89. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, with which the DAC Regulation "Leithaberg" and the DAC Regulation "Eisenberg" will be amended

Due to § 34 (1) of the Wine Act 2009, BGBl. I n ° 111, as last amended by the Federal Law BGBl. I No 111/2010, shall be ordered:

1. The Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for regional quality wines with origin profiles for the wine-growing region of Leithaberg, BGBl. II No. 252/2009, in the version of the Federal Law BGBl. I n ° 111/2009, is amended as follows:

1. § 1 reads:

§ 1. The political district Eisenstadt surrounding, the Freistadt Eisenstadt and the political communities Jois and Winden as well as in the municipality of Neusiedl am See the Rieden Marthalwald, Marthaläcker, Landstraße Hutweide, Zuckermantel I & II, Lange Ohn, Übermasses, Stümpfl, Lange Neuberg, Fügler, Upper & Lower Froschau, Short Neuberg, Lower Neuberg, Upper Meadows, Lower & Upper Gern, Upper & Lower Blindberg, Zwergäcker and Lange & Middle Sauerbrunn form the Leithaberg wine-growing region.

2. § 2 Z 3 reads:

White wine must be made from the quality wine grape varieties "Pinot Blanc", "Weißer Burgunder" ("Pinot Blanc") , "Chardonnay", "Neuburger", "Grüner Veltliner" or a blend of these grape varieties has been prepared.

3. § 2 Z 6 reads:

" 6.

The actual alcoholic strength by volume shall be at least 12.5%. "

4. § 2 Z 10 reads:

10.

Development and placing on the market:

a.

Red Leithaberg DAC must be removed from the wooden barrel and not delivered to the consumer before 1 September of the second year after the harvest; an application to obtain the state test number may only be submitted between April and November from the the second year after the harvest;

b.

White Leithaberg DAC must not be delivered to the consumer before 1 September of the year following the harvest; a request to obtain the state test number may only be made in the period April to November from the year following the harvest be made.

2. The regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for regional quality wines with origin profiles for the wine-growing region Eisenberg, BGBl. II No 57/2010, shall be amended as follows:

§ 2 Z 7 reads:

" 7.

"Eisenberg DAC" can be placed on the market under one of the following two categories:

a)

"Eisenberg DAC":

-

Taste: typical, fruity, mineralic-spicy;

-

Colour: covered strong red;

-

Odour: typical, refreshing sortenbukett;

-

Extension: no up to barely noticeable wooden sound;

-

the actual alcoholic strength shall be indicated at a minimum of 12.0% on the label;

-

Closure: natural cork, screw cap or glass closure;

-

the wine may not be delivered to the consumer before 1 September of the year following the harvest; a request for obtaining the state test number for wine with the name "Eisenberg DAC" shall be allowed from 1 June of the year on the harvest the following year.

b)

"Eisenberg DAC", indicating the name "Reserve":

-

Taste: varietal, fruity, mineral-spicy, strong, with potential;

-

Extension: in the traditional large wooden barrel or in the barrique;

-

the actual alcoholic strength by volume shall be indicated by at least 13.0% vol. on the label;

-

the wine may not be delivered to the consumer before 1 March of the second year following the harvest; an application for obtaining the state test number for wine with the name "Eisenberg DAC Reserve" may be made from 1. Jänner of the year following the harvest will be placed next year;

-

Closure: natural cork, screw cap or glass closure. "
