53. Regulation of the Federal Minister for agriculture and forestry, environment and water management, modifies the old vehicle regulation

On the basis of §§ 14, 23 and 36 of the waste management act of 2002 (AWG 2002), Federal Law Gazette I no. 102, I no. is amended by the Federal Act Federal Law Gazette 9/2011, in agreement with the Federal Minister of economy, family and youth:

The old vehicle Ordinance, BGBl. II no 407/2002, as last amended by regulation BGBl. II No 179/2010, is amended as follows:

1 paragraph 2 Z 9: "9"hazardous substance"each substance, the criteria for any of the following in annex I of to Regulation (EC) no 1272/2008 on classification, labelling and packaging of substances and mixtures, amending and repealing directives 67/548/EEC and 1999/45/EC and amending Regulation (EC) No 1907/2006, OJ" No. L 246 of the 23.09.2011 meets S. 34, set out hazard classes or risk categories: a) hazard classes 2.1 to 2.4, 2.6 and 2.7, 2.8 types A and B, 2.9, 2.10, 2.12, 2.13 categories 1 and 2, 2.14 categories 1 and 2, 2.15 types A to F;

b) hazard classes 3.1 to 3.6, 3.7 impairment of sexual function and fertility, as well as the development, 3.8 effects other than narcotic, 3.9 and 3.10;

c) hazard class 4.1;

d) hazard class 5.1.

2 in § 7 para 3 and § 11 paragraph 4 the phrase "until the end of the calendar year following the redemption" is replaced by the phrase "up to return following the end of the second calendar year".

3. the heading of section 11 is as follows:

"Obligations of the initial transferee"

4. in the section 11, paragraph 1, the phrase "and any other vehicle dealer" is omitted.

5. in section 12a paragraph 1, the phrase "up to the end of the calendar year following the date of the acquisition" is replaced by the phrase "up to the time of the acquisition following the end of the second calendar year".

6. in paragraph 13, the word is omitted at the end of the Z 5 "and"; After the No. 6 following Nos. 7 and 8 are inserted: "7 the Directive 2008/112/EC amending Directives 76/768/EEC, 88/378/EEC and 1999/13/EC and directives 2000/53/EC, 2002/96/EC and 2004/42/EC in order to adapt it to Regulation (EC) no 1272/2008 on classification, labelling and packaging of substances and mixtures" , OJ No. L 345 of December 23, 2008, p. 68, and 8.
the 2011/37/CE directive amending Annex II of Directive 2000/53/EC on end of life vehicles, OJ "No. L 85 by 31.03.2011 p. 3," 7. The following paragraph 8 is added to article 14:

"(8) § 2 Z 9, § 7 paragraph 3, the heading to section 11, article 11, paragraph 1 and 4, Article 12a para 1, § 13 Nos. 5, 7 and 8, as well as a schedule 2 as amended the regulation Federal Law Gazette II No. 53/2012 with the day following the proclamation into force."

(2) this exception is checked by 2015.

(3) this exception is checked in 2014.

(4) this exception is checked before January 1, 2012.

(5) removal, if in connection with entry 8a an average threshold of 60 grams per vehicle is exceeded to 8j. Electronic devices that are not installed by the manufacturer during the manufacturing, are excluded from the application of this clause.

 

Notes:-a maximum concentration value up to 0,1% by weight lead, hexavalent chromium and mercury per homogeneous material and up to 0,01 weight percent cadmium per homogeneous material will be tolerated.

-Reuse of automotive parts, which were already before the end of the period of validity of an exception in transport, is fully allowed because it doesn't fall under article 4, paragraph 1.

-Spare parts installed after July 1, 2003, in transport, used for vehicles before the 1 July 2003 which are exempted from the provisions of § 4 para 1. This does not apply carbon brushes for electric motors and brake linings for weights,."
