9. Reaction of the Federal Chancellor concerning the scope of the Convention on the law applicable to the form of final provisions

According to the communication from the Ministry of Foreign Affairs of the Netherlands, the following states have their instruments of accession to the Convention on the Law Applicable to the Form of Ultimate Injunctions (BGBl. No 295/1963, last proclamation of the BGBl area. III n ° 97/2007):

On the occasion of the deposit of the instrument of accession, the following states have declared the following reservations:

Moldova:

According to Art. 9 of the Convention, by way of derogation from Article 1 (3) of the Convention, the Republic of Moldova reserves the right to determine the place where the deceased had his residence in accordance with the law applicable at the place of jurisdiction (lex fori).

Pursuant to Article 10 of the Convention, the Republic of Moldova reserves the right not to recognise the most recent dispositions of one of its nationals who have no other nationality, except in the case of exceptional cases. Circumstances, established in oral form.

Ukraine:

According to Art. 9 of the Convention, Ukraine reserves the right to determine the place where the deceased has had his residence in accordance with the law applicable at the place of jurisdiction (lex fori).

According to Art. 10 of the Convention, Ukraine reserves the right not to recognise the ultimate injunctions of Ukrainian nationals in oral form, except in the case of exceptional circumstances.

3.

In accordance with Article 12 of the Convention, Ukraine reserves the right not to apply this Convention to arrangements in a final agreement which, under the law of Ukraine, are not of a non-brethical nature.
