403. Ordinance of the Federal Minister of Health, amending the Ordinance on Pharmacists ' Electoral Regulations 2001

On the basis of § 33 of the Pharmacerkammergesetz 2001, BGBl. I n ° 111, as last amended by the Federal Law BGBl. I No 64/2011, shall be arranged:

The regulation on the conduct of the elections to the Austrian Chamber of Pharmacists (Österreichische Apothekerkammer), (pharmacy chamber electoral code 2001), BGBl. II No 339, as last amended by the BGBl Regulation. II No 392/2010, shall be amended as follows:

1. § 19 (2) and (3) reads:

" (2) The approved nominations shall be made known by the Main Electoral Commission not later than seven weeks before the election day. The order of the election proposals in the ballot is based on the number of mandates of the elective groups in the last election of the Executive Board and of the Assembly of Delegates in the respective constituency. If the number of seats is the same, the number of votes cast shall be determined by the last election in the constituency for the group to be elected. Elective groups, which are in the chamber board or in the Assembly of Delegates in the constituency so far have not been represented, are ranked according to the other elective groups according to the date of the arrival of the election proposal.

(3) The approved nominations shall be submitted for inspection during the last ten days before the election day at the places designated in the election manifestation. "

2. § 19 (4) deleted.

3. In § 20 (2), the parenthesis shall be "(Section 19 (3))" by the parenthesis expression "(Article 19 (2))" replaced.

4. In accordance with § 29 (4), the following paragraph 4a is inserted:

" (4a) In a constituency in which only an approved nomination was proposed for an electoral body, so many candidates as members of the Board of the Chamber and the Assembly of Delegates are elected in the order of the electoral proposal, as mandates to are awarded. "

Section 29 (6), first sentence reads:

"The main electoral commission shall declare this to the candidates identified in accordance with paragraph 4 and (4a) as being elected."
