131. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, on the criteria for the evaluation of whether a PM 10 -crossing of the limit on the whirling of particles after spreading of stray salt or streusplitt is due to (IG-L-Winter Scattering Ordinance)

On the basis of § 7 (3) of the Immission Protection Act-Air (IG-L), BGBl. I n ° 115/1997, in the version of the Federal Law BGBl. I No 77/2010, shall be arranged:

Scope

§ 1. (1) For the determination according to § 7 (1) Z 3 IG-L, whether the daily mean value or the annual mean value for PM is exceeded 10 did not occur in accordance with Appendix 1a IG-L without any contributions from the whirling of particles after the spreading of scattering salt or streusplitt on roads in winter service, and thus no status survey according to § 8 paragraph 1 Z 2 lit. c IG-L is to be carried out and no program according to § 9a lit. c IG-L is to be drawn up, without prejudice to any other provisions of national law, in any case, to use the provisions of this Regulation.

(2) The provisions of § 3 shall apply for those days in which the material from which the goods are delivered in the course of the winter road service has been found on the relevant sections of the road.

(3) The provisions of this Regulation shall apply only to PM 10 -limit value overruns after 19 August 2010.

Salt scattering

§ 2. If the Landeshauptmann according to § 7 para. 1 Z 3 IG-L the share of the contribution of the salt dispersion from the PM 10 -daily averaged value for the day in question, this proportion is by means of chemical analysis of the PM 10 -to determine the daily samples at the measuring point concerned. The determination shall be carried out separately for each day on which the share of salt dispersion is to be taken into account. The chemical analysis has to determine the concentration of chloride in order to permit a conclusion to the total salt concentration of the chloride-containing stray salt used at the road section in question.

§ 3. (1) If the Landeshauptmann (Landeshauptmann) in accordance with § 7 (1) Z 3 IG-L, the share of the contribution of the division of the PM (mineral particles) to the PM 10 -daily average value for the day in question shall be subject to the ratio of the daily average values of PM 2.5 to PM 10 at the same measuring point is not greater than 0.50. Under the conditions mentioned above, the share of the contribution of the spread spread to be deducted shall be 50% of the rough PM fraction in accordance with paragraph 2.

(2) The rough PM fraction shall be determined by the difference between PM's daily average values 10 and PM 2.5 calculated.

(3) Stand at a measuring point at which the contribution of the spread of the splice at the PM 10 concentration is to be assessed, not sufficient PM 2.5 Data available in accordance with para. 2 are the data of the nearest PM 2.5 -measuring point at which comparable topographical conditions and conditions prevail, the environment of which has a comparable issuer structure and the height of which is less than 200 m from the level of the PM 10 -measuring point.

Annual average value

§ 4. In order to determine, in accordance with § 7 (1) Z 3 IG-L, whether the annual mean value for PM is exceeded 10 in accordance with Appendix 1a IG-L to the whirling of particles after spreading salt or streusplitt on roads in winter service, the arithmetic mean of all the days of the year is to be made, for which on those days when a the contribution of the winter dispersion to the respective daily average value, which is to be claimed in accordance with § 2 resp. § 3 or from both determined share of the dispersion reduced daily mean value is used.

Documentation and data transmission

§ 5. (1) If the Landeshauptmann applies § 7 para. 1 Z 3 IG-L, he/she shall submit a report to the Federal Minister for Agriculture, Forestry, Environment and Water Management until 31 May of the exceeding of a limit value pursuant to § 1 paragraph 1 following year. , which shall contain at least the following information:

1.

the identification of the measuring points in which a limit value has been attributed to the contribution of salt or split scattering or both;

2.

information on whether the contribution is made from salt dispersion in accordance with § 2 or the spread of the spread according to § 3 or from both;

3.

Documentation of the use of relevant information in accordance with § 1 para. 2;

4.

Documentation of individual daily average values for PM 10 (excluding and taking into account the contribution of salt or splice or both) and PM 2.5 , if daily mean values for PM 2.5 are required in accordance with § 3;

5.

Results of the necessary chemical analyses as well as the total concentration of the chemical compound used as the scattering salt, which is the contribution of the salt dispersion to the PM 10 -the daily mean value for the day in question is deducted;

6.

Meaningful information on measures taken to reduce the contribution from salt or spline dispersion;

(2) If the Landeshauptmann applies § 7 para. 1 Z 3 IG-L, the Landeshauptmann and the Umweltbundesamt GmbH have in their annual reports according to § 35 para. 1 resp. 2 of the Regulation on a measurement concept for air pollution control, BGBl. II No 127/2012, the results of the individual PM 10 -daily averages or the annual mean value for PM 10 (without and with consideration of the contribution of salt or split or both) to be published.
