469. Presentation of the Federal Minister of Justice on the repeal of the provisions of the regulation on the re-establishment of court fees and tax bases, BGBl. II No 188/2009, the regulation on the level of fees for the production of copies by the public prosecutor's office or the criminal police in the context of file inspection, BGBL. II No 390/2007, of the Decree of 17 July 2009, Zl. BMJ-L390.002/0003-II 3/2009, amending the Law of the Court of Justice and the Decree of 26 July 2010, Zl. BMJ-B18.000/0006-I 7/2010, on certain aspects of the determination of the appeal fees in accordance with the subheading 12a GGG in the executive proceedings and the fees for file copies, revelations and other copies according to subheading 15 Note 6 GGG by the Constitutional Court

According to Art. 139 (5) B-VG, it is made known:

The Constitutional Court, with the recognition of 13 December 2011, G 85,86/11-17, V 77-81/11-17, the Federal Minister for Justice, delivered on 21 December 2011:

1. (a) Article I Z 17 lit. b of the regulation of the Federal Minister for Justice on the reestablishment of court fees and tax bases, BGBl. II No. 188/2009, was illegal.

(b) § 2 of the Ordination of the Federal Minister of Justice on the amount of fees for the production of copies by the Public Prosecutor's Office or the Criminal Police in the context of file inspection, BGBl. II No 390/2007, is being repealed as being illegal.

(c) The three last paragraphs of the decree of the Federal Minister for Justice of 17 July 2009, Zl. BMJ-L390.002/0003-II 3/2009, concerning the amendment of the court fee law, are repealed as being illegal.

(d) Z 3 lit. a, c and d (together with footnotes) of the decree of the Federal Minister for Justice of 26 July 2010, Zl. BMJ-B18.000/0006-I 7/2010, on individual aspects of the determination of the appeal fees in accordance with the subheading 12a GGG in the executive proceedings and the fees for file copies, revelations and other copies according to subheading 15 Note 6 GGG, will be as illegal.
