Article 1

Federal Minister for Education, the Arts and Culture on the curricula of the New Middle Schools

Because of

1.		of the School Organization Act, BGBl. No 242/1962, as last amended by the Federal Law BGBl. I n ° 36/2012, in particular § § 6 and 21b thereof,
2.		§ 31a of the German Education Act, BGBl. No 472/1986, as last amended by the Federal Law BGBl. I No 36/2012, and
3.		with regard to Appendix 5, also § 19 of the Minorities-Schulgesetz für Kärnten, BGBl. No. 101/1959, as last amended by the Federal Law BGBl. I No 36/2012,

Is prescribed:

§ 1. The following curricula (with the exception of curricula for religious education) will be issued for the various forms of the New Middle Schools:

1.		Curriculum of the New Middle School (Appendix 1),
2.		Curriculum of the New Middle School with special emphasis on arts education (Neue Musikmittelschule) (Appendix 2),
3.		Curriculum of the New Middle School, with special emphasis on sports training (New Sports School) (Appendix 3),
4.		Curriculum of the New Middle School, with special emphasis on ski school education (New Skimittelschule) (Appendix 4),
5.		Curriculum of the departments for teaching in Slovenian language, which are set up in new middle schools with a German language of instruction (Appendix 5).

§ 2. This Regulation, together with the annexes to this Regulation (with the exception of the curricula for religious education), enter into force on 1 September 2012 and shall be applicable to:

1.		the first classes of the primary schools, which are listed as new middle schools in accordance with § 130a (1) and (3) of the School Organization Act, are applied in a school-based manner,
2.		the primary school classes, which were conducted as model classes before the beginning of the school year 2012/13 (Section 130a (2) of the School Organization Act).

Article 2

Publication of the curricula for religious education

On the basis of § 2 para. 2 of the Law of Religion, Federal Law Gazette (BGBl). No. 190/1949, as last amended by the Federal Law BGBl. I n ° 36/2012, is made known:

The curricula for religious education contained in the Fifth Part of Appendix 1 were issued by the respective churches and religious societies and are hereby incorporated by reference in accordance with § 2 para. 2 of the Law of Religion, BGBl. No. 190/1949, as last amended by the Federal Law BGBl. I No 36/2012.

Article 3

Amendment of the Performance Evaluation Regulation

On the basis of § § 18, 20, 21 and 23 of the school teaching law, BGBl. No 472/1986, as last amended by the Federal Law BGBl. I n ° 36/2012, shall be arranged:

The Performance Evaluation Ordinance, BGBl. No 371/1974, as last amended by the BGBl Regulation. II No 35/1997, shall be amended as follows:

1. § 5 (11) reads:

" (11) Oral examinations are inadmissible:

a)		in the elementary school
aa)			in the 1. to 4. School level in all subject areas,
bb)			in the 5th to 8. School level in educational education, movement and sports, work education (technical works, textile works) and geometric drawing,
b)		in the secondary school and in the New Middle School in Education, Geometric Drawing, Movement and Sport, Plant Education (Technical Works, Textile Works), Machine Writing and Short-Paper,
c)		in the Polytechnic School in Motion and Sport, Technical Drawing, Work Education, Stenotypie, Machine Writing and Short-Paper,
d)		in the general higher schools in geometric drawing, movement and sports and work education (technical works, textile works) as well as in the lower level in educational education (except in general-education higher schools under special consideration of the arts education, in so far as educational education is the main focus of education), short-writing, machine writing, visual design and work education (with the exception of general-education higher schools with special emphasis on education) Consideration of the arts education, as far as pictorial nerisms Education is very important),
e)		in the vocational schools in motion and sport, and

2. § 8 (11) reads:

" (11)		Written reviews are not permitted:
a)			in elementary school in educational education, movement and sports, work education (technical works, textile works) and geometry drawing,
b)			in the secondary school and in the new middle school in educational education, geometry drawing, movement and sports and work education (technical works, textile works),
c)			in the Polytechnic School in motion and sport, technical drawing and work education,
d)			in the general education of higher schools in darting geometry, foreign language conversation, geometric drawing, movement and sports and work education (technical works, textile works) as well as in the 1. to 5. Class in pictorial education,
e)			in vocational schools in motion and in sport and practical work, and
f)			in the vocational middle and higher schools in movement and sport. "

3. In § 11, the following paragraph (3b) is inserted after paragraph (3a):

" (3b) In addition, regular discussions between teachers, guardians and pupils, in which the student's performance and the performance of the pupil, are to be held at the New Middle School, are to be held on the 7th. and 8. 6. § 13 reads as follows:

" School types which are of particular importance for educational education, work education (technical works, textile works), movement and sports, as well as music education

§ 13. In the assessment of achievements in educational education, exercise and sports, music education and work education (technical works, textile works), Section 11 (9) is not applicable in the following cases:

a)		in the main schools and in the new middle schools, with particular regard to the arts education in music education,
b)		in the main schools and in the new middle schools, with particular emphasis on sports training in exercise and sport,
c)		in the Business School of Realgymnasium in works education (technical works, textile works),
d)		in the Oberstufenrealgymnasium with instrumental music in music education and instrumental lessons,
e)		In the Oberstufenrealgymnasium with educational design and work education in educational education and work education,
f)		in factory schools in factory education (technical works, textile works),
g)		in the general higher schools, paying particular attention to sports training in exercise and sport,
h)		in the general higher schools, with particular reference to the arts education in educational education, music education and work education (technical works, textile works), to the extent that these subjects are of major importance. ,
i)		in the educational institutions for kindergarten education and in the educational institutions for social education in educational education, exercise and sport, music education as well as work education. "

7. The following paragraph 7 is added to § 14:

"(7) In the elementary school, the special school and at the New Middle School, the class forum or the school forum may decide that the assessment of achievements by grades is to be added to a written explanation."

8. In accordance with § 14, the following § 14a and title shall be inserted:

" Special provisions concerning the performance and assessment of the performance in the New Middle School

§ 14a. (1) In the 7. and 8. The school level of the New Central School must be carried out in accordance with the requirements of the curriculum in accordance with basic and in-depth aspects of performance and assessments in the differentiated compulsory subject areas. 9. In § 22 (5) lit. a sublit. bb eliminates the word sequence "Housekeeping and Child Care" and the term "Leibesübungen" through the phrase "Movement and Sport" replaced.

10. The following paragraph 4 is added to § 24:

" (4) § 5 para. 11, § 8 para. 11, § 11 para. 3b, § 11 para. 9, § 12 paragraph 1 Z 2, § 13 including the title, § 14 para. 7, § 14a including the headline as well as § 22 para. 5 lit. a sublit. bb of this Regulation, as amended by the BGBl Regulation. Article 4

Amendment of the Certificate Forms Regulation

On the basis of § § 22 and 39 of the school teaching law, BGBl. No 472/1986, as last amended by the Federal Law BGBl. I n ° 36/2012, shall be arranged:

The Certificate Forms Ordinance, BGBl. No 415/1989, as last amended by the BGBl Regulation. II No 81/2009, shall be amended as follows:

1. § 2 (6) reads:

" (6) The assessment of the benefits is to be written in the other cases in paragraphs, in the final products, ripening certificates, maturity and diplomacy certificates, certificates of diplomacy and final examination certificates. If the conditions of § 18 (2) of the Schulunterrichtsgesetz (School Education Act) are fulfilled, a written explanation must be added. When teaching is carried out in groups of services, the assessment of the performance group visited by the student must be indicated; in the case of vocational schools, a note must be made only when visiting compulsory subject areas with extended or deepened the offer of education provided that this endorsement is not necessary because of the specific description of these compulsory items. 8e.		if the class conference is in accordance with § 55 paragraph 1a of the School Organization Act, BGBl. No 242/1962, as amended, states that, in spite of an assessment of a differentiated compulsory subject, the pupil is entitled to 'sufficient' in accordance with the educational objective of the basic general education as a result of his or her other benefits. is likely to meet the requirements of at least three-year vocational medium-sized schools:
"		He/she meets the requirements for admission to the 1. Class of at least three-year vocational middle school. ";
8f.		if the class conference is in accordance with § 68 (1) Z 4 of the School Organization Act, BGBl. No 242/1962, as amended, states that, in spite of an assessment of a differentiated compulsory subject, the pupil has to perform the basic general education on the basis of his or her other achievements with a large degree of general education. The probability of the requirements of the vocational higher school will be sufficient:
"		He/she fulfils the conditions for admission to the first year of a vocational higher school. ";
8g.		if the class conference pursuant to § 5 (3) (3) (3) of the Ordinance on the Reception And Aptitude Tests, BGBl. No 291/1975, as amended, states that, in spite of the assessment of a differentiated compulsory subject, the pupil has to perform the basic general education on the basis of his or her other achievements with a large degree of general education. The probability of the demands of the higher institutions of teacher education and educating will be sufficient:
"		He/she meets the requirements for admission to the 1. Class of a higher institution of teacher education and educating. ";"

5. In Section 5 (2), after Z 3, the point is replaced by an accoration and the following Z 4 is added:

" 4.		in the case of new middle schools, the endorsement of the entitlement to transfer to a middle and/or higher school after the 8. School level. "

(6) The following paragraph 12 is added to § 12:

Article 5

Amendment of the Regulation on reception and aptitude tests

On the basis of § § 6 to 8 of the school teaching law, BGBl. No 472/1986, as last amended by the Federal Law BGBl. I n ° 36/2012, shall be arranged:

The regulation of the Federal Minister of Education, Arts and Sport on the admission and aptitude tests, BGBl. No 291/1975, as last amended by the BGBl Regulation. II No 440/2006, shall be amended as follows:

1. In § 1, after the term "Hauptschule" an inversion and the phrase "the New Middle School" inserted.

2. § 5 (3) reads:

" (3)		The written examinations in German, the Living Foreign Language and Mathematics will be omitted if these compulsory items are
1.		in the 4th Class of higher education in general, or

On the basis of § § 3 and 29 to 31 of the school teaching law, BGBl. No 472/1986, as last amended by the Federal Law BGBl. I n ° 36/2012, shall be arranged:

The regulation of the Federal Minister of Education and Arts on the one-stage examination as a prerequisite for admission to the school and the receiving examination as a prerequisite for the transfer to another school type, BGBl. No 347/1976, as last amended by the BGBl Regulation. II No 501/1992, shall be amended as follows:

1. In Section 1 (1), the term shall be based on the term "Specialdirection" the phrase "or another priority area" inserted.

The Opening-and Partial Numerical Ordinance, BGBl. No 86/1981, as last amended by the BGBl Regulation. II No 420/2008, shall be amended as follows:

Article 9

Amendment of the Regulation on the exemption from participation in individual countries Mandatory items

The regulation of the Federal Minister of Education and the Arts on the Liberation of Participation in Individual Obligatory Items, BGBl. No 368/1974, as last amended by the BGBl Regulation. No 420/1983, shall be amended as follows:

The regulation on educational standards in schools, BGBl. II n ° 1/2009, as last amended by the BGBl Regulation. II No 282/2011, shall be amended as follows:
