53. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, with which the old-vehicle regulation is amended

On the basis of § § 14, 23 and 36 of the Waste Management Act 2002 (AWG 2002), BGBl. I n ° 102, as last amended by the Federal Law BGBl. I n ° 9/2011, is to be arranged in agreement with the Federal Minister for Economic Affairs, Family and Youth:

The End-of-Life Vehicle Ordinance, BGBl. II No 407/2002, as last amended by the BGBl Regulation. II No 179/2010, shall be amended as follows:

1. § 2 Z 9 reads:

" 9.

"dangerous substance" means any substance which meets the criteria for one of the following in Annex I to Regulation (EC) No 1272/2008 on the classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67 /548/EEC and 1999 /45/EC and amending Regulation (EC) No 1907/2006, OJ L 327, 30.12.2006, p. No. 34, presented hazard classes or hazard categories:

a)

Hazard classes 2.1 to 2.4, 2.6 and 2.7, 2.8 types A and B, 2.9, 2.10, 2.12, 2.13 categories 1 and 2, 2.14 categories 1 and 2, 2.15 types A to F;

b)

Hazard classes 3.1 to 3.6, 3.7 impairment of sexual function and fertility, as well as development, 3.8 excluding narcotic effects, 3.9 and 3.10;

c)

Hazard class 4.1;

d)

Hazard class 5.1. "

2. In § 7 (3) and § 11 (4) the word order shall be "up to the end of the calendar year following the withdrawal" through the phrase "up to the end of the second calendar year following the withdrawal" replaced.

3. The title of § 11 reads as follows:

"Obligations of the First Contractors"

4. In Section 11 (1), the word order shall be deleted "and any other vehicle dealer" .

(5) In § 12a (1), the word order shall be "up to the end of the calendar year following the date of adoption" through the phrase "up to the end of the second calendar year following the date of adoption" replaced.

6. In § 13, at the end of the Z 5 the word "and" ; after Z 6 the following Z 7 and 8 are inserted:

" 7.

Directive 2008 /112/EC amending Directives 76 /768/EEC, 88 /378/EEC and 1999 /13/EC as well as Directives 2000 /53/EC, 2002 /96/EC and 2004 /42/EC in order to adapt them to Regulation (EC) No 1272/2008 on classification, labelling and Packaging of substances and mixtures, OJ No. OJ L 345, 23.12.2008 p. 68, and

Directive 2011 /37/EU amending Annex II to Directive 2000 /53/EC on end-of-life vehicles, OJ L 206, 22.7.2011, p. No. OJ L 85, 31.03.2011 p. 3, "

7. The following paragraph 8 is added to § 14:

" (8) § 2 Z 9, § 7 para. 3, the title to § 11, § 11 para. 1 and 4, § 12a para. 1, § 13 Z 5, 7 and 8 as well as the annex 2 in the version of the regulation BGBl. II No 53/2012 shall enter into force with the day following the presentation. '

1 ) Disassembly, if an average threshold of 60 grams per vehicle is exceeded in connection with entry 10a. Electronic equipment which is not installed by the manufacturer during manufacture shall be excluded from the application of this clause.

2 ) This exception will be reviewed in 2015.

3 ) This exception will be reviewed in 2014.

4 ) This exception will be taken before the 1. January 2012 reviewed.

5 ) Disassembly, if an average threshold of 60 grams per vehicle is exceeded in connection with entry 8a to 8j. Electronic equipment which is not installed by the manufacturer during manufacture shall be excluded from the application of this clause.

Notes:

-

A maximum concentration value of up to 0.1% by weight of lead, hexavalent chromium and mercury per homogeneous material and up to 0.01% by weight of cadmium per homogenous material shall be tolerated.

-

The re-use of vehicle parts which have already been placed on the market before the expiry of the period of validity of an exemption shall be permitted without restriction, as it does not fall within the scope of Article 4 (1).

-

Spare parts placed on the market after 1 July 2003, which are used for vehicles placed on the market before 1 July 2003, shall be exempted from the provisions of Section 4 (1). This shall not apply to balancing weights, carbon brushes for electric motors and brake linings. "
