56. Regulation of the Federal Minister of Health on detailed provisions concerning the animal welfare-conformant training of dogs

Pursuant to § § 2, 14, 24 (1) Z 2 and 24 (3) of the Federal Law on the Protection of Animals (Animal Protection Act-TSchG), BGBl. I No 118/2004 Article 2, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 80/2010, shall be ordered:

Section 1

General

Scope

§ 1. This Regulation shall apply to the training of all dogs. Exceptions to this are the service dogs within the meaning of § 1 of the Diensthunde Training Ordinance, BGBl. II No 494/2004.

(2) The personal requirements for the pursuit of a business, which is the subject of training and behavioural training of dogs, shall be governed by the provisions of the Industrial Regulations 1994.

Principles in dog training

§ 2. (1) The training of the dog must be in compliance with animal protection standards. In particular, it should be borne in mind that no measures are used which are covered by the prohibition of the cruelty of animals in accordance with Article 5 of the TSchG.

(2) In the case of the training of the dog, it is important to lay down that

1.

encouraging the good social behaviour of dogs towards people and other dogs and appropriate habituation to their living and training environment,

2.

the training is age-based and corresponds to the physical possibilities and learning requirements of the dog,

3.

to racial specific characteristics and individual characteristics of the dog is adequately addressed.

(3) In the training of the dog, it must be ensured that it is based on the basics of learning theoretical knowledge and methods of positive motivation are given in advance of aversiven methods.

Requirements for persons who train dogs

§ 3. (1) Persons who train dogs must:

1.

comply with the principles set out in § 2;

2.

self-sufficient and suitable for keeping animals according to § 12 of the TSchG

3.

to be reliable.

(2) Anyone who trains dogs without complying with the requirements of paragraph 1 is subject to an administrative surrender in accordance with § 38 para. 3 TSchG.

Exclusive reasons

§ 4. (1) Reliability within the meaning of Section 3 (1) (3) (3) does not apply if a person has been legally convicted by a court or administrative authority on the grounds of animal-agonist conduct, or if he/she has been sentenced to death by a court or has been punished or the Public Prosecutor's Office has resigned from law enforcement on the basis of diversionary measures (§ 198 StPO).

(2) Likewise, these requirements do not exist if a person has been convicted in a legally binding manner on account of an intentional crime or offence against body and life.

Section 2

"Animal protection qualified dog trainer" or "Pet-qualified dog trainer"

Requirements for animal-qualified dog trainers Animal-welfare-qualified dog trainers

§ 5. (1) As An "animal Skilled Dog Trainer", "Animal protection qualified dog trainers" may only be referred to as persons who, in addition to the requirements of § § 3 and 4

1.

can prove the required qualification in accordance with § 6, and

2.

have passed the examination in accordance with § 6 (1) Z 2 in a positive way.

(2) Dog trainers Dog trainers may be issued a seal of quality which is marked as "animal protection qualified" if the conditions set out in paragraph 1 are met.

Requirements for animal-qualified dog trainers Animal-welfare-qualified dog trainers

§ 6. (1) The training shall include at least the following:

1.

At least two years of practical experience in working with dogs according to the principles of § 2.

2.

The examination of the contents according to § 7, consisting of a theoretical part and a practical part, and which are taken together by an examination board in accordance with paragraph 3, shall be taken up. In the practical part, solution approaches are to be provided in at least four different training situations.

3.

Compulsory training of at least 40 hours within two calendar years, which offers, on the one hand, a repetition and deepening of the training content in accordance with § 7 and, on the other hand, further training.

(2) The qualification certificate within the meaning of § 5 (1) Z 1 shall be deemed to have been provided if the dog trainer or trainer is responsible for the qualification of the dog. the dog trainer

2.

has completed the examination in accordance with paragraph 1 (1) (2).

(3) The examination board shall consist of three experts, namely:

1.

of a scientist, a scientist who, who is active in one or more territories pursuant to Article 7 (1) (10) and (14),

2.

of a dog trainer a dog trainer with animal protection competence and experience in the education and training of dog trainers dog trainers and

3.

a person with a professional knowledge of animal protection and veterinary or behaviorally biological knowledge.

Training content

§ 7. (1) For the qualification as an "animal protection qualified dog trainer" or "animal protection qualified dog trainer" or In any case, the basic principles in the following areas of content must be proved as "animal protection qualified dog trainers":

1.

Animal welfare-appropriate education methods and animal welfare-related issues of dog training, knowledge and application of animal welfare-friendly training methods, animal welfare relevance of various educational methods and aids;

2.

Learning behaviour of dogs and learning methods, theoretical foundations of classical conditioning and operative conditioning, as well as cognitive and social learning in dogs;

3.

expression behaviour of dogs, communication behaviour of dogs towards conspecificates as well as people according to certain moods (especially anxiety, stress, appeasement, defenses) and racial differences;

4.

The nature and behaviour of dogs, social behaviour, the behaviour of dogs in normal situations versus conflict situations, the assessment of nature and temperament, social order and resource control in dogs;

5.

Anxiety and aggression behavior causes and development of meidebehavior and defenses as well as fear and aggression avoidance in everyday life and dog training;

6.

Stress in dogs, neurophysiology of stress events, measures to avoid stress and stress management, effects of stress in everyday life and in dog training;

7.

Rassekunde and racespecific behavior: the genesis of the individual races and their aptitude, individual and racial differences in behaviour;

8.

Welfare-friendly attitude and coexistence with the dog: species-specific and racial-specific requirements for keeping, feeding, caring for and utilization of the dog, questions of the coexistence of dogs and people in everyday life;

9.

Breeding and rearing of dogs, basics of dog breeding, puppy development and socialization phases, puppy learning and requirements for "puppy schools";

10.

Ethology of dog, evolution and history of dog, evolution of behaviors; motor, sensory and cognitive abilities of the dog;

11.

Right, animal welfare law, legal issues of dog husbandry;

12.

veterinary basics, diseases of the locomotor system, vaccinations, common diseases and hereditary diseases, genetics and anatomy, first aid to the dog;

13.

communication and didactics, basics of communication and rhetoric, teaching of learning contents and building of training tasks; ethical questions of dog training;

14.

Human-animal relationship, basics of human-animal relationship in general and the human-dog relationship in particular, communication man-dog, sources of danger and avoidance;

15.

Dog sport, saving of dog sports and other forms of employment of dogs, including their training requirements, questions related to animal welfare in the various divisions/training processes.

(2) The current training contents and explanations are provided by the Federal Minister of the Federal Republic of Germany. Published by the Federal Minister of Health on the homepage of the Federal Ministry of Health.

Coordinating body

§ 8. (1) With the award of the quality seal "Tierschutzqualified Hundetrainerin" or "Animal protection qualified dog trainer" shall be provided by the Federal Minister, respectively. by the Federal Minister of Health, a coordinating body. There is no legal entitlement to an assignment. In case of omission of the conditions, the deprivation of the application takes place.

(2) The coordinating body shall have relevant scientific experience, which shall include scientific expert experts from independent experts from the following fields:

1.

Right (in particular, animal welfare legislation),

2.

Behavioural Biology,

3.

Learning Biology and Cognitive Research,

4.

Veterinary medicine.

(3) The coordinating body shall be entitled, upon request, to the seal of approval "Animal Protection Qualified Dog Training" or "Animal Protection Qualified Training". "animal protection qualified dog trainer" if the applicant or the applicant fulfils the conditions laid down in § § 5 and 6. To this end, it closes with the dog trainer who is looking for the seal of quality. a contract for the dog trainer who is seeking the seal of approval. The coordinating body shall also decide on the authorisation to continue and withdraw the seal of quality.

Role

§ 9. (1) The coordinating body shall be responsible for:

1.

the definition of the modalities of examination,

2.

the definition of administrative agendas;

3.

the verification of the conditions of access for the examination in accordance with § 6 and the conduct of the examination,

4.

the review of training;

5.

the award of the seal of quality, its continuation and disqualification,

6.

the management of a register of recognised and recognised quality seals and the publication of the recognition and withdrawal of the seal of quality on the homepage of the coordinating body,

7.

the registration of the trademark "Animal Protection Qualified Dog Training" or "Animal protection qualified dog trainer" in the trademark register in accordance with the provisions of the trademark protection law 1970, BGBl. N ° 260/1970, as last amended by BGBl. I No 126/2009.

(2) The coordinating body shall have directives in respect of:

1.

Details on the design of the quality seal "Tierschutzqualified Hundetrainerin" or "Tierschutzqualified Hundetrainerin" "Pet-qualified dog trainer",

2.

Details on the expiry of the audit,

3.

Details of an on-the-spot check,

4.

the cost-bearing and

5.

the continuation and withdrawal of the quality seal

to work.

Approval of policies

§ 10. The guidelines referred to in § 9 (2) shall be drawn up within three months from the appointment of the coordinating body and shall be the Federal Minister's office, respectively. to submit to the Federal Minister of Health for approval. After approval, the guidelines are to be published immediately on the homepage of the coordinating body. Each amendment to the guidelines is provided by the Federal Minister to approve the Federal Minister of Health.

Guided tour of the quality seal

§ 11. (1) The seal of approval "Animal Protection Qualified Dog Training" or "Animal protection-qualified dog trainer" is the coordinating body at the request of the dog trainer, if the other conditions are fulfilled after successfully completed examination in accordance with § 6 (1) Z 2. of the dog trainer. It may be taken from the date of the award ceremony.

(2) The seal of approval "Animal Protection Qualified Dog Training" or "Pet-qualified dog trainer" shall be allowed to continue if:

1.

the proof of the training is provided in accordance with Article 6 (1) Z 3,

2.

there is no superstition, and

3.

the award is no longer than four years ago or, within three months of the expiry of that period, an application for the continuation of the seal of approval is submitted.

§ 12. This Regulation shall enter into force on 1 April 2012, but not before the end of the day of its presentation in the Federal Law Gazans.
