152. Regulation of the Federal Minister for agriculture and forestry, environment and water management to establish another national register of organizations that apply equivalent environmental management systems to EMAS (UMG register VO)

On the basis of § 15 para 5 of the environmental management Act (UMG), Federal Law Gazette I no. 96/2001 as amended by Federal Law Gazette I no. 99/2004 is prescribed:

Target

§ 1. The aim of the regulation is the creation of national registers for organizations, as well as the establishment of criteria for the entries in these registers.

Definitions

2. (1) disposal sites (EFB establishments) are organizations that collect waste, transport, sort, store, recycle or otherwise treat and made an agreement with the Club for disposal sites (V.EFB) on the application of the provisions of the V.EFB.

(2) responsible care companies are organizations that are subject to a voluntary initiative of the chemical industry for the purpose of improving the health, safety and environment.

(3) ISO 14001 businesses are organisations which have a certified environmental management system according to ISO 14001.

Requirements for registration

3. (1) application for registration an EFB operation, a responsible care operation or an ISO 14001 company is at the Federal Ministry of agriculture and forestry, to introduce environmental and water management in the way of the Federal Environmental Agency. The registration application shall contain the following:



1 a by an EMAS environmental verifiers validated report pursuant to § 4 ABS. 1 Z 3, para 2 Z 3 or paragraph 3 No. 2, 2. presenting a recommendation of certification signed by an EMAS environmental verifiers, a valid V.EFB certificate issued on the basis of the regulations on the requirements for disposal sites (RAEF) and an opinion of the V.EFB Advisory Board to the report, drawn up pursuant to article 4 or

3. presentation of a valid "responsible care certificate" including a statement of the EMAS environmental gutachters, which confirms that the care certificate beyond contents of the EMAS regulation are met beyond the requirements of the responsible or

4. template of a current ISO 14001 certificate that is issued by a certified EMAS environmental review and 5. evidence of the payment of cost replacement incurred for running the register by the Federal Environmental Agency as a service provider.

(2) the Federal Environmental Agency has to check the existence of the requirements for registration and to present the results as well as a draft decision the Federal Ministry of agriculture and forestry, environment and water management within twelve weeks after submission. The requirements for registration are met, the Federal Minister of agriculture and forestry has to cause the registration of environmental and water management within a week.

Requirements

4. (1) V.EFB establishments must



1. have a valid certificate of V.EFB;

2. certification recommendation signed by an EMAS environmental verifiers and a confirmation of the EMAS environmental Verifier on the involvement of employees in accordance with annex II, part B. 4 have the EMAS regulation;

3. create a report containing the following information: a) clear and unambiguous description of the organisation, a summary of its activities, products and services, as well as, where appropriate, the relationship to any parent organisations.

b) description the environmental policy of the Organization and description of the environmental management system;

(c) a description of all significant direct and indirect environmental aspects, the environmental impact of the company to significant lead, and explanation of the type of effects related to these environmental aspects;

(d) description of the environmental objectives and targets related to the significant environmental aspects and impacts;

(e) summary of the available data on environmental performance, measured by the environmental objectives and targets of the operation and obtained the significant environmental effects. The environmental performance is using core indicators set out in annex IV, section C of Regulation (EC) 1221/2009 to represent number. [Regulation (EC) No 1221/2009 on the voluntary participation by organisations in a Community eco-management and environmental audit and repealing Regulation (EC) No. 761/2001, as well as the decisions of the Commission 2001/681/EC and 2006/193/EC, OJ] [No. L 342 of December 22, 2009 S. 1.];

(f)) other factors of environmental performance, including the compliance of legislation with regard to their significant environmental impacts;

(g) reference to the applicable environmental regulations;

(h) name and accreditation or licence number of the EMAS environmental verifier and date of validation).

The report, to present the opinion of the V.EFB Advisory Committee on the report, the certificate and the certification recommendation, and annually updated data in the report are the Federal Environmental Agency in the three year interval. The report and the annually updated data in the report shall be validated by an EMAS environmental verifiers.

(2) responsible care companies must



1. a valid responsible have care certificate;

2. a statement of the EMAS environmental verifier, is confirmed by the, that care certificate beyond contents of the EMAS regulation are satisfied the requirements of the responsible and 3 create a report, containing the following information: a) clear and unambiguous description of the organisation, a summary of its activities, products and services, as well as, where appropriate, the relationship to any parent organisations.

(e) summary of the available data on environmental performance, measured by the environmental objectives and targets of the Organization and based on their significant environmental impacts. (f)) other factors of environmental performance, including the compliance of legislation with regard to their significant environmental impacts;

(g) reference to the applicable environmental regulations;

(h) name and accreditation or licence number of the EMAS environmental verifier and date of validation).

The Federal Environment Agency are to present the report, the certificate and the Declaration of the environmental verifier and annually updated data in the report in the three year interval. The report and the annually updated data in the report shall be validated by an EMAS environmental verifiers.

(3) ISO 14001 companies must



1. issued by an EMAS environmental verifiers updates ISO 14001 certificate, as well as a confirmation of the EMAS environmental Verifier on the involvement of employees in accordance with annex II, part B. 4 of the EMAS regulation have and create 2 a report that contains the following information: a) clear and unambiguous description of the organisation, a summary of its activities, products and services, as well as, where appropriate, the relationship to any parent organisations.

The Federal Environment Agency are to present the report, the certificate, and each year the updated data in the report in the three year interval. The report and the annually updated data in the report shall be validated by an EMAS environmental verifiers.

Reimbursement of expenses


§ 5. The Federal Minister for agriculture and forestry, environment and water management UMG can enjoy in the establishment and management of registers in accordance with § 15 para 5 as amended of a service provider. For registration or for the maintenance of the registration in the other national registers is the Environment Agency GmbH (UBA) service providers. The resulting expenses per calendar year is to replace the environmental agency GmbH.

Leadership of the national register

§ 6 responsible for keeping the national registries pursuant to § 15 para 5 UMG in the currently valid version is the Federal Minister for agriculture and forestry, environment and water management, which is operated in this task of the Federal Environmental Agency. The public register shall contain the following minimum information:



1 name or name of the Organization, 2. address of the Organization and phone number, 3. contact person, 4. registry number, 5. date of registration of the Organization, 6 date of a suspension or cancellation of the organization.

Gender-neutral terms

§ 7. The terms used in this regulation are gender-neutral.

Entry into force

§ 8. This regulation enter into force on the day following the announcement.
