219. Regulation of the Federal Minister for Transport, Innovation and Technology on the protection of railway systems and rail vehicles (Railway Safety Regulations-EisbSV)

On the basis of Section 47c of the Railway Act 1957-EisbG, BGBl. N ° 60, as last amended by the Federal Law BGBl. I No 50/2012, shall be arranged:

Scope

§ 1. (1) This Regulation shall apply to all railways (main and secondary railways, trams, cableways and webs of material) in accordance with § 1 of the EisbG, as amended, and shall determine that for the protection of railway installations, the operation of a railway, the operation of rail vehicles on a railway and rail transport behaviour of the railway users.

For the purposes of this Regulation, railway users shall be passengers and passengers who accompany or collect passengers and any other persons who are not, for the purposes of carrying out the operation or the transport of the railway on railway lines, or in rail vehicles (e.g. freight transport customers, cleaning staff, construction workers from non-railway undertakings).

Behaviour within the railway systems

§ 2. (1) Rail installations may only be entered in certain places, except for the persons referred to in § § 3 and 4; these are those which serve the general purpose of transport or make it possible for them, such as railway platforms, to and from the railway system. Exits, in particular rail corridors, crossing and underpasses, waiting rooms, sanitary facilities, parking spaces and railway crossings; otherwise the entry of railway equipment is prohibited.

(2) The stay

1.		in the danger zone marked by the edge of the platform and the marking of the ground (warning strips), and
2.		on the platforms of main and secondary railways, which do not have a hazard area marked by ground markings (warning strips),
shall be limited to the extent necessary for the boarding and boarding after the stopping of trains and before the door-closing warning signal or the announcement of the departure.

(3) In the case of rail inclines, the end of the rail has to be made sure that the tracks are crossed without danger and that they cross the same as quickly as possible.

(4) Shutting down or banning "access to unauthorized persons" shall be deemed to be a prohibition to cross the tracks if these barriers or warnings are placed before, between or after the tracks.

(5) The entering of railway equipment at the points determined for this purpose (pursuant to para. 1) and the stay there within the closed periods of public information are prohibited.

(6) derogations from the provisions of paragraphs 1 to 5 shall be permissible if such provisions have been arranged on a case-by-case basis by railway inspectorates who have convinced themselves that these arrangements can be complied with without delay and without delay (e.g. as a result of technical breakdowns, malfunctions or accidents).

(7) (1) to (5) shall not apply to:

1.		Members of mission organisations and other auxiliary staff in the course of an aid operation or
2.		persons who, with the express consent of the railway undertaking, are to reside in areas not used for general transport purposes,
if operational measures and on-the-spot rail staff present on the spot ensure that they enter the market safely.

Behaviour of the persons referred to in § 47 (2) EisbG

§ 3. (1) The institutions of the authorities referred to in Article 47 (2) of the EisbG, the experts appointed by these authorities, as well as the members of the Austrian Federal Army, may only enter railway installations without permission cards, if and as long as this is the case. The exercise of their duties is required.

(2) The persons referred to in paragraph 1 shall have the following conditions when entering railway installations, in so far as it is compatible with the exercise of their duties:

1.		prior agreement of the railway undertaking from the intended entry of the hazard area of the railway track;
2.		if a rail operator is advised to use safe transport routes, they shall be used;
3.		For better recognizability is a suitable, the provision of § 102 (10) of the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law BGBl. I No 116/2010, to wear appropriate warning clothing with white retroreflective stripes.

Special permission to enter railway facilities

§ 4. (1) A railway undertaking may issue permits for the entry of railway equipment only to persons who have been shown to have completed the training required for railway staff to enter the hazardous areas.

(2) holders of permission cards shall have to observe the following when entering railway facilities:

1.		if available, use exclusively the internal transport routes designated in accordance with the local guidelines, which are used to safely reach buildings, operating facilities or jobs;
2.		the danger space of the tracks shall be entered only in essential cases;
3.		For better recognizability is a suitable, the provision of § 102 (10) of the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law BGBl. I No 116/2010, to wear appropriate warning clothing with white retroreflective stripes.

Special hazard areas

§ 5. In the case of high-voltage installations without a suitable insulating protective device, the body and the objects carried along shall be subject to a protective distance, unless it has been established without any doubt that these high-voltage installations are not under tension. are and are grounded.

Behaviour of the rail users

§ 6. (1) Within the railway systems, a behaviour which disrupts the operation of a railway, the operation of rolling stock on a railway, and the traffic on a railway is prohibited. In particular, it shall be prohibited,

1.		Use, use, damage, ascend or contaminate railway systems, railway engineering facilities and rail vehicles;
2.		to put items on the roadway;
3.		-other obstacles to driving;
4.		Switch to a soft switch;
5.		Operating the circuit breakers;
6.		abusive safety or emergency equipment, alarm or signals to be given.

(2) The entry into service of railway installations, with the exception of those designated for this purpose, shall be authorised only with a permit issued by the railway undertaking.

(3) Rail users shall immediately comply with the official instructions of the railway supervisory bodies, provided that they show the identity card issued in accordance with Section 30 (2) EisbG.

(4) In the case of the use of railway and rail vehicles, railway users have to behave in such a way as to the safety and order of the operation of the railway, the operation of railway vehicles on the railway, the traffic on the railway, the railway vehicles and the railway vehicles. 		to the extent that this is not necessary after the stopping of trains and before the door-closing warning signal or the handling announcement for the boarding and boarding;
3.		to be leaning out of rail vehicles;
4.		Animals which may endanger, hinder or harass other users of the railway shall be allowed to take along; dogs may be transported only on a leftist basis and provided with protective measures, except in the case of dogs for persons with visual impairment; other pets are not permitted. to be transported in safe containers;
5.		to take along dangerous objects, such as unpacked saws, stains, glass panes or loaded firearms;
6.		Route and escape routes, access to elevators, escalators or pavements, to be set up or blocked;
7.		to depart bicycles and other vehicles outside the areas designated for this purpose;
8.		Provision of or unauthorised reference to facilities intended for persons with disabilities, such as access ramps, tactile blinding systems.

(5) Rail users shall be allowed to enter and exit only at the places designated for this purpose and only at the side of the rail vehicles designated for this purpose. In particular, it is also forbidden to leave rail vehicles on main and secondary railways away from platforms, trams outside of stops.

(6) As long as a rail vehicle is in motion, the opening of the outside doors of the rail vehicle, the entering of the footboards and the linings on unsecured open platforms as well as the entry and exit are prohibited.

(7) It is prohibited to throw objects from the rail vehicle.

(8) Non-public railway crossings may be used only by those entitled to it and only under the conditions to be prescribated by the railway undertaking for safety reasons.

(9) Exceptions to the prohibitions laid down in paragraphs 1 to 8 shall be permitted where, on a case-by-case basis, such prohibitions have been ordered by railway inspectorates who have been satisfied that such arrangements can be safely complied with.

(10) The persons referred to in § 3 (1) shall be exempted from compliance with the provisions of paragraphs 1 to 7, insofar as this is necessary for the exercise of the duties of the service. In addition, state security bodies may also carry out firearms in the loaded state if this is not necessary for the performance of the duties.

§ 7. Infringements of the provisions and prohibitions of this Regulation shall be punishable in accordance with Section 162 (1) of the EisbG (EisbG).

§ 8. This Regulation shall enter into force on 1 September 2012.
