following paragraphs 3 and 4 are added to § 20:

" (3) At the date of entry into force of the Regulation BGBl. II No. 399/2011 already approved commercial operating facilities must comply with § 1 para. 5, § 2 para. 8, § 8 Z 8, § 9 Z 4, § 10 Z 4, § 11 Z 12, § 12 Z 12, § 13 Z 12, § 14 Z 9 and § 19a by no later than three years after the entry into force of this Regulation.

(4) In the date of entry into force of the Regulation BGBl. The pyrotechnic articles of Classes I to IV, which have been referred to in Annex II No 399/2011, shall be considered to be pyrotechnic articles of categories F1 to F4 until they are amended by communication. "

28. In § 21 (1) the word "different" by the word "other", and in Section 21 (2), the words of the word "of pyrotechnic articles of Classes III and IV" by "of pyrotechnic articles of categories F3 and F4" and "of pyrotechnic articles for technical purposes" by "of other pyrotechnic articles of categories P1 and P2" replaced. The following paragraph 3 is added to Article 21:

" (3) The title of the Regulation, § § 1 and 2, § § 4 to 21, all section headings, interim headings and paragraphs as well as Annex 1, respectively, as amended by the Regulation BGBl. II No 399/2011 shall enter into force with the day following the presentation. '

29. The ÖNORM reproduced in Annex 1 shall be replaced by the ÖNORM EN 13501-2:2010-02-15 "Classification of construction products and types to their fire performance-Part 2: Classification with the results from fire resistance tests, with the exception of ventilation systems" replaced.
