Regulation of the Federal Minister for education, art and culture of the curricula of the new secondary schools

Due to 1 of the school Organization Act, Federal Law Gazette No. 242/1962, as last amended by Federal Law Gazette I no. 36/2012, in particular its paragraphs 6 and 21b, 2. § 31a of the Education Act, Federal Law Gazette No. 472/1986, as last amended by Federal Law Gazette I no. 36/2012, as well as 3. with regard to the Appendix 5 also of § 19 of the minority schools Act for Carinthia, Federal Law Gazette No 101/1959, as last amended by Federal Law Gazette I no. 36/2012 , is prescribed:

§ 1. For the various forms of the new secondary schools following curricula (with the exception of the curriculum for religious education) be adopted: 1 curriculum of the Neue Mittelschule (Appendix 1), 2. syllabus of the new middle school, focusing on the musical education (new music school) (Appendix 2), 3. syllabus of the new middle school, focusing on sports training (new sports school) (Appendix 3), 4. syllabus of the new middle school, focusing on the sport education (new ski school) (annex 4) , 5. curriculum of departments for teaching in Slovenian language, which are decorated in new secondary schools with German language of instruction (Appendix 5).

§ 2. This regulation and the schedule to this Regulation (with the exception of the curriculum for religious education) come into force on September 1, 2012 and for the first classes on 1 of the major schools, carried out in accordance with article 130a, paragraph 1 and 3 of the school organization act as a new secondary schools, school gradually ascending application, 2. main classes, conducted before the start of the school year 2012/13 model experimental classes (§ 130a para 2 of the school Organization Act) , Application.

Article 2

Notice the curriculum for religious education

On the basis of § 2 para 2 of the religious education law, BGBl. No. 190/1949, as last amended by Federal Law Gazette I no. 36/2012, will be made known:

The curricula for teaching religion contained in the fifth part of Appendix 1 were adopted by the churches and religious societies and be hereby referred to in § 2 para 2 of the religious education law, BGBl. No. 190/1949, as last amended by Federal Law Gazette I no.  36/2012, made known.

Article 3

Performance assessment regulation

On the basis of §§ 18, 20, 21 and 23 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by the Federal Act Federal Law Gazette I no. 36/2012, is prescribed:

Performance evaluation regulation, Federal Law Gazette No. 371/1974, as last amended by regulation Federal Law Gazette II No. 35/1997, is amended as follows:

1. paragraph 5 paragraph 11:

"(11) (oral exams are not allowed: a) (in the elementary school aa) bb in 1 – 4 grade in all subjects) in the 5th-8th grade in Visual education, exercise and sports, work education (technical works, textile works) and geometric drawing, b) in secondary school and in the Neue Mittelschule in Visual education, geometric drawing, movement and sport, work education (technical works, textile works)" , Maschinschreiben and shorthand, c) in the Polytechnic School of movement and sport, technical drawing, work education, Stenotypie, Maschinschreiben and shorthand, d) in the higher schools of general education in geometric drawing, movement and sport and work education (technical works, textile works), as well as in the lower school in Visual education (except in higher schools of general education with particular reference to the musical training, as far as art education is focus-forming), shorthand ", S) in the vocational schools in movement and sport-f) in the educational institutes for nursery and in the education institutes for Social pedagogy in kindergarten, Hort practice and home practice."

2. § 8 paragraph 11 is: "(11) (written checks are not permitted: a) in elementary school in Visual education, exercise and sports, work education (technical works, textile works) and geometric drawing, b) in secondary school and in the Neue Mittelschule in Visual education, geometric drawing, movement and sports and work education (technical works, textile works)(, c) in the Polytechnic School of movement and sport, technical drawing and movement education" "(, d) in the higher schools of general education in foreign language conversation, geometric drawing, movement and sport, performing geometry and work education (technical works, textile works), as well as in the 1st to 5th class in Visual education, e) in vocational schools in exercise and sport and practical work and f) in the vocational schools and colleges in exercise and sports."

3. in article 11, b is inserted after paragraph 3a the following paragraph 3:

"(3B) on the new middle school are beyond regular discussions between teachers, to provide guardian and students together to discuss are the strengths of the performance and the performance level of the student, on the 7th and 8th grade in particular with regard to the educational goal of the in-depth education where." If the performance of a student in the 7th and 8th subside grade in the deepening of a differentiated mandatory item to the extent that he to assess only more according to the requirements of the basic general education would be at the end of the year, this is the parent/guardian must be notified immediately and the students as well as the guardian of the class Board, or the teaching teacher opportunity to a consultative discussion of that to give paragraph 3a of the Education Act funding opportunities within the meaning of article 19. 5. in article 12, paragraph 1 Z 2 is used for the term "Secondary school" a comma and inserted the phrase "in the Neue Mittelschule".

6 section 13 is together with the heading:

"Schools, whose task of art education, work education (technical works, textile works), movement and sports as well as music education of particular importance"

§ 13. In assessing the achievements in creative education, movement, music education and sports work education (technical works, textile works) is section 11 paragraph 9 in the following cases do not apply: a) in the schools and in the new secondary schools, focusing on the musical education in music education, b) in the schools and in the new secondary schools with special consideration of sports training in exercise and sport , c) in the Wirtschaftskundlichen Realgymnasium in work education (technical works, textile works), d) Oberstufenrealgymnasium with instrumental music in music education and instrumental instruction, e) Oberstufenrealgymnasium with pictorial design and work education in creative education and work education, f) in factory school institutions in work education (technical works, textile works), g)

"(in den allgemeinbildenden höheren Schulen unter besonderer Berücksichtigung der sportlichen Ausbildung in Bewegung und Sport, h) in the higher schools of general education, focusing on the musical education in Visual education, music and movement education (technical works, textile works), as far as these subjects are focus, i) in the training institutes for nursery and in the educational institutes for Social pedagogy in Visual education, movement and sport, music education and work education."

7 the following paragraph 7 is added to § in 14:

"(7) in the elementary school, the school and the new school the class forum or the school Forum may decide that a written explanation to add is assessment of performance by notes."

8. after section 14 the following section 14a and heading is inserted:

'Special provisions on the performance assessment and assessment in new middle school

§ 14a. (1) in the 7th and 8th grade of the Neue Mittelschule performance findings and reviews in the differentiated mandatory subjects according to the requirements of the curriculum according to basic and in-depth aspects must be made. Performance findings have to expel the assessment according to the requirements of the Basic or the in-depth education.

9. in article 22, paragraph 5 lit. a sublit. BB is omitted the phrase "Housekeeping and child care" and the term "Physical education" is replaced by the phrase "Exercise and sport".

10 the following paragraph 4 is added to § the 24:

"(4) § 5 para 11, § 8, paragraph 11, section 11 subsection 3 b, section 11, paragraph 9, article 12, paragraph 1 Z 2, § 13, including heading, § 14 paragraph 7, § 14a along with heading and section 22 paragraph 5 lit." a sublit. BB No. 185/2012 II this Regulation as amended by regulation BGBl. 1 September 2012 into force."

Article 4

Change the certificate form regulation

On the basis of articles 22 and 39 of the school education law, BGBl. No. 472/1986, as last amended by Federal Law Gazette I no. 36/2012, is prescribed:

The certificate form regulation, Federal Law Gazette No. 415/1989, as last amended by the regulation BGBl. II No 81/2009 is amended as follows:

1. paragraph 2 paragraph 6:

"(6) the assessment of the performance is in the diplomas, graduate certificates, in words, in other cases in digits to write matriculation and diploma certificates, diploma certificates and completion certificates. There is a written explanation on how to add the requirements of § 18 para 2 of the Education Act. If instruction in ability groups, the performance group visited by the students in assessing is to specify; in vocational schools, a related note only visiting the compulsory items with extended or recessed education is to record, provided that this notice not for the special designation of this compulsory subjects is dispensable. 2. in article 3, paragraph 1 Z 1 b is for the term "Secondary school" a comma used and inserted the phrase "the 3rd class of the new middle school".

3. in article 3, paragraph 1 Z 8 c be the quote "§ 5 para 2" by the quote "article 5 par. 3 No. 2" and the quote "BGBl. No. 271/1975" by the quote "BGBl. No. 291/1975" replaced.

4. in article 3, paragraph 1 8 c are inserted after Z following Z 8 d up to 8 g: "8 d.
If the class Conference according to § 40 paragraph 3a of the school Organization Act, Federal Law Gazette No. 242/1962, in its up-to-date version, notes that students despite evaluation of differentiated mandatory items will meet the requirements of secondary of general-education secondary school after the educational goal of in basic education due to its other services most likely: "He/she meets the requirements for inclusion in the 5th class of secondary higher school.";

8. If the class Conference in accordance with § 55 paragraph 1a of the school Organization Act, Federal Law Gazette No. 242/1962, in its up-to-date version, notes that students despite evaluation of differentiated mandatory items will meet the requirements of a minimum three-year vocational middle school after the educational goal of in basic education with "Enough" due to its other services most likely: "He/she meets the requirements for inclusion in the 1st class of an at least three-year vocational middle school.";

8F. If the class Conference in accordance with article 68, paragraph 1 No. 4 of the school Organization Act, Federal Law Gazette No. 242/1962, in its up-to-date version, notes that students despite evaluation of differentiated mandatory items will meet the requirements of vocational high school after the educational goal of in basic education due to its other services most likely: "He/she is eligible for inclusion in the vintage of a vocational higher school.";

8. If the class Conference pursuant to § 5 para 3 Z 3 of the Ordinance, the Aufnahms - and aptitude tests, Federal Law Gazette No. 291/1975, in its up-to-date version, notes that students despite evaluation of differentiated mandatory items will meet the requirements of the higher institutes of teacher education and the teacher education according to the educational goal of in basic education due to its other services likely ":"He/she fulfils the requirements for inclusion in the 1st class of a higher Institute of teacher education and the teacher education.";"

5. in § 5 para 2 after no. 3 the point replaced with a comma and following Z 4 added: "4th at new schools if applicable the note of permission to the progression in a medium or higher school after the 8th grade."

6 12 the following paragraph is added to in section 12:

"(12) § 2 article 6, § 3 para 1 Z 1b, 8c and 8 d 8 g, § 5 paragraph 2 No. 4 and Annex 2a to this Regulation as amended by regulation BGBl. II Nr 185/2012 1 September 2012 into force."

Article 5

Amendment of the regulation of the Aufnahms - and proficiency tests

On the basis of §§ 6-8 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by Federal Law Gazette I no.  36/2012, is prescribed:

Ordinance of the Federal Minister for education, art and sport of the Aufnahms - and proficiency tests, Federal Law Gazette No. 291/1975, as last amended by the regulation Federal Law Gazette II No. 440/2006, is amended as follows:

1. in article 1, for the term "Secondary school" a comma used and inserted the phrase "the new school".

2. § 5 para 3 is: "(3) the written exams in German, living foreign language and mathematics are eliminated, if these compulsory subjects, 1 in the 4th class of secondary higher school or 2. in the first performance group of the middle schools at least with"Enough"or in the II. performance group of secondary school at least with"Good"have been assessed or performance group of middle schools with"Fair"have been assessed in the II. and determines the secondary school class Conference" ", that students will comply with the requirements of the higher institutes of teacher education and the teacher education due to his other achievements with great probability or 3rd in new middle school have been assessed according to the educational aim of deepening or, if this does not apply to (only) one of these items, the new middle school class Conference notes that the students most likely will meet the requirements of a higher school."

3. in article 15, the citation is after the citation "section 55, paragraph 1" "and § 55 para 1a" inserted.

4. the heading of section 7 is as follows:

"7TH SECTION

Aptitude test at higher schools of general education, new schools and schools with particular reference to the musical training"

5. the heading of 8 section is as follows:

"8 SECTION

Aptitude test at higher schools of general education, new schools and schools with particular reference to the athletic training (including new ski schools and ski schools)"

6. in section 53 para 2, used a comma after the term "Power group" and inserted the phrase "in the 8th grade of the new middle school".

7 the following paragraph 6 is added to in article 55:


"(6) § 1, § 5 para 3, § 15, the headings of the 7th and the 8th section as well as section 53 para 2 of this Regulation as amended by the Ordinance BGBl. No. 185/2012 II contact force, September 1, 2012."

Article 6

Modification of the Ordinance on the placement exam as a prerequisite for admission to the school and passes the entrance examination as a prerequisite for the transfer to a different school

On the basis of §§ 3 and 29 to 31 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by the Federal Act Federal Law Gazette I no. 36/2012, is prescribed:

Ordinance of the Federal Minister for education and art on the placement exam as a prerequisite for inclusion in the school and passes the entrance examination as a prerequisite for the transfer in a different school, Federal Law Gazette No. 347/1976, amended by regulation BGBl. II No 501/1992, is amended as follows:

1. in article 1, paragraph 1, the phrase "or any other focus area" is inserted after the term "Specialization".

2. in article 2, paragraph 2, the phrase "or the focus area" is inserted after the term "Specialization".

3. in section 4, paragraph 2, and in section 7, paragraph 2 each, the phrase "or the Neue Mittelschule" is inserted after the phrase "Curriculum of the secondary school".

4. in § 4 para 3 to 5, § 5, article 7, par. 4 and 5 article 8, both the phrase "or of the focus area" is inserted after the term "Specialization".

5. paragraph 7 para 3:

"(3) the Department shall include items from the subjects which were subject to duty in one of the previous levels of the target school or form or discipline or focus area of a school and the conversion applicant still not or not visited in almost same extent. In the case of the transfer of major students in higher schools of general education, passes the entrance examination has to include tasks from those compulsory items, in which the year report of the transfer applicant contains not the performance assessment, no. 242/1962, in the current version, for a transfer without Department is prescribed in accordance with article 40, paragraph 2 and 3 of the school Organization Act, Federal Law Gazette; for the transfer of pupils of the new middle school in higher schools of general education applies paragraph 2a and 3a of the school organization act in terms of section 40."

6. in article 14, paragraph 4, the phrase "or of the same priority" is inserted after the term "Specialization".

7. the previous section 16 receives the sales designation (1) and the following paragraph 2 is added:

"(2) § 1 para 1, § 2 para 2, § 4 paragraph 2 to 5, § 5, section 7 para 2 to 5, § 8 and § 14 para 4 of this Regulation as amended by regulation BGBl. II Nr 185/2012 1 September 2012 into force."

Article 7

Change of Aufnahmsverfahrensverordnung

On the basis of section 5 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by Federal Law Gazette I no. 36/2012, is prescribed:

The Aufnahmsverfahrensverordnung, BGBl. II no 317/2006, as last amended by regulation BGBl. II No 297/2007, is amended as follows:

1. in the heading to section 3, for the term "Secondary school" a comma used and inserted the phrase "the new school".

2. in paragraph 7, the phrase "and new practice schools" is inserted after the term "Practice schools".

The following paragraph 3 is added to § 3. 10:

"II No. 185/2012 apply (3) the heading to § 3 and § 7 of this Regulation as amended by regulation BGBl. 1 September 2012."

 

Article 8

Change the opening and partition numbers regulation

On the basis of § 8a 1 of the school Organization Act, Federal Law Gazette No. 242/1962, as last amended by the Federal Act Federal Law Gazette I no. 36/2012, is prescribed:

The opening and partition numbers regulation, Federal Law Gazette No. 86/1981, as last amended by the regulation BGBl. II no 420/2008, is amended as follows:

1. in article 2, para. 1, subpara 1 lit. c is inserted after the term "Secondary school" the phrase "or of the new middle school".

The following paragraph 8 is added to § 2. 10:

"(8) § 2 para 1 subpara 1 lit. c of this regulation in the version of regulation BGBl. No. 185/2012 II is September 1, 2012, power."

 

Article 9

Amendment of regulation relating to exemption from participation in individual compulsory items

On the basis of § 11 section 6 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by the Federal Act Federal Law Gazette I no. 36/2012, is prescribed:

Ordinance of the Federal Minister for education and art on the exemption from participation in individual duty goods, BGBl. No. 368/1974, as last amended by the regulation BGBl. No. 420/1983, is amended as follows:

1. in section 2, paragraph 2, the phrase "or on the Neue Mittelschule" is inserted each for the term "Secondary school".

2. the previous section 7 receives the sales designation (1) and the following paragraph 2 is added:

"(2) section 2 paragraph 2 of this Regulation as amended by regulation BGBl. II Nr 185/2012 comes into effect with September 1, 2012."

 

Article 10

Amendment of the regulation on educational standards in schools

On the basis of § 17 para 1a of the Education Act, Federal Law Gazette No. 472/1986, as last amended by Federal Law Gazette I no. 36/2012, is prescribed:

The regulation on educational standards in schools, Federal Law Gazette II No. 1/2009, last modified by regulation Federal Law Gazette II No. 282/2011, is amended as follows:

1. in article 1, paragraph 1, as well as the heading to the 2nd part of the facility, for the term "Hauptschule" each used a comma and inserted the phrase "the new school".

2. in article 1, paragraph 1 Z 2 is used for the term "Secondary school" a comma and inserted the phrase "New school".

The following paragraph 3 is added to § 3. 5:

"(3) § 1 para 1, § 1 para 1 No. 2 as well as the heading for the 2nd part of this Regulation as amended by the Ordinance BGBl. No. 185/2012 II with 1 September 2012 in force."

 

Article 11

Regulation of educational documentation

On the basis of § 6 par. 2 and §§ 8 and 9 of the training documentation Act, Federal Law Gazette I no. 12/2002, as last amended by Federal Law Gazette I no. 36/2012, is prescribed:

The educational documentation regulation, Federal Law Gazette II No. 499/2003, as last amended by the regulation BGBl. II No 308/2010, is amended as follows:

1 the following paragraph 4 is added to § the 24:

"(4) Appendix 1 Z 5 and 7 of this Regulation as amended by regulation BGBl. II Nr 185/2012 enter into force with September 1, 2012."

2. in annex 1 Z 5 is in the attribute "stand" the row with the value "ah":

Article 12

Amendment of the regulation on the election of student representatives

On the basis of §§ 59, 59a and 64 of the Education Act, Federal Law Gazette No. 472/1986, as last amended by Federal Law Gazette I no. 36/2012, is prescribed:

Ordinance of the Federal Minister for education and art about the election of student representatives, Federal Law Gazette No. 388/1993, as last amended by the regulation Federal Law Gazette II No. 142/1997, is amended as follows:

1 § 1a paragraph 1 reads:

'section 1a. (1) for Volksschuloberstufen, for schools, for new secondary schools, for the 5th to 8th grades of the schools listed according to the curriculum of the schools or the new secondary schools and for the steps of the general-education secondary schools based on a representative of the class President and a Deputy are to choose."

2 the following paragraph 4 is added to in section 22:

"(4) § 1a para 1 of this Regulation as amended by regulation Federal Law Gazette II No. 185/2012 comes into effect with September 1, 2012."

 

Article 13


Amendment of the regulation on the election of the representatives of the class parents

On the basis of section 63a of the Education Act, Federal Law Gazette No. 472/1986, as last amended by the Federal Act Federal Law Gazette I no. 36/2012, is prescribed:

Ordinance of the Federal Minister for education, art and sport, on the choice of the class parent representative, Federal Law Gazette No. 285/1988, is amended as follows:

1. in article 1, Z 1 is inserted after the term "Secondary school" the phrase "and the new secondary school".

The following paragraph 3 is added to § 2. 11:

"(3) § 1 Z 1 of this Regulation as amended by regulation BGBl. II Nr 185/2012 comes into effect with September 1, 2012."
