453. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection, with which the regulation on the assessment of the care requirement is amended in accordance with the Federal Nursing Money Act (Einstufungsverordnung zum Bundesmoisturallowances Act-EinstV)

On the basis of § 4 of the Federal Nursing Money Act, BGBl. No 110/1993, as last amended by the Federal Law, BGBl. I No 58/2011, shall be ordered:

1. § 8 reads:

" § 8. In any case, the basis of the decision on the granting of care allowance forms a medical expert opinion. The decision on the reassessment of the care money can also be based on an expert opinion from members of the higher-level service for health and nursing care. If necessary, people from other fields, such as salvation and special education, social work, psychology, and psychotherapy should be included in the holistic assessment of the nursing situation. "

2. The following paragraph 4 is added to § 9:

" (4) § 8 in the version of the BGBl Regulation. II No 453/2011 shall enter into force 1. Jänner 2012 in force. "
