104. Regulation of the Federal Minister for transport, innovation and technology, which changes the communications Survey Ordinance

Due to 90 paragraph 2 of the Federal law, a telecommunications law passed is (Telecommunications Act 2003 TKG 2003), Federal Law Gazette I no. 70/2003, amended by the Federal Act, Federal Law Gazette I no. 102/2011, is prescribed:

The communications Survey Ordinance, Federal Law Gazette II No. 365/2004, is amended as follows:

1. paragraph 1 paragraph 2:

"(2) the following statistics are to create: 1. quarterly statistics on sales, infrastructure, traffic values and number of customers or connections with carrier selection or pre-selection of public voice telephony at fixed locations, 2nd quarter statistics on sales, traffic values and number of used SIM cards from public mobile services, 3rd quarter statistics on sales, number and capacity of leased lines and Ethernet services, 4th quarter statistics on sales and number of broadband, 5. quarterly statistics on the number of Concierge operations" ", 6 quarter statistics on business figures to staff and investment in the telecommunications sector."

2. paragraph 7 subsection 2:

"(2) (following publications are quarterly by the Rundfunk und Telekom Regulierungs-GmbH to create and to publish at least one quarter after completion of the survey pursuant to section 1, subsection 1, sentence 2 and 3 on the Internet: 1. statistics on public voice telephony at fixed locations, they have to include: a) quarterly figures on the revenues from access services for public voice telephony at fixed locations divided into customer group (private/non-private)" , b) quarterly figures on revenue from connection fees for calls over the public telephone network at a fixed location distinguished by customer group (private/non-private) and after talking distance (domestic landline, domestic mobile network, international, service numbers), c) quarterly figures on the number of connections, differentiated according to type of connection (POTS, ISDN, mult-ISDN), d) quarterly figures on the number of customers or connections with carrier selection or pre-selection, s) quarterly results over the minutes on the fixed retail market , differentiated by conversation distance (domestic landline, domestic mobile network, foreign service numbers), f) quarterly figures on the development of revenues from origination, termination, and transit.

2. statistics on public mobile radio services, they have to include: a) quarterly figures on the total turnover from mobile telephony, b) quarterly figures on the minutes of the mobile retail market, c) quarterly figures on the number of SMS of the retail market, d) quarterly figures on the number of used SIM cards (2 G / 3 G / 4 G, prepaid/postpaid), e) quarterly figures on the number of the used SIM cards for M2M services, f) quarterly figures on the volume of data embedding and download on the mobile end-customer market.

3. statistics on leased lines, they have to include: a) quarterly figures on the revenues from national retail leased lines, classified data rate, b) quarterly figures on the number and capacity of national retail leased lines, differentiated according to data rate, c) quarterly figures on the revenues from national leased lines and Ethernet services at wholesale level, distinguished according to data rate, d) quarterly figures on the number and capacity of national leased lines and wholesale Ethernet services that distinction after data rate.

4. statistics on broadband access, they have to include: a) quarterly figures on the number of end customers broadband distinguished infrastructure, bandwidth and product group (retail / not retail products), bundle variant, b) quarterly figures on revenue from end broadband connections, differentiated bundle version and product group, c) quarterly results about number of offered on the wholesale market and bought broadband lines, divided into infrastructure and Bitstream/resale, d) quarterly figures on the revenues from broadband connections offered on the wholesale market and bought.

5. statistics on the number of Concierge operations, these have quarterly figures about the number of Concierge operations, to include phone numbers and number of participants, distinguished by area (geographical phone numbers, mobile phone numbers, service numbers), as well as number.

6 statistics on business figures to staff and investment in the telecommunications sector, they have to include: a) quarterly figures on the number of its own staff and the number of leased employees and freelancers, b) annual values of the level of investment in technical infrastructure, frequencies, as well as in sales and customer service (call center, shops) in the telecommunications sector.

3. appendices 1 to 7 will replace the plants 1 to 6 to this regulation.
