432. Regulation of the Federal Minister of Transport, Innovation and Technology, which amalgles the Act Implementing the Force Act 1967 (57). Novelle to the KDV 1967)

Due to the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law, BGBl. I No 116/2010, shall be arranged:

The law on force driving-Implementing Regulation 1967, BGBl. No 399, as last amended by the BGBl Regulation. II No 458/2010, shall be amended as follows:

1. § 8b (3) reads:

" (3) The confirmation of the manufacturer or his authorised representative in the authorisation state in accordance with paragraph 2 shall be valid for two years from the date of the exhibition. At the end of this period, a new confirmation shall be confirmed on the basis of a further examination of the vehicle with regard to the conformity of its noisable parts and their effects with the original, for the first-time issuing of the confirmation. To display the state of measurement. If values are measured, they may exceed the originally measured values by not more than 2 dB (A). This confirmation shall be valid for two years from the date of the examination. "

2. In Section 11 (8), the third sentence is deleted.

13. In § 62, the following paragraph 1 is inserted after paragraph 1:

" (1a) In the case of tractors not admitted to the market for agricultural trailers-working machines, interchangeable towed machinery or towed equipment, the values of § 54 (2) (3.30 m) shall prevail in respect of the permissible width. For a width of more than 2.55 m, the provisions of section 54 (2) of the first sentence shall apply. "

14. The title of § 63a reads as follows:

18. § 64b (3) reads:

" (3) The theoretical training for all classes of steering authorities shall be carried out in accordance with the curriculum set out in Annex 10a. Lectures are to be supplemented by presentations and exercises, in particular also on the basis of suitable viewing materials and suitable models (§ 64a para. 3). 19. In § 64b paragraph 4 Z 1, the term " Class A " replaced by " Class A1 as well as classes A2 and A, each with direct entry "

Article 64b (5) reads as follows:

" (5) The practical training must be carried out by steering a motor vehicle under the supervision of an owner of a driving instructor's ID. For the training of applicants for the A1 class, additional training for the teaching of risk competence (§ 64f) has to be completed in addition to the driving instructor's ID card. The training has to be carried out

If the training is carried out for several classes simultaneously, the night travel can also be carried out in the course of the training for another class. In the case of training with motor vehicles, a driving instructor may at the same time only train a driving student. In the case of a motor vehicle, drivers may not be given more than four teaching units per day. "

21. In § 64b paragraph 6 Z 1, the expression " Class A " replaced by " Class A1 as well as classes A2 and A, each with direct entry "

22. In accordance with Section 64b (7), the following paragraph 7a is inserted:

"(7a) For more than 18 months between individual parts of the training, without further theoretical or practical training being completed, the parts previously completed may no longer be credited."

23. In accordance with § 64e, the following § 64f shall be inserted with the title:

" Additional training for the mediation of risk competence

§ 64f. (1) The additional training for the teaching of risk competence in accordance with § 64b (5) comprises eight teaching units within the scope of 50 minutes, in which the following contents are to be conveyed:

1.

Concepts for risk behaviour and skills development of young people from pedagogy, youth sociology and developmental psychology,

2.

The risk-competence model (Judgment-Judgment-decide),

3.

the importance of risk-risk development among young people for accident prevention, in particular with regard to motorcycles,

4.

methods and tools to work with young people in terms of the development of risk competence,

5.

the implementation of the knowledge acquired in the training of the driving school and the combination with other methods,

6.

Joint discussion of positions on the risk behaviour of young people.

This content is to be conveyed through the presentation of the theory, discussions and practical exercises on risk perception and on implementation in the classroom.

(2) The additional training for the teaching of risk competence may only be carried out in approved driving instructor training centres (§ 64c). Persons who have special knowledge of risk-pedagogic methods for accident prevention must be available for the specialist lecture on the teaching of risk competence. These persons shall be notified to the Governor of the State. Also in connection with the use of risk-pedagogical methods in the context of driving training, the completion of the additional training does not qualify as a specialist in the course of their implementation. "

24. In accordance with § 69 (29), the following paragraph 30 is added:

" (30) In view of the changes made by the BGBl Regulation. II No 432/2011 shall apply the following transitional arrangements:

1.

§ 11 (8), § 17a (2), § 19b (5), § 52 (10) Z 1 and Z 14, and Appendix 1, Table III, Z 4, respectively, as amended by the BGBl version. II No 432/2011 shall not apply to vehicles which have already been approved before they enter into force, but they must comply with the provisions of the previous legislation;

2.

Section 52 (10) (2) to (10) and (13), respectively, as amended by BGBl. II No 432/2011 shall apply to:

a)

Vehicles of classes T1, T2 and T3 not intended for vehicles which have already been approved before they enter into force, but which must comply with the previous regulations; such vehicles shall not be allowed after 29 September 2012. be admitted for the first time to transport;

b)

Vehicles of class T4.3 not intended for vehicles already approved before 29 September 2013, but which must comply with the previous regulations; such vehicles shall not be allowed to transport for the first time after 29 September 2016 may be authorised;

c)

Vehicles of categories T4.1, T4.2, T5, C, R and S not intended for vehicles already approved three years after the date of entry into force of the last individual Directive to be adopted, but which must comply with the previous rules; such vehicles shall be subject to the provisions of the previous Directive; Vehicles may not be allowed for the first time for the first time after six years after the date of entry into force of the last individual Directive which has yet to be adopted.

3.

Annex 5d in the version BGBl. II No 432/2011 shall not apply to the number of marks already assigned;

a)

Until 30 June 2012, registration plates must still be assigned with the previous authority designations "BA", "JU" or "KF"; as of 1 July 2012, the registration owner of a vehicle, for which a license plate with the official names "BA", "JU" or "KF", has yet to be assigned. , the possibility of assigning an identifier under Annex 5d in the BGBl version. II No 432/2011;

b)

already assigned marks with the authority designations "BA", "JU" or "KF" remain valid during an upright registration of the vehicle; in the case of an application or the assignment of another character during an upright admission are but the names of the authorities in accordance with Annex 5d in the version BGBl. II No 432/2011; exemption from registration plates with the names of the authorities "BA", "JU" or "KF" are only possible until 30 June 2012 and shall be valid until this date;

c)

You may also continue to use the "BA", "JU" or "KF" authorities with the names of the authorities in the case of an application or the assignment of a registration mark during an upright admission until the end of the right to guide this wish mark. if they are reserved until 30 June 2012; an extension of the right to guide the desired identification is only possible, provided that the time period for the application of the respective renewal request pursuant to section 48a (8a) of the KFG is still valid. until 30 June 2012, but this period ends in these cases at least with 30 June 2012;

4.

In the case of the authorities or the admissions office, in order to cover the current demand, the registration plates with the authority designations "BA", "JU" or "KF" may still be used for a period of three months after 30 June 2012 taken up and assigned to their characteristics;

5.

A conversion of the marking (§ 5 ZustV) of the relevant registration authorities and the relevant registration stamps (§ 10 ZustV) must be made by 1 July 2012 at the latest. "

25. In accordance with § 70 (12), the following paragraph 13 is added:

" (13) The amendments by the Regulation, BGBl. II No 432/2011 shall enter into force as follows:

1.

Section 52 (10) (2) to (10) and (13), respectively, as amended by BGBl. II No 432/2011 concerning

a)

vehicles of classes T1, T2 and T3, at the end of the day of the customer's event;

b)

Vehicles of class T4.3 with 29 September 2013 and

c)

Vehicles of categories T4.1, T4.2, T5, C, R and S three years after the date of entry into force of the last individual Directive to be adopted;

2.

the title of § 63b, § 63b (1), § 64a (3) Z 2.1.1, § 64b (3), Section 64b (4) (1), Section 64b (5), Section 64b (6) Z 1, Annex 10a and Annex 10b, respectively, in the version BGBl. II No 432/2011 with 19. Jänner 2013.
