104. Regulation of the Federal Minister of Transport, Innovation and Technology, which changes the communication survey regulation

Pursuant to Section 90 (2) of the Federal Act, which enacted a telecommunications law (Telecommunications Act 2003-TKG 2003), BGBl. I n ° 70/2003, as last amended by the Federal Law BGBl. I No 102/2011, shall be arranged:

The communication survey regulation, BGBl. II No 365/2004, shall be amended as follows:

1. § 1 (2) reads:

" (2) The following statistics shall be compiled:

1.

Quarterly statistics on sales, infrastructure, traffic values and number of customers, or connections with operator selection or carrier pre-selection of public voice telephony at fixed locations,

2.

Quarterly statistics on turnover, traffic values and the number of SIM cards used by public mobile services,

3.

Quarterly statistics on turnover, number and capacity of leased lines and Ethernet services,

4.

Quarterly statistics on turnover and number of broadband access,

5.

Quarterly statistics on the number of porting operations,

6.

Quarterly statistics on business performance indicators for employees and investments in the telecommunications sector. "

2. § 7 (2) reads:

" (2) The following publications are to be produced by broadcasting and Telekom Regulierungs-GmbH quarterly and shall be published on the Internet at the latest one quarter after the conclusion of the survey in accordance with § 1 (1) Sentence 2 and 3:

1.

Statistics on public voice telephony at fixed locations, which have to include:

a)

Quarterly data on revenues from access services for public voice telephony at fixed locations differentiated by customer group (private customer/non-private customers),

b)

Quarterly data on turnover from connection charges for calls for talks on the public telephone network at fixed locations differentiated according to customer group (private customers/non-private customers) and after call distance (domestic fixed network, domestic mobile network, Abroad, service call numbers),

c)

Quarterly data on the number of connections, differentiated according to type of connection (POTS, ISDN, Mult-ISDN),

d)

Quarterly values on the number of customers or Connections with operator selection or carrier pre-selection,

e)

Quarterly data on the call minutes on the fixed-network retail market, differentiated according to the call distance (domestic fixed network, domestic mobile network, foreign service call numbers),

f)

Quarterly figures on the development of revenues from originations, scheduling and transit.

2.

Statistics on public mobile communications services, which have to include:

a)

Quarterly data on total mobile communications revenue,

b)

Quarterly data on the minutes of the mobile telephony retail market,

c)

Quarterly data on the number of SMS in the retail market,

d)

Quarterly data on the number of SIM cards used (2G/3G/4G, prepaid/postpaid),

e)

Quarterly data on the number of SIM cards used for M2M services,

f)

Quarterly data on the data volume Up-and download at the mobile end customer market.

3.

Statistics on leased lines, these have to include:

a)

Quarterly data on sales from national end-customer leased lines, differentiated according to data rate,

b)

Quarterly data on the number and capacity of national end-customer leased lines, differentiated according to data rate,

c)

Quarterly data on sales from national leased lines and services at the level of services, differentiated according to data rate,

d)

Quarterly data on the number and capacity of national leased lines and services at the service level, differentiated according to the data rate.

4.

Statistics on broadband access, these have to include:

a)

Quarterly data on the number of end-user broadband connections differentiated according to infrastructure, bundle variant, bandwidth and product group (private customer/non-private customer products),

b)

Quarterly data on sales from end-user broadband lines, differentiated according to bundle variant and product group,

c)

Quarterly data on the number of broadband connections offered and purchased on the wholesale market, differentiated according to infrastructure and bitstream/resale,

d)

Quarterly data on the sales of broadband lines offered and purchased on the wholesale market.

5.

Statistics on the number of porting processes, these have quarterly values on the number of porting operations, differentiated by range (geographical numbers, mobile phone numbers, service call numbers) as well as number of numbers and number of subscribers, shall be included.

6.

Statistics on business performance indicators for employees and investments in the telecommunications sector, which have to include:

a)

Quarterly values on the number of employees and the number of leasing personnel and free employees,

b)

Annual values on the level of investments in technical infrastructure, in frequencies as well as in sales and customer service (call centers, shops) in the telecommunications sector.

Annexes 1 to 7 shall be replaced by Annexes 1 to 6 to this Regulation.
